Dear Sir:
I'm the homeowner of the property located at 10390 Stern Ave, Cupertino, CA 95014, and this property
is undergoing a major renovation with permit no. 10020143. I'm writing this letter to you to request for
the release of my current general contractor, Mr. Khanh Pham, as I'm running out of options on how to
resolve the issue and getting my house completely done timely and complied by all codes.
Mr. Khanh Pham, though I believe that he uses another contractor's license number on record, has
signed the contract with me and started his work since May 2010. 1 have been paying him on time on
every scheduled installed payment (see attachment). Since the last city inspection done on Aug 23,
2010, and per our signed contract, I have retained the final payment of $14k for the final successful
inspection by the city for the Certificate of Occupancy.
However, Mr. Pham has stopped his work since the last inspection and demanded me to release the
final payment before he can proceed. We've then agreed that I'd release gradually for him to proceed
with the works and thus far, $9k of the $14k has been paid to Mr. Pham. I'm now holding only the last
$5k retainer but the house is nowhere near completion.
On Monday of this week, Oct 18, the PG&E crew came out for the long scheduled gas meter relocation.
However, Mr. Khanh did not show up nor have the gas pipe ready for the hook-up, although he's dugged
the trench for the work already. When I confronted with him on the issue, he told me that he's not
responsible for any work outside of the house and I'll have to pay all materials costs moving forward. To
make the matter worse, he did not do any further work on the house at all 2 days after. When I ask him
to sign the letter and relinquish his responsibility on the construction, he demands that I must first pay
his final payment of $5k, which is due upon successful final inspection.
Mr. Khanh has promised me that the house shall be completed by the end of August 2010. We're in late
October and there's no sight of final inspection on the house. With each month in delay I have to pay
$1100 for the storage fee of my household goods. Mr. Khanh knows this and he wants to use this to
pressure me. Furthermore, I'm scheduled have to leave the country for a business trip for a month in
mid-November, but the final inspection is nowhere in sight with the current work pace by Mr. Khanh. I
have no other choice and option but to pursue help from another general contractor who's committed
to get all the remaining work done within 2 weeks, though this will cost much more than $5k.
I urgently and respectfully request you to allow me to release Mr. Khanh from his contracted work on
my house and allow me to bring on the new contractor for him to complete all the works required on
my house.
