SUBJECT: TWO STORY PERMIT ACTION LETTER—Application R-2013-01
This letter confirms the decision of the Director of Community Development, given on February 20,
2013; approving a Two-Story Permit to allow the conversion of attic space into habitable, second story
living area in a single family residence, located at 20917 Greenleaf Drive,with the following conditions:
1. APPROVED PROJECT
This approval is based on a plan set entitled, "Beffa Addition/IZemodeling, 20917 Greenleaf Drive"
consisting of 13 sheets dated Received January 3, 2013, except as may be amended by conditions in
this resolution.
2. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the building plans.
3. ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but not
limited to property boundary locations, building setbacks, property size, building square footage,
any relevant easements and/or construction records. Any misrepresentation of any property data
may invalidate this approval and may require additional review.
4. EXISTING ACCESSORY STRUCTURES
Prior to issuance of the certificate of occupancy, the property owner agrees to remove the
unpermitted accessory structure abutting the fence along the western property line, or legalize the
accessory structure as required by the City of Cupertino.
The existing tool shed located in the northwest corner of the property has been issued a building
permit from the County of Santa Clara on October 1, 1992 (Permit #: 1992-22697-00) and may remain.
Any modifications to existing accessory structures must first be reviewed by the City of Cupertino.
5. BUILDING PERMIT
The revised construction plan set must also be submitted to the Building Division prior to issuance of
building permits far the second story living area.

6. PRIVACY PLANTING
The final privacy-planting plan shall be reviewed and approved by the Planning Division prior to
issuance of building permits. The variety, size, planting distance shall be consistent with the City's
requirements.
7. PRIVACY PROTECT'ION COVENANT
If required, the property owner shall record a covenant on this property to infarm future property
owners of the privacy protection measures and tree protection requirements consistent with the R-1
Ordinance, for all windows with views into neighboring yards and a sill height that is 5 feet or less
from the second story finished floor. The precise language will be subject to approval by the Director
of Community Development. Proof of recordation must be submitted to the Community
Development Department prior to final occupancy of the residence.
8. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to the
proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
9. EXTERIOR BUILDING MATERIALS/TREATMENTS
Final building exterior treatment plan (including but not limited to details on exterior color, material,
architectural treatments and/or embellishments) shall be reviewed and approved by the Director of
Community Development prior to issuance of building permits. The final building exterior plan
shall closely resemble the details shown on the original approved plans. Any exterior changes
determined to be substantial by the Director of Community Development shall require a minor
modification approval with neighborhood input.
10. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indemnified parties and the applicant to
attack, set aside, or void this ordinance or any permit or approval autharized hereby for the project,
including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.
11. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and
a description of the dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period complying with all of the requirements of Section 66020, you will
be legally barred from later challenging such exactions.
Please note that if this permit is not vested within a year, it shall expire on February 20,2014.
Staff has received a comment from a neighbor regarding existing accessory structures on-site. One
accessory structure (not illustrated on the site plan) is described by the neighbor as abutting their fence

along the subject site's western property line. The other is an existing tool shed located in the northwest
corner of the property. The property owner has agreed to remove the unpermitted accessory structure
abutting the fence not illustrated on the site plan. However, a building permit issued from the County of
Santa Clara on October 1, 1992 for the existing tool shed in the northwest corner has been submitted.
Therefore, the tool shed is legal and may remain. A condition of approval has been added to reflect
these requirements.
Staff has made all the findings that are required for approval of a Two-Story Permit as required by the of
Cupertino's Municipal Code, Chapter 19.28.140 (B). Also,please note that an appeal of this decision can
be made within 14 calendar days from the date of this letter. If this happens,you will be notified of a
public hearing,which will be scheduled before the Planning Commission.

1.Approval of these plans does not release the Owner and/or Contractor of the
responsibility for the correction of mistakes,errors,or omissions contained therein.
If during the course of construction improvements,public interest requires a
modification of/or a departure from the City of Cupertino specifications or these
improvements plans,the City Engineer shall have the authority to require such
modification or departure and to specify the manner in which the same is to be

7.A work schedule of grading and Erosion&Sediment Control Plan shall be provided
to the City Engineer by August 15.No hillside grading shall be performed between
October 1 to April 15.
8.All new electrical service(power,phone,and/or cable)shall be undergrounded.
9.To initiate release of bonds,contact the Public Works inspector for Finai Inspection.
10.All downspouts to be released to the ground surface,directed away from building
foundations and directed to landscaped area.
il.Prior to beginning any work with the Public Right of Way,the Contractor will be
responsible for pulling an encroachment permit from the Public Works Department.
12.Storm water from surface or roof drains,other than general surface runoff water
or condensate from any residential HVAC equipment shall not be discharged to the
sanitary sewer.

9.18.040 Dlscharge inbo the storm drain prohlbited
It is unlawful to discharge,or cause,allaw,or permit to
be discharged irrto any stortn drain or natural outlet or
channel all waste,induding but not restricted to,sewage,
industrial wastes,petroleum produds,coal tar or any refuse
substance arising from the manufacture of gas from coal or
petroleum,chemicals,detergeMs,solverrts,pairtts,
confaminated or chbrinated swimming pool water,
pesticides,herbiades and fer6lizers.
9.18.080 Vlolation
My person who violates any provision of this chapter is
quitty of a misdemeanor and upon conviction thereof shall
be punished as provided in Chapter 1.12 of this cbde
9.19.100 Clvil penalty for violatlon
Any person who violates any provision of this chapter
or any provision of any permit issued pursuant to this
chapter shall be civilly liable to the City in a sum not to
exceed the amourrts provided for in GovemmeM Code
Section 54740 and/or 54740.5[up bo 525,000 per day per
vlolatlon].The City may petition the Superior Court
pursuarrt b Govemmerrt Code Section 54740 to impose,
assess and recover such sums.The civil PenanY Provided
in this section is cumulative and not exclusive,and shall be
in addition to all other remedies available to the aty under
State and Federal law and bcal ordi�ances. Funds
collec��ed pursuar�t to this section shall be paid to City's
EnvironmeMal Managemerrt Accourrt.
9.19.101 Civil penalty for illkit discharges
Any person who discharc�es pollutants,in violation of
this chapter,by the use of illicit connections shall be civilly
liable to the City in a sum not to exc�ed twenty-flve
thouaand dollars per day per vlolatloo for each day in
which such violaation oa:urs. The City may petition the
