Sign Exceptiol1 (EXC-2008-15) request to allow a sign to exceed the number and maximum height limitation at a11 existu1g commercial building (Evertrust Bank). RECOMMENDATION: Staff recomme11ds approval of EXC-2008-15, based on the model resolution. BACKGROUND The project site is located at the southwest corner of Steven.s. Creek Boulevard a11d De Anza Boulevard east of t11e C11evrol1 gas station 011 the cor11er, (see diagram to t11e rig11t, project site in blue). Staff l1as already approved one wall sign facing De Anza Boulevard (east side) that is consistent wit~ the City sign ordinance. Tl1e applicant Eva Liu, representu1g Evertrust Bank, is requesting approval to install a second wall sign, exceeding the Sigr1 Ordinance requireme11ts ll1 sign number and height. DISCUSSION: Sign Exceptions NUlnber of Signs According to the Sign Ordinance Section 17.24.050, each business with exterior frontage s11all be permitted one ,vall sign. A second wall sigr1 may 011ly be permitted under either one of t11e following circumstances: 1. Busu1ess adjacent to more than one street and wit11110 ground sign; or 2. The second sign is directed to the interior of t11e project and 110t visible from a public right-of-way. August 21, 2008 EXC-2008-15 2 Wall Signs The additiollal wall sign would be facing Stevens Creek Boulevard. Staff supports the sign exception request for an additional wall sign based on the following reasons: The intent of the Sign Ordinance is to provide effective and visible signs. The approved existing Sigrl is located on the east side of tIle. buildiIlg, (see diagram to tIle rigIl t). Due to the existlllg gas sta tiOll and trees located on tIle corner / this Sigrl will ll0t be very visible to vehicles travelulg llorthboUlld on De AI1Za Blvd. Therefore, an additional sign facing Stevens Creek Blvd. is warrallted. 1 h - ;lVl: .', ~~I. Height Sign Ordinance Section 17.24.060 states the following: Commercial District ~ 50 feet setback fr0111 face of curb Single Row of Sign Co Double Row of Si Co 18 inches 36 inches > 50 feet setback from face of curb or tenant space of 5,000 - 9/000 square feet 24 incIles Min. 100 feet setback from face of curb and tellant space of 10,000 - 19,999 s uare feet 36 inches 48 incIles 48 inclles The existing commercial building is setback less than 50 feet from Stevens Creek Boulevard, allowing for a sign v\lith a height of 18 lllches. TIle applicant is proposing a 24-inch tall wall Sigll. Staff supports tIle Sigrl Ileight exception to allow a maximum height of 24 ulcll.es because precedence Il.as already been set wllere the previous tenants, United Commercial Bank, had a wall sign facing Stevens Creek Boulevard that was approximately 24 inches tall. In addition, the proposed height will also be more harmonious with the adjacent sigrl. facing De Anza Blvd., which is 24 incIles in height. August 21, 2008 EXC-2008-15 3 Findings for Exception Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant an exception based upon the following findings: A. Literal Enforcement of the Sign Regulations will result in restrictions inconsistent with the spirit and intent of this title. The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of signs as they relate to building design" and to "provide [sign regulations] that will allow for good visibility for the public and the needs of the business ....". The proposed exceptions are necessary to provide effective and visible signs given the project's location and existing structures and trees east of the building. B. The granting of the exception will not result in a condition, which is materially detrimental to the public health, safety, or welfare. The proposed sign does not create any health or safety problems. C. Least modification of the prescribed regulations and the mzmmum varzance that will accomplish the purpose. With the exception of the number and sign height, the proposed sign is consistent with all aspects of the sign ordinance. Other recommendations Staff recommends that the following measures be considered by the Design Review Committee to further enhance the banks surroundings: 1. The applicant shall plant additional shrubs around the perimeter of the structure to enhance the exterior of the existing building. If the Design Review Committee finds merit in the above suggestion, then it should require the revised plans reflect the additional landscaping to be reviewed and approved by the Planning Department prior to issuance of building permits.
