Mayor Mahoney and Council Members: My name is Paul Kalra and I am building a house at 10569 San Leandro Ave (APN: 357-05- 079). I am requesting your consideration of this appeal of a determination of the Director of Public Works to relocate a utility pole on Mr. Wang's property at 10555 San Leandro Ave and pay for it. During the process of obtaining building permits on August 3, 2012, I was informed erroneously by Mr. Mosley that the utility pole is located on my property at 10569 San Leandro Avenue and I have to post a$25,000 bond to relocate it. After agreeing to move the pole and posting the bond it was discovered and admitted by Mr. Mosley in writing that the pole was located on Mr. Wang's property at 10555 San Leandro Avenue and neither myself nor the City had authority to relocate the pole. I informed the City on August 14, 2012 that the Order to relocate the pole was illegal, unenforceable and my deposit should be refunded immediately. My agreement to relocate the pole was made on reasonable reliance of Mr. lvlosley's statements. Since the initial correspondence, numerous meetings and letters have been exchanged concluding with this formal appeal of the Public Works Director's decision. I will now establish the facts in the order of the staff report. A. Applicant has been ordered to relocate pole on neighbor's property. In the first week of August, I informed Mr. Mosley that the utility pole was located on Mr. Wang's property. Mr. Mosley requested the Engineer's drawing (Exhibit 1) showing the exact location of the utility pole. Exhibit 1 shows that the pole is located 1.22 feet and the anchor cable an additional 5.67 feet inside Mr. Wang's property. In Emails (Exhibit 2) Mr. Mosley admitted that the pole will stay in its present location and to bring my engineer to the City to modify drawings to add bollards. 1 In September, the City said (Exhibit 3) that they will make their decision regarding the relocation of the utility pole at the end of October and would not refund my deposit. I agreed to relocate the pole and make a deposit on a reasonable reliance on Mr. Mosley's false statements. The City refused to refund my deposit even after acknowledging that the pole and anchor cable were located seven feet inside Mr. Wang's property. The City also refused to indicate on what basis was I being held responsible for relocating this pole on Mr. Wang's property and paying for it. B. Applicant's driveway does not create any safety issues requiring relocation of utility pole. Exhibit 4 shows the lot map of the houses on San Leandro Avenue. I am building my house with driveway on lot 47A. A few years back there was a new house constructed with driveway on lot 55A. Both of these lots are flag lots and gave a 10 ft. easement to the City to widen the street. Both of these lots have utility poles and anchor cables on the adjacent lots. The direction of traffic is from North to South in front of these driveways. That means the vehicles from both the driveways have to turn South away from the respective poles and do not create any new safety hazards. Exhibit 5 shows the poles at these two locations. Although the driveway on plot 55A was widened with curb and gutter, the utility pole remained at the existing location. Only two bollards were added to protect the cable anchor. This is the exact situation on my driveway on lot 47A. I offered to add two bollards in front of the utility pole on neighbor's property. Mr. Mosley refused to provide the rationale for requiring me to relocate the pole on neighbor's property and pay for it. These poles have existed for a decade in their present location with no reports of accidents according to the City traffic department.. Therefore my driveway is not creating any new safety hazards requiring relocation of the utility pole on Mr. Wang's property. C. Applicant's deposit was obtained with misrepresentations contrary to municipal code and related precedents. Again referring to Exhibit 5, when the street was widened in front of driveway on lot 55A and the new house built on lot 55, the owner was not asked to relocate pole or make a deposit for future relocation of the pole on the adjacent lot. My situation is exactly the same as driveway 55A and is on the same street. From past practice there is no justification for requiring Mr. Kalra to relocate pole on Mr. Wang's property and pay for it. The fact is that Mr. Mosley imposed the condition of relocating the pole and deposit based on erroneous information and misrepresentations of the municipal code. After confirming the true 2 location of the pole on Mr. Wang's property, he is holding my deposit hostage to cover up his own manipulations and wasting the City's and Council's time for the last eight months. D. City is creating disputes between neighbors. In September after confirming that the utility pole and anchor cable extended seven feet along Mr. Wang's property, Mr. Mosley unilaterally decided to obtain an easement from him to relocate the pole 15 feet inside Mr. Wang's front yard. He decided on this course of action even when there was no requirement to relocate the pole in the first place. Mr. Wang protested in his emails to Mr. Mosley(Exhibit 6). According to Mr. Wang: "The metal wire to support the pole will be located in the middle of our concrete sideway and cause a lot of safety concern. I believe you can understand why we don't think this is going to work for us." Then Mr. Mosley told Mr. Wang that the City had a deposit from Mr. Kalra and would force him to pay for relocation of the pole. If Mr. Wang did not provide an easement then he would have to pay for relocating the pole when the street had to be widened in front of his property in the future. Mr. Wang agreed to the easement and is blaming Mr. Kalra for creating this unsafe situation in his front yard with old people and children in his household. Thus Mr. Mosley has created bad feelings between neighbors who have to live with each other for a long time. It should be understood that there is no need to relocate the utility pole and create a new safety hazard for Mr. Wang at this time. I am requesting the City Council to restore my good relations with Mr. Wang by leaving the utility pole alone in its present location. Conclusion: It has been demonstrated that the utility pole and anchor cable are located seven feet within Mr. Wang's property and the condition imposed on Mr. Kalra to relocate the pole and make a deposit was based on erroneous statements. It has also been shown from similar precedents that there is no need for relocating the pole at this time and in fact the pole relocation would create new safety hazards and hardship for Mr. Wang. As for modifying the plans, we've not established what requirements we will be imposing to address safety issues, and the requirement for relocating the pole has not been relinquished as yet, because we've not yet exhausted our options. These required improvements affect an existing utility pole located near the northeasterly corner of your property,where it meets the public right of way(San Leandro Ave). Construction of these improvements requires the relocation of the subject utility pole to a location behind the proposed new curb and gutter alignment. The City understands that PG&E will require an easement over a portion of 10555 San Leandro Ave, in order to accommodate the relocated utility pole and subsequent guy wire. The City is currently working with your neighbor to acquire these rights. If the City is able to obtain an easement from your neighbor,your project's requirement to relocate the pole will continue as the current approved plans indicate,and the City will not release your encroachment bond until such time that the pole has been relocated. However, if the City is unable to obtain an easement from your neighbor,we will require that alternative safety measures be implemented in order to protect the pole from on-coming traffic. This maynclude the installation of a curb island around the utility pole,with the addition of reflector-ized bollards to visually alert drivers of the utility pole. This installation will require that the approved building plans be modified to indicate that the pole is to remain in place and to show the aforementioned safety measures. These safety improvements will require that the City obtain a bond equivaienrto 115%-ofthe-cost of installation We will then return any-outstanding portion of the $25,000.00 encroachment bond that was required for the pole relocation. We understand that the cash-flow for your project is impacted by the timing of this decision, so the City hopes to exhaust it's efforts, successfully or unsuccessfully,to obtain an easement from your neighbor prior to October 31st, 2012. Based on your suggestion(the two black lines), the metal wire to support the pole will be located in the middle of our concrete side way and cause a lot of safety concern. I believe you can understand why we don't think this is going to work for us. But having say that, it does not mean we are not willing to provide reasonable easement for the relocation of the utility pole. Instead of your suggested location, I think moving it to the left about 1-2 feet(see two red lines in JPG file) will make sure the metal wire will not be in the middle of our side way and we don't have to dig a hole on our concrete side way(it will be on dirt if we move it to the left 1-2 feet). I hope this make senses to you. If not, we can meet in front of our property next week and discuss further about this move.
