CITY COUNCIL MEETING
PLEDGE OF ALLEGIANCE
At 6:45 p.m. Mayor Mark Santoro called the meeting to order in the Council Chamber,
and led the Pledge of Allegiance.
ROLL CALL
Present: Mayor Mark Santoro, Vice‐Mayor Orrin Mahoney, and Council members Barry
Chang, Rod Sinks, and Gilbert Wong. Absent: None.
CEREMONIAL MATTERS AND PRESENTATIONS ‐ None

ORAL COMMUNICATIONS
Randy Bryant, head of the Automotive Division and Vice President of the Academic
Senate for De Anza College, introduced Chris Dove, the ICC Automotive Technology
Rep. Mr. Bryant thanked Council and the community for its support in passing
Proposition 30. He explained that the Automotive Division holds classes 4 days a week
and on the weekends and has 800 enrollments each quarter, including a current
enrollment of 147 women. He noted that they recently received a grant for a solar lab,
own an electric demonstration vehicle, and just started a green transportation
alternative fuels program. The division recently held the first electric vehicle training
class for any college in the Western United States and is partnering with a company to
provide training for fleet technicians with tuition off‐set by State funds.

Successor to the Redevelopment Agency
Maureen Jones distributed a handout titled, “More Than a Toothache: Untreated Dental
Disease in Our School Children.” She mentioned examples from the handout including
a study done between Alameda County and Santa Clara County in which Alameda
fluoridated 90% of the water and Santa Clara County 12% of the water. She noted that
the results of tooth decay were exactly the same in Kindergartners and a little higher in
Santa Clara County for Third‐graders due to Alameda County offering tooth sealants.
She also explained how sealants are important because tooth decay is on the surface of
the molars and that sending children to bed with baby bottles increases tooth decay. She
noted that in all of the examples, ingesting fluoride did nothing for the children and
since fluoride is 80% cumulative in growing children, it is bad for their health.
Nai Hsueh introduced herself as the new District 5 Santa Clara Valley Water District
Board member.
Team “Never Give Up” Cupertino said that they did the Susan G. Komen 3‐day walk
which is 60 miles in 3 days to help raise $6.5 million for breast cancer research. They
noted that the Council and community support was remarkable and that Council
members joined them on their training walks. They said that Breast Cancer Awareness
month is in October.
Charles Johnson said that he is a new business owner in Cupertino who cares about the
community. He noted that there needs to be active participation in the local parks and
libraries, and that he has concern that graffiti, litter, and other crime is ruining
neighborhoods. He said he enjoys the trees but that the fruit from fruit trees that are
planted to replace the orchards fall onto sidewalks and is difficult to remove.

1. Subject: Enact ordinance to amend contract with California Public Employees’
Retirement System (CalPERS) for a second tier, 2% at 60 retirement plan
Recommended Action: Conduct the reading and enact urgency Ordinance No. 12‐
2100: ʺAn Ordinance of the City Council of the City of Cupertino authorizing an
amendment to the contract between the City Council of the City of Cupertino and

the Board of Administration of the California Public Employeesʹ Retirement System
and declaring the urgency thereofʺ
City Clerk Grace Schmidt read the title of the ordinance. Wong moved and Mahoney
seconded to read the ordinance by title only, and that the City Clerk’s reading
would constitute the only reading thereof. Ayes: Chang, Mahoney, Santoro, Sinks
and Wong. Noes: None.
Wong moved and Mahoney seconded to enact urgency Ordinance No. 12‐2100.

ELECTION OF MAYOR AND VICE MAYOR
2. Subject: Council members elect Mayor
Wong moved and Sinks seconded to nominate Orrin Mahoney as Mayor. The
motion carried with Chang abstaining.
3. Subject: Council members elect Vice Mayor
Mahoney moved and Chang seconded to nominate Gilbert Wong as Vice Mayor.
The motion carried with Chang abstaining.
OATHS OF OFFICE
4. Subject: Mayor takes oath of office
City Clerk Grace Schmidt swore in newly elected Mayor Orrin Mahoney.
5. Subject: Vice Mayor takes oath of office
Former Cupertino Mayor and Vice President of the Santa Clara County Board of
Education Michael Chang swore in newly elected Vice Mayor Gilbert Wong.

COMMENTS BY NEW MAYOR
6. Subject: Comments by new Mayor and presentation of gifts
Incoming Mayor Orrin Mahoney presented a gavel plaque and a sporting goods gift
certificate to outgoing Mayor Mark Santoro. City Manager David Brandt presented a
pen set on behalf of staff to outgoing Mayor Mark Santoro.
Mayor Mahoney thanked former Mayor Santoro and the other Council members for
a great year with significant accomplishments including: hiring a new City Manager;
updating the McClelland Ranch Master Plan; Main Street approval; Crossroads
Shopping Center Development; new Green Building ordinance; and wind‐down of
the Redevelopment Agency. He reassured the residents that the City Council always
tries to make the best decisions for the whole of Cupertino and that tax dollars are
well‐spent for residents, workers, and visitors to Cupertino. He noted that he will
have regular business hours and would follow up on the Leveraging Ethnic
Diversity (LED) workshop. Mayor Mahoney invited everyone to watch the State of
the City on January 30.

7. Subject: Comments by Council members
Council members took turns making comments including thanking outgoing Mayor
Santoro for his work as Mayor, thanking fellow Council members for working
together to make good decisions for the residents, wishing incoming Mayor
Mahoney and incoming Vice Mayor Wong a good year, thanking the residents and
commissioners for making Cupertino a great city to live in, and thanking the
Sheriff’s office and City staff for all of their hard work.
8. Subject: Members of the audience are invited to speak
