Subject: Director's Minor Modification, DIR-2012-39, to a previously approved Use Permit (U-
1998-14) to install new patio fences to match existing ones to delineate private open
space for 63 units and other minor improvements at an existing apartment complex,
located at 10159 S. Blaney Avenue.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION
The applicant, Chris Wojick, representing Biltmore Apartments, is requesting modifications to a
previously approved Use Permit application (U-1998-14) to install new patio fences to match
existing ones to delineate private open space for 63 units and other minor improvements.
The R3 Ordinance states that first floor units of an apartment complex must be provided with
approximately 20% of the gross floor area of the unit. The new patio fences have been placed in
a manner that allows each unit to comply with this requirement.
In addition, the applicant is proposing the installation of gutters on sixteen buildings in the
apartment complex. This will involve minor alterations to the exterior of the building due to
removal of rafter tails on these buildings to accommodate the gutters.
ACTION
The Director of Community Development deems the modifications minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Biltmore Apartments, 10159 South Blaney Avenue,
Cupertino, California 95014-3116" prepared by Eric Knutsen, Architect, dated September 24,
2012 and updated on December 10, 2012 consisting of 13 sheets labeled A0.01, A1.01 -A1.09,
and A2.01 -A2.03;except as may be amended by the conditions contained in this resolution.

2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
3. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City,
its City Council, its officers, employees and agents (the "indemnified parties") from and
against any claim, action, or proceeding brought by a third party against the indemnified
parties and the applicant to attack, set aside, or void this ordinance or any permit or
approval authorized hereby for the project, including (without limitation) reimbursing the
City its actual attorneys' fees and costs incurred in defense of the litigation. The City may,
in its sole discretion, elect to defend any such action with attorneys of its choice.
4. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the modification is effective December 17, 2012. The fourteen calendar day
appeal period will expire on January 11, 2013.
