ITS INTENTION TO ORDER VACATION OF A P TI I F STEVENS CREEK
BOULEVARD, WEST of C.UPERTrNO ROAD, AT 22257 STEVENS CREEK
BOULEVARD, WITH IRREVOCABLE OFFER OF DEDICATION FOR
ROADWAY PURPOSES, AS PROVIDED IN SECTION 8320 'ET SE Q. OF THE
STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA '
i WHEREAS, healing on Resolution No. 9978 was held on November 3,, 1997, at a regular
meeting of the City Council at 1 0300 Torre Avenue, Cupertino, California; and
WHEREAS-, it appears that notice thereof was duly given as required by law; .and
WHEREAS, from the evidence presented, both oral and documentary, .it appea to a in
the best interests of the City to vacate the hereinafter described portion of a* City street; and that
said portion of said City sleet is unnecessary- for present or prospective public street uses-

` however, said vacation is with are irrevocable offer of dedication for roadway purposes.
WHEREAS, existing streets are adequate to handle present and future projected traffic;
and
V EREAS, vacation is in conformance with the City's General Plan.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby declares its
intention to vacate the aforesaid portion of city strut.
1. That all or any protests against the vacation of said portion of City street be and
hereby are overruled and denied;
2. That said portion of Stevens Creek Boulevard described and shown i Exhibits
"A" and "B" attached hereto and made Part hereof, be and hereby is vacated with irrevocable
offer of dedication for roadway poses.
BE IT FURTHER. RESOLVED that the City Clerk be and hereby is instructed and
directed to cause a certified copy of this resolution, attested to and sealed with the official seal of
the City, to be recorded with the County Recorder of the County of Santa Clara, California,
forthwith.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
