I am writing to you on behalf of Vallco Shopping Mall and to express our support of
having a General Plan Amendment. We understand that a General Plan Amendment is
a very large undertaking and there is a need for a very detailed plan that will give a
long.-term vision for the City of Cupertino. Cupertino is truly a great City to be involved
with and even better City to do business in. Many large scale projects and high profile
employers have sought after a Cupertino address thereby making planned growth
important for the future.
Vallco Shopping Mall has been asked by the City of Cupertino to help fund part of the
General Plan Amendment. As we all are well aware of, this shopping center has been
plagued by very difficult economic times over the past several years, many national
tenants have reduced their retail footprint, regional tenants have reduced their business
expansion plans and many independent tenants are just not venturing into business
these days. However, we have started to see the retail and restaurant business return,
but there is some recovery still to come. Whereas, Vallco supports the General Plan
Amendment we are just not able to help fund it as of this time.
We would hope that a consensus of the General Plan Amendment would be that there
would be smart growth within the city and that growth would include, Hotel Rooms,
Office Space, Housing and well placed retail.
We look forward to working with the City of Cupertino and support your efforts with a
General Plan Amendment.

RE: General Plan update and Goodyear Tire shop
Honorable Mayor and City Council Members:
I have met with many of the leaders of the City, including a City wide citizen group. I have
discussed my project with my neighbor and with the city staff. Specifically we have determined
that we can build and support a 5 star hotel to replace the Goodyear site. In any case the
Goodyear site has the attributes of a better use both from City entrance site and as an
opportunity for a significant redevelopment.
I want you to know that we support a City wide General Plan Document that will lead towards
an updated General Plan Amendment that will include our site. I fully expect to pay our fair
share in this endeavor as well as being able to provide detailed drawings that can be studied as
part of the City wide examination of its future. The staff at De Anza Properties and particularly
the Hotel staff are all anxious to participate in the process. Jerry Leap has met with Aarti and
the City manager who both have indicated their support for the process and for our property to
be included in the study.
I want to respectfully ask the Mayor and Council to support this study as something that will
lead to positive growth for the City. I want the Council to support our involvement as it applies
to creating a better use for the Good year site.

Dear Mayor Santoro and Council Members:
I am writing to you on behalf of Sears Roebuck and Co. ("Sears") regarding the proposed General Plan
Amendment("GPA") process. Sears first became aware of this proposal at a meeting with Interim City
Manager Amy Chan, Community Development Director Aarti Shrivastava, and Planner Gary Chao on
August 2nd;we did not get a copy of the Staff Report until Friday, August 17th. As such, we are still in
the process of trying to understand the potential scope and impacts of the proposal as well as how the
timing could impact Sears and its development and other property rights. In particular, we understood
very clearly from Ms. Chan and Ms. Shrivastava that the City of Cupertino intends to institute a"policy"
that would, in effect, be a moratorium on otherwise allowable permit applications during the pendency of
the GPA process.
Because of the proposed GPA's lack of specificity at this stage of the process, until we have a better
understanding of its scope, impacts and timing, Sears neither opposes nor supports the process from a
land use planning perspective. However, Sears is very concerned about the imposition of any sort of
actual or de facto development moratorium as part of the GPA process and specifically objects if a
moratorium is adopted by the City Council and/or enacted by the staff in a de facto manner.
Sears hereby respectfully requests that it be included on all public communications for this property and
the GPA process. Please send such notices directly to me as Sears' representative. Sears looks forward
to learning more about the GPA as the process unfolds so that it can continue to be a supportive member
of the Cupertino community.
