'. i,;l:(!,:.l/ , '... , . :: 1-1 May 14, 2008 EXC-2008-06 DISCUSSION: According to the Rl Ordinance, the combined side yard setbacks for a single family home shall be 15 feet, except that no side yard setback may be less than five feet. For properties with existing five foot legally non-conforming setbacks, one side can be designated the five foot side, while any future construction on the other side would need to be set back 10 feet. Lots with irregular shapes have been allowed to extend into portions of their setbacks. The intent is to allow flexibility for lots that do not have 90 degree angles, or have portions of the lot that are less than 60 feet wide, or have less then four sides. This property is triangular in shape, with the left side. yard at a 45 degree angle. The shape of the lot doesn't allow reasonable use of the lot, and any addition towards the side and rear yard would extend into the ten-foot setback. In addition, the purpose for a ten-foot side yard setback is to minimize the visual impacts onto adjacent neighbors. Because the left side yard abuts a park, and the addition is a single-story, massing impacts are not a concern. The applicant is requesting an exception to permit a partial reduction of the required ten- foot setback along the left side yard. Staff supports the exception for the following reasons: . The intent of the ordinance is addressed. The lot is irregular in shape, and the addition displays reasonable measures to decrease the amount of encroachment into the side yard. . The property abuts a public park rather then a residence, thereby eliminating massing impacts onto the adjacent property. Findings for Exception Per Section 19.28.110 of the Rl Ordinance, the Design Review Committee may grant an exception based upon the following findings: A. Literal Enforcement of the provisions of this chapter will result in restrictions inconsistent with the spirit and intent of this chapter The intent of the ordinance is addressed. The lot is not typical in shape, resulting in unreasonable restrictions that limit the use of the lot. B. The proposed development will not be injurious to property or improvements in the area, nor detrimental to the public health, safety, or welfare The property abuts a public park rather then a residence, thereby eliminating massing impacts onto the adjacent property. C. The exception to be granted is one that will require the least nlOdification of the prescribed design regulation and the minimum variance that will accomplish the purpose Historically, the majority of the proposed setback exceptions are proposed along portions of a parcel that is non-conforming in width or shape. RECOMMENDATION: Staff recommends that the Design Review Committee approve the Architectural and Site Approval, file no. ASA-2007-08, for an outdoor dining area at an existing restaurant per the model resolution. BACKGROUND: The applicant, Susan Chen, representing 1- Restaurant, is proposing a 32-seat outdoor dining patio and landscape improvements for this restaurant located at the northwest corner of Stevens Creek Boulevard and North Blaney Avenue. The dining patio stretches across both building street frontages in the front and street sideyard landscape areas. Two pathways connect the street sidewalks to the outdoor dining area and restaurant entrance. The restaurant shares building space with a music studio and there is a separate, rear building on the property occupied by a music store. The parking lot is shared among all three tenants with most of the stalls located toward the rear of the restaurant. Abutting land uses are also commercial to the south, west and north and a residential/ commercial mixed use project to the east across Blaney Avenue. DISCUSSION: The parking analysis is included on the plan set. It demonstrates the sufficiency of the parking inventory with the 32 added restaurant seats and including the music studio and store. A total of 62 spaces is required per the parking ordinance and 64 stalls are provided. The dining patio facing Stevens Creek Boulevard is similar to other restaurant patios built along Stevens Creek Boulevard. There is often special paving with tables chairs and umbrellas and the patio defined by potted plants and/ or a low wall or fence. The Blaney Avenue patio has a more garden-type environment with arching foliage and lighting (see detail sheet). Literal Eriforcement of the Sign Regulations will result in restrictions inconsistent with the spirit and intent of this title. The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of signs as they relate to building design" and to "provide [sign regulations] that will allow for good visibility for the public and the needs of the business .... fl. The proposed exceptions are necessary to provide effective and visible signs given the project's location along Wolfe Road and surrounding mature trees. In addition, T.G.I Friday's is located in the core business district of the City, staff feels that flexibility in sign design is appropriate for this area to promote business identity and the proposed signs are complimentary to the building architecture and design.
