Subject: Director's Minor Modification, DIR-2012-44, to a previously approved Architectural
& Site Approval (ASA-2000-26), to allow for parking lot and common area Americans
with Disabilities Act (ADA) site upgrades for the McClellan Square Shopping Center
located at 10385-10497 South De Anza Boulevard.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Victor de Melo, representing Browman Development Company, is requesting
approval to add parking stalls and construct ADA site upgrades to the parking lot and
common areas of the McClellan Square Shopping Center located at the northwest corner of
South De Anza Boulevard and McClellan Road. The project is being accomplished in
conjunction with proposed tenant improvements to the former Lucky's Store for 99 Ranch
Market. Typically, such parking lot improvements are deemed minor and reviewed at the
building permit stage, but because of the extent of the upgrades, affecting the whole parking
lot and other site changes, the project is first being reviewed under a Director's Minor
Modification.
Accessibility
ADA accessibility improvements in the parking lots are being proposed for each of the three
buildings with paths of travel connecting all three buildings to nearby parking areas.

Parking
The applicant prepared a parking analysis of the shopping center (Exhibit A). The applicant
proposes to add new parking stalls in several locations but only one location does not raise
access issues with Santa Clara County Fire Department and Planning. When the new
acceptable stalls are included, there will be a net supply of 371 parking stalls, which exceeds
the City's parking ordinance requirement of 337 stalls by 34 parking spaces.
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Accessibility Compliance On-Site Improvements for
Browman Development Company/McClellan Square/Shopping Center/10385-10497 S. De
Anza Boulevard/Cupertino, California," prepared by George Meu Associates, dated
September 28, 2012, and consisting of three sheets labeled A001, ASD101, and AS101;
except as may be amended by the conditions contained in this resolution.
2. BUILDING PERMITS
The applicant shall submit plans with the City Building Division to obtain the necessary
building permit.
3. NEW PARKING STALL ADDITIONS
A revised parking lot plan shall be submitted to the City for review and approval prior to
issuance of building permit. Only the area under the drive-through canopy of the building
at 10465 S. De Anza Boulevard is approved for new parking stalls. Applicant shall install
new wheel stops and paint lines for this parking. All other proposed new stalls shall be
deleted based on Fire Department concerns with emergency access.
4. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.

This approval of the modification is effective November 14, 2012. The fourteen calendar day appeal
period will expire on November 28, 2012.
