CA This is intended to describe an agreement to construct a new segment of a `good neighbor fence" to be constructed between the properties at 20550 Blossom Lane and 20544 Blossom Lane, both of Cupertino, CA. Both owners agree that the fence can only approximate the property line and that small portions of their property may lie on the other side of the fence. As a consequence, and so as to preserve full property rights, this "good neighbor" fence agreement is in no way intended to modify the legal property description of either property and to the extent that the new fence may deviate from the legal boundary between the two properties, each property owner grants that the other may use that portion of their property on the other side of the fence by permission which is revocable at any time. Both neighbors agree to share in the cost of constructing the new "good neighbor" fence segment (GNF) The new fence segment (GNF) will abut both an existing backyard fence (BF) which lays East to West along the southernmost extent of the two properties, and an 7 -1/2 foot high existing side fence (ESF, running North - South) and that lies between the two houses and to the North of the currently standing garage. The new fence segment is to be constructed on a straight line between two points defined on existing fence posts that will remain standing. One of these points is a northernmost point (NP) and the other is a southernmost point (SP). The northernmost point (NP) of the new fence segment is to be defined as the center of the existing 4 "x6'• fencepost located about V -7" to the East of the North East corner of the Garage (as It exists as of the date of this agreement) located on the 20550 Blossom Lane property. This reference fencepost also forms a part of the fence segment (ESF) running North -South between the two houses and said fencepost (NP) and fence segment (ESF) will be left standing as is. The southernmost point (SP) of the new fence segment Is defined as the Westernmost Edge of the Eastern -most 4 "x6" fencepost of the recently constructed backfence of 20550 Blossom Lane and is located roughly 62 feet south of the fencepost labeled NP. At the northermost point, the new fence segment should attach to and make use of the existing fencepost (NP) defined above. At the southernmost point, a new 4 "x6" fencepost should be placed per attached sketch; but braced by the existing E -W backyard fencepost located nearby. Between these two points (NP and SP) a new fence segment shall be constructed similar in type to the backyard fence of 20550 Blossom lane, being 8' high (by permission of both, property owners), except that it shall be 6' solid and 2' mesh along the top. Fenceposts used shall be of good quality, pest -mold- and - termite resistant redwood 4 "x6" (oriented with the 6" edge running N -5). The fence will be treated after construction with appropriate sealant. Prior to placement of the new fence segment, tree roots will be removed along and on either side of where the fence will be placed so as to preclude subsequent deterioration of the stability of the fence. One attached sketch depicting the placement of the new fence segment, initialed by owners of both properties shall be considered a part of this agreement. The agreement shall only become effective upon signature by owners of both properties.
