SUBJECT: TWO STORY PERMIT ACT'ION LETTER—Application R-2013-09
This letter confirms the decision of the Director of Community Development, given on April 9, 2013;
approving a Two-Story Permit for the demolition of an existing single story residence and the
construction of a new 4,151 square foot, single family residence, located at 10229 Scenic Boulevard (APN
357-09-010), in consideration of the public comments and as subject to the following conditions.
PUBLIC COMMENTS
In direct response to public comments received during the notice period, several project specific
conditions have been added. Among them, the demolition of the south garage wall shall require
installation of a temporary fence, the second story bedroom window on the front/southwest corner shall
be obscured and inoperable, and the proposed redwood fence shall have a solid concrete foundation to
reduce the likelihood for rot/decay. Furthermore, a drywell is required to collect and dispose of excess
storm water runoff. Lastly, construction vehicle parking along Scenic Boulevard has been restricted due
to the narrow street width.
Comments and concerns pertaining to the overall size and mass of the home were reviewed and
conveyed to the property owner. As the property conforms with the development standards of the
zoning district, and in some areas, is well under the maximum allowed thresholds, staff is supportive of
the application as proposed.
CONDITIONS OF APPROVAL
1. APPROVED PROJECT
This approval is based on a plan set entitled, "Hsu Residence" consisting of 9 sheets (T-1.0, A-1.0, A-
1.1, A-2.0, A-3.0, A-4.0, A-5.0, C.1, C-2) stamped received March 01, 2013, and fence exhibits,
consisting of 3 sheets ("Construction Schedule of Fence", "Fence Repair Sheet 1B of 2", and "Fence
Repair Sheet 2 of 2") stamped received Apri15, 2013, and "Window Glass Sample" stamped received
April 5,2013, except as may be amended by conditions in this resolution.
2. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the first page of the
building plans.

3. ACCURACY OF THE PROjECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but not
limited to property boundary locations, building setbacks, property size, building square footage,
any relevant easements and/or construction records. Any misrepresentation of any property data
may invalidate this approval and may require additional review.
4. CONSTRUCTION PLANS SET REVISIONS/CLARIFICATIONS
Prior to issuance of building permits, the construction plan submittal shall include the following
information and revisions:
a. At a minimum, the second story bedroom window on the front/most southwest corner shall be
noted as obscured and inoperable, similar to the "Window Glass Sample" stamped received
Apri15, 2013. Staff recommends that the applicant provide a matching treatment for the southeast
bedroom window, of the same bedroom, for symmetry.
b. Pursuant to the "Impervious Surface Notes" on sheet A1 of the plans, please identify and more
clearly demonstrate how the selected design measure(s) will be accomplished.
c. Please show the path of the underground electrical. If overhead electrical is to be used, please
show the path and point of connection. Please note that overhead electrical connecting to the
front of the new residence will not be permitted.
d. The placement/location of the HVAC units shall be relocated to the rear of the property, to the
satisfaction of the Planning Division.
e. Fence segments over 6' in height shall require the adjoining property owner's signature and an
issued building permit prior to construction.
f. All trees indicated to remain onsite shall require a Plan of Protection in accordance with section
14.18.080 of the City of Cupertino Municipal Code.
5. LANDSCAPE INSTALLATION REPORT:
Prior to final inspection, a landscape installation audit shall be conducted by a certified landscape
professional after the landscaping and irrigation system has been installed. The findings of the
assessment shall be consolidated into a landscape installation report.
The landscape installation report shall include, but is not limited to: inspection to confirm that the
landscaping and irrigation system are installed as specified in the landscape and irrigation design
plan, system tune-up, system test with distribution uniformity, reporting overspray or run-off that
causes overland flow, and preparation of an irrigation schedule.
The landscape installation report shall include the following statement: "The landscape and
irrigation system have been installed as specified in the landscape and irrigation design plan and
complies with the criteria of the ordinance and the permit."
6. LANDSCAPE PROJECT SUBMITTAL:
Prior to issuance of building permits, the applicant shall submit a full landscape project submittal per
sections 14.15.040 A, B, C, and D of the Landscaping Ordinance if more than 2,500 square feet of
landscaping area is proposed. The Water-Efficient Design Checklist (Appendix A of Chapter 14.15),
Landscape and Irrigation Design Plans, and Water Budget Calculations shall be reviewed and
approved to the satisfaction of the Director of Community Development prior to issuance of building
permits.

7. DRYWELL &ONSITE DRAINAGE
The drywell shall be kept clear of debris and onsite drainage shall be maintained as shown on the
plans. If offsite drainage issues are reported, additional remedial measures may be required to the
satisfaction of the Director of Community Development.
8. PRIVACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future property owners of the
privacy protection measures and tree protection requirements consistent with the R-1 Ordinance, for
all windows with views into neighboring yards and a sill height that is 5 feet or less from the second
story finished floor. The precise language will be subject to approval by the Director of Community
Development. Proof of recordation must be submitted to the Community Development Department
prior to final occupancy of the residence.
9. EXTERIOR BUILDING MATERIALS/TREATMENTS
Final building exterior treatment plan (including but not limited to details on exterior color, material,
architectural treatments and/or embellishments) shall be reviewed and approved by the Director of
Community Development prior to issuance of building permits. The final building exterior plan shall
closely resemble the details shown on the original approved plans. Any exterior changes determined
to be substantial by the Director of Community Development shall require a minor modification
approval with neighborhood input.
10. CONSULTATTON WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to the
proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
11. COMPLIANCE WITH PUBLIC WORKS CONFIRMATION FORM
The project shall comply with the requirements indicated on the Public Works Confirmation form
dated 10/22/2012, including, but not limited to, dedications, easements, off-site improvements,
undergrounding of utilities, all necessary agreements, and utility installations/relocations as deemed
necessary by the Director of Public Works and required for public health and safety. The Public
Works Confirmation is a preliminary review, and is not an exhaustive review of the subject
development. Additional requirements may be established and implemented during the construction
permitting process. The project construction plans shall address these requirements with the
construction permit submittal, and all required improvements shall be completed to the satisfaction
of the Director of Public Works prior to final occupancy.
12. CONSTRUCTION PARKING
Construction parking on Scenic Boulevard, on or adjacent to the project site, will not be permitted
due to the narrow width of the Boulevard and the clearance requirements for emergency vehicles.
Construction traffic for this project should be limited to on-site parking, or along Carmen Road,
where permissible.
13. DEMOLITION REQUIREMENTS
a. All demolished building and site materials shall be recycled to the maximum extent feasible
subject to the Buildulg Official. The applicant shall provide evidence that materials were
recycled prior to issuance of final demolition permits.

b. Demolition shall be subject to the construction schedule as outlined in the approved e�ibit
"Construction Schedule of Fence" stamped as Received Apri15, 2013.
14. DUST CONTROL
The following construction practices shall be implemented during all phases of construction for the
proposed project to prevent visible dust emissions from leaving the site:
a. Water all active construction areas at least twice daily and more often during windy periods to
prevent visible dust from leaving the site; active areas adjacent to windy periods; active areas
adjacent to existing land uses shall be kept damp at all times, or shall be treated with non-toxic
stabilizers or dust palliatives.
b. Cover all trucks hauling soil, sand, and other loose materials or require all trucks to maintain at
least 2 feet of freeboard.
c. Pave, apply water at least three times daily, or apply (non-toxic) soil stabilizers on all unpaved
access roads, parking areas and staging areas at construction sites.
d. Sweep streets daily, or more often if necessary (preferably with water sweepers) if visible soil
material is carried onto adjacent public streets.
e. The applicant shall incorporate the City's construction best management practices into the
building permit plan set.
15. GRADING AND CONSTRUCTION HOURS
All grading activities shall be limited to the dry season (April 15 to October 15). Grading hours shall
be limited to Monday through Friday, 7 a.m. to 8 p.m. Grading, street construction, demolition or
underground utility work shall not occur on Saturdays, Sundays and holidays, and during the
nighttime period as defined in Section 10.48.053(b) of the Municipal Code. Construction activities
shall be limited to Monday through Friday, 8 a.m. to 8 p.m. and Saturday and Sunday, 9 a.m. to 6
p.m. Construction activities are not allowed on holidays. The developer shall be responsible for
educating all contractors and subcontractors of said construction resirictions. Rules and regulation
pertaining to all construction activities and limitations identified in this permit, along with the name
and telephone number of a developer appointed disturbance coordinator, shall be posted in a
prominent location at the entrance to the job site.
16. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indexnnified parties and the applicant to
attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project,
including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.
17. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and
a description of the dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest

within this 90-day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
Please note that if this permit is not vested within a year, it shall expire on Apri18, 2014.
Staff has made all the findings that are required for approval of a Two-Story Permit as required by the of
Cupertino's Municipal Code, Chapter 19.28.140 (B). Also,please note that an appeal of this decision can
be made within 14 calendar days from the date of the mailing of this decision. If this happens, you
will be notified of a public hearing,which will be scheduled before the Planning Commission.

1. Demolition on the existing primary residence begins. The Garage wall will be
removed on the same day the temporary fences are setup. (Two days work)
2. Survey engineer will perform the staking work. (Next day after demolish)
3. Contractor will start to build the retaining wall and fence. (The retaining wall and
fence will be completed within 10 days).

Locations will etermined based on the site topography such that there will be a
minimum of a eet fence. The fence shall meet the requirements of fence regulations,
and a two fee� lattice shall be maintained consistent throughout; however, the retaining
wall may be omitted where necessary.
On the property line on the uphill side of the existing property, an eight feet tall fence in
total will be maintained.
