Subject: Director's Minor Modification, DIR-2012-33, to allow the construction of a pergola
over an existing outdoor seating area in front of a restaurant located at 10619 S. De
Anza Boulevard.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Moon Chien, representing Bar Code Restaurant, is proposing to construct a
wood resembling, non-flammable vinyl pergola over an existing outdoor seating area of the
restaurant. The pergola is to be located adjacent to the restaurant entrance along the Kirwin
Lane frontage. The design of the pergola is compatible with the existing shopping center and
will enhance the e�cisting outdoor seating area. Additionally, the pergola will not impede
handicap access to the building via the existing ADA compliant parking space located directly
in front of the existing outdoor seating area. Staff supports the project because it is consistent
with the General Plan, Heart of the City Specific Plan, South De Anza Boulevard Conceptual
Plan,and CG Ordinance.
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on Plan Sets titled: "Bar Code Restaurant Outdoor Dining Improvement
10619 S. De Anza Blvd, Cupertino, CA 95014" prepared by John Ha, AIA dated September
14, 2011 and consisting of two sheets labeled A-0, A-1, and elevation A-1.1,except as may be
amended by the conditions contained in this memorandum.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.

3. SIGNAGE
The existing nonconforming wall and window signs shall be abated to comply with the
City's Sign Ordinance prior to final occupancy. No new signage is approved as part of this
project. All proposed signage must be consistent with the City's Sign Ordinance prior to
issuance of building permits.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This Director's approval is effective October 26, 2012. The fourteen calendar day appeal period
will expire on November 9, 2012. Please be aware that if this permit is not used within two
years, it shall expire on October 26, 2014.
