Recommendations to Assist in the Trouble Free Completion of Your C raiect
1. Before scheduling inspections please fill out, sign and return the enclosed Information/Authorization Form. Also,
please attach the city approved Special Inspection and "testing Schedule and a copy of the permit, if available.
Without the returned In ormation/Authorizaeion Fermis reports cannot be processed and sent to the city, resulting in
possible delays to your project.
2. Testing Engineers issues reports for a project based on its permit number. On a project with multiple permits we need
to track the work performed for each one. Let us know of all permits issued for your project. If revised permits are
obtained, inform our office and our inspector at the work site immediately. Failure to do so will result in inaccurate
progress reports, Final Report delays, and the possibility that we may not be able to include the revised permit
number on the Final Report.
3. Schedule inspections as far in advance as possible. During busy periods inspections may need to be scheduled up to
72 hours in advance to guarantee an inspector. With the exception of periodic welding inspection, the code requires
you to have an inspector on your work site whenever work requiring special inspection is being performed.
4. For welding inspection, our inspector needs to be present at the start of any welding, even when periodic visual
inspection is permitted. Review of approved plans, welding procedure specifications, welder qualifications and fit -up
needs to be done by our inspector prior to any welding. If the welding has been completed prior to inspection, it will
be noted in the progress reports and as an exception in the Final Report, possibly creating problems for you with the
city.
5. For concrete inspection, our inspector needs sufficient time to inspect the rebar and anchor bolt placement prior to
concrete placement. Rebar placement cannot be performed while the concrete is being placed. if our inspector does
not have sufficient tirne to inspect the rebar, it will be noted in the progress report and as an exception in the Final
Report, possibly creating problems for you with the city.
6. For proof -load testing, our inspector needs the proof -load value and rate of testing provided by the responsible
engineer (if not already on the approved Drawings). Without this information, our inspector cannot perform the tests.
7. When scheduling inspections be as thorough as possible when describing what inspections you will need. This will
insure that an inspector with the proper qualifications is sent to your project with all of the appropriate equipment.
8, if you require an inspector on an ongoing basis give our dispatcher a conservative estimate of the duration. If an
inspector is scheduled for a 4=hour inspection don't assume their availability beyond that point. In most cases they
have been scheduled for a later inspection.
9. * The Final Report must be requested, for each permit number, after all the required special inspections have
been completed. Allow at least 3 working days for the Final Report to be processed. Remember that concrete
and masonry samples are tested 28 days after sampling. These test results are needed prior to issuing the Final
Report."

TERMS AND COND17YONS FOR SPECIAL INSPECTION
The TERMS AND CONDITIONS stated below will govern
the provisions of services and will constitute the contract
between 'Testing Engineers. Inc. (TEI) and our client ("Client')
unless the Client avid'lEl have executed a written contract wit.li
respect to such services rn which case the teens and provisions
of the written contract shall control.
WORKING CONDITIONS AND HOURS will be enforce(] in
accordance with T( is current agreement with the hilernatit:mal
Union of Operating C;nginccl;s. Local 3 (see attached B6.sis o

Contractor to provide site access to inspection/testing locations.
Verification of plunlbness/levehiess by others.
SCHEDULING: Dispatch for services are to be made a
minimum of 24 hours in advance, during the business hours
between 7:30 am and 4:00 pin, Monday through Friday.
Twenty four (24) hour advance scheduling may not guar:uitee
the availability of a Special trlspector. For specialized tests and
inspection, or during seasonal busy periods. scheduling for
services may need to be matte up to 72 hours in advance.
Occasionally TP-1 may employ an industry consuftault to execute
the assigned testing and inspection.
COORDINA'r D INSPECTIONS: If TEI or its a-,ents will
be performing in -shop inspections of fabrication or assembly.
Client understands that TP-I may perform coordinaled
inspections and hill accordingly. Industry standards and
governing codes require that continuous inspection mandate it
continuous presence in the facility for fabrication or assembly.
COMPLETION: Inspector will remain nn job until dischal',ed
by Lite Client or the Clients representative.
CANCELLATION: Two (2) hour charge unless cancellation is
made before 4:00 pill of the preceding clay for local inspections
within 50 mile radius of TEI's San Leandro facility.
TERi'yIS OF PAYMENT: Upon requesting services from TEI
and in consideration of the extension of credit. Client au'rces to
the following: invoiceti shall he deemed delinquent if not paid
within thirty (30) days from dale of invoice, and will he subject
to a finance charge of 1.5%. per month or lire unpaid balance for
each month for additional credit and any and all collection
expenses incurred thereby. A $35.00 NSF (Non -Sufficient
Funds) charge shall be imposed tan any and ali checks returned
by Ti:I's hank as uncollectible. Furthermore, any raid all NSF
checks are subject to treble damages up to the amount allowable
under California law (Chapter 522. Section 1719).
TEI reserves the rights to terminate its services to Client without.
notice if any or all invoices are not paid currently. Upon SLIC11
terillinaGon of services, the entire amount accrued for all
services performed shall immediately become duc and payable
TERMS O1' PAYMENT (continued): Client waives any and
all claims against TEL its subsidiaries, affiliales, servants and
agents, for termination of work pursuant to this paragraph.
Should TEI deem it necessary to refer a past -due account to an
attorney. or collection agency, or to file suit for collection. Client
agrees to pay for any and all actual expenses and costs -incurred
thereby, including any and all attorney's fees and court costs.

ANTICIPATED COSTS: Client recognizes and agrees that. any
'`anticipated costs" "budget estimates". or like that may be
prepared by TE/ are NOT "guaranteed maximums". "lumps
sums". or "not to exceed" totals. Client will be invoiced for all
work performed.
INDEMNIFICATION: Client shall indemnify, defend and hold
harmless TEI from and against all claims, suites. damages. losses,
expenses, costs, obligations, liabilities. recoveries and
deficiencies. including. but riot limited to. irneresis. penalties and
reasonable attorney's fees that 'i.'El shall incur or suffer, which
arise or result: from or relate to the breach of. or failure by Client,
to perforn.i. any representation. warranty, covenant or agreement
given or made by Client as set forth in this Agreement.
LIMITATION OF LIABILITY: Client and TEI aGrec to limit
the liability, incluain(, but. not limited to liability for consequential
damages, of TEI. including its shareholders. officers. directors.
employees, agents and representatives for any acts, errors.
omissions, breaches of contract. or negligence, active affirmative,
passive, concurrent or solely on the part. of TEf, arising directly or
indirectly fronl the performance of the professional services under
this Agreement of TEI to $1.000 or an amount equal to TEI's
invoiced fee to client., whichever is smaller.
DOMINANT TERMS: The (ernes and conditions of this
Agreement shall take precedence over any terms and conditions
which may appear in Clients purchase order, approval of
acceptance, (Any t'ernts and conditions of Client's purchase order.
approval or acceptance which are not identical to the terms and
conditions of this Agreement are null and void. are not part of the
Agreement between TEI and Client and are not. bind upon TEE.)
The terms and conditions of this Agreement may not be altered.
modified, added on, or changed, nor any of its provisions waived,
except by written agreement, signed by an authorized
representative of Testing Engineers, Inc.
Notwithstanding, any provisions in the agreement in the event of
conflict or dispute between client's purchase orcler or contract and
this agreement. the latter shall prevail.
