August 15, 2012 Aarti Shrivastava Director of Community Development City Of Cupertino 10300 Torre Ave. Cupertino CA 95014 Dear Aarti: I am writing to you on behalf of Vallco Shopping Mall and to express our support of having a General Plan Amendment. We understand that a General Plan Amendment is a very large undertaking and there is a need for a very detailed plan that will give a long.-term vision for the City of Cupertino. Cupertino is truly a great City to be involved with and even better City to do business in. Many large scale projects and high profile employers have sought after a Cupertino address thereby making planned growth important for the future. Vallco Shopping Mall has been asked by the City of Cupertino to help fund part of the General Plan Amendment. As we all are well aware of, this shopping center has been plagued by very difficult economic times over the past several years, many national tenants have reduced their retail footprint, regional tenants have reduced their business expansion plans and many independent tenants are just not venturing into business these days. However, we have started to see the retail and restaurant business return, but there is some recovery still to come. Whereas, Vallco supports the General Plan Amendment we are just not able to help fund it as of this time. We would hope that a consensus of the General Plan Amendment would be that there would be smart growth within the city and that growth would include, Hotel Rooms, Office Space, Housing and well placed retail. We look forward to working with the City of Cupertino and support your efforts with a General Plan Amendment. I have discussed my project with my neighbor and with the city staff. Specifically we have determined that we can build and support a 5 star hotel to replace the Goodyear site. In any case the Goodyear site has the attributes of a better use both from City entrance site and as an opportunity for a significant redevelopment. I want you to know that we support a City wide General Plan Document that will lead towards an updated General Plan Amendment that will include our site. I fully expect to pay our fair share in this endeavor as well as being able to provide detailed drawings that can be studied as part of the City wide examination of its future. The staff at De Anza Properties and particularly the Hotel staff are all anxious to participate in the process. Jerry Leap has met with Aarti and the City manager who both have indicated their support for the process and for our property to be included in the study. I want to respectfully ask the Mayor and Council to support this study as something that will lead to positive growth for the City. I want the Council to support our involvement as it applies to creating a better use for the Good year site. ("Sears") regarding the proposed General Plan Amendment("GPA") process. Sears first became aware of this proposal at a meeting with Interim City Manager Amy Chan, Community Development Director Aarti Shrivastava, and Planner Gary Chao on August 2nd;we did not get a copy of the Staff Report until Friday, August 17th. As such, we are still in the process of trying to understand the potential scope and impacts of the proposal as well as how the timing could impact Sears and its development and other property rights. In particular, we understood very clearly from Ms. Chan and Ms. Shrivastava that the City of Cupertino intends to institute a"policy" that would, in effect, be a moratorium on otherwise allowable permit applications during the pendency of the GPA process. Because of the proposed GPA's lack of specificity at this stage of the process, until we have a better understanding of its scope, impacts and timing, Sears neither opposes nor supports the process from a land use planning perspective. However, Sears is very concerned about the imposition of any sort of actual or de facto development moratorium as part of the GPA process and specifically objects if a moratorium is adopted by the City Council and/or enacted by the staff in a de facto manner. Sears hereby respectfully requests that it be included on all public communications for this property and the GPA process. Please send such notices directly to me as Sears' representative. Sears looks forward to learning more about the GPA as the process unfolds so that it can continue to be a supportive member of the Cupertino community. We expect the projected 12-15 month delay on project approvals to be excessively constrictive for property owners. Businesses make Kevin rd McClelland,Financial VP LAC y p p ✓ Leeward Financial&Insurance decisions based on where they expect the market to be and most feel Services comfortable with making only six month predictions. By delaying approvals by at least a year, current proposals and projects will likely LMGw ub%oLountants have to be set aside given the uncertainty it creates. In addition, given the number of issues that need to be addressed in a General Darcy Paul,VP Community Plan Amendment,we are concerned that projects could be delayed Relations Law Offices of Darcy August Paul for a much greater length of time than outlined in the Staff report. 2) Requiring mitigation fees for the General Plan Amendment to be paid up Lynn Ching,Membership front by property owners at opportunity sites Development Sustainable Living Group,Inc. a. Given that the scope and potential impact of a General Plan Amendment have not yet been detailed,we believe it is unfair to Board Members expect property owners to commit to paying mitigation fees upfront. Yogi Chugh There currently exists too much uncertainty in what the General Plan State Farm Insurance Amendment will involve for a property owner to give a financial Mike Foulkes commitment. In addition,we are concerned that by requiring Apple,Inc. property owners to pay the complete cost of the review, you Tamon Norimoto PG&E unintentionally create the negative perception that they are"buying" Sandy James approval for a General Plan Amendment. LeHigh Cement Company **End addendum August 17,2012** Scott Jeng HSBC Bank USA,NA. I am writing to express our support for a General Plan Amendment for the City of Mahesh Nihalani Cupertino. Jewels in Style Barbara Perzigian Cupertino Inn We understand that amending the General Plan is an important decision to make. Vicky Tsai The General Plan directly affects the quality of life for the residents and business that Dry Clean Pro call Cupertino home.It also has the responsibility of providing a clear vision and Joanne Mansch direction for how we will sustain balanced growth. Alotta's Delicassen&Catering As you know,Cupertino has experienced welcomed growth over the last few years. This growth was anticipated by Chamber, and we have since 2000 noted that the General Plan is not sufficient to address this growth. We are now reaching a point where our ability to promote any possible future growth will be limited without an amendment of the General Plan. Simply put,we are running out of square footage in the General Plan.Without the flexibility of more available space,we run the risk of delaying and preventing future projects and developments from taking place in Cupertino. Furthermore, companies are beginning to move out of Cupertino because of the availability of high-quality office and industrial space elsewhere. They will continue to do so without Cupertino offering competing space. Cupertino is known for its high quality of life,a feature that makes it a big draw for both residents and businesses. We need to ensure the City has a General Plan that will allow it to continue to provide the great services and amenities for which the City is known. Thank you for taking the time to consider our comments. We respectfully request you approve the process to explore an amendment to the General Plan, and we urge you to approach this topic with a sense of immediacy,as the issue should not be put off any longer. If approved,we look forward to continue working with the City and participating in a robust community dialogue.
