and WHEREAS, the bylaws of the Commission included establishment of the Recycling and Waste Reduction Technical Advisory Committee (the TAC) to provide technical advice to the Commission on solid waste management and policy, to bring together a wide spectrum of viewpoints and expe countywide solid waste and recycling issues affecting individual and to assist in development of policies, and programs as well as revisions to the County Solid Waste Management Plan/County Integrated Waste Manag Plan; and WHEREAS, in accordance with the AB 939 provisions for financing solid waste diversion and planning activities, the County of Santa Cla collects the Countywide Solid Waste Planning Fee (SWPF) on each ton o waste disposed at landfills located within the County, on tons taken to non- disposal facilities located within the County and subsequently t disposal to landfills outside Santa Clara County, and on tons transported directly to disposal facilities located outside Santa Clara County, and t the SWPF, along with grants and voluntary contributions from age to fund the work of the Commission and the TAC; and WHEREAS, the field of solid waste management and recycling has become much more complex since the TAC was originally established, and the 1 101 Resolution No. 13- City of Cupertino has found it useful and cost-effective to work jointly with other local jurisdictions through the Commission and the TAC in order to comply with the increasing number of new laws and regulations; and WHEREAS, the responsibilities of the TAC have evolved over time to include recommending, implementing, monitoring, and auditing the funding for existing and new countywide programs included in the Commission-approved Annual Workplan and Budget and these enhanced duties need to be formalized by the cities and the County; and WHEREAS, in 2009 the Commission and the TAC appointed an Organizational Study Committee and an Organizational Study Subcommittee, respectively, and retained the services of Arroyo Associates to organizational structure of the countywide integrated waste mana system, programs, staffing and services; and WHEREAS, the Commission held a public meeting in May 2012 to discuss the recommendations of the Organizational Study with the TAC and the public and directed the TAC to prepare an agreement between all the agencies in Santa Clara County that are responsible for AB 939 compliance (all cities and the County) to clarify, enumerate and memorialize the duties of the TAC and to streamline the decision-making and reporting functions of the TAC; and WHEREAS, the Commission reviewed and approved the attached Agreement Creating the Santa Clara County Recycling and Waste Reduction Technical Advisory Committee and has recommended the Agreement to the County and to all of the cities in Santa Clara County for consideration and approval; Y. ,§°µ¸Street"»º!meansanasphaltcutonaresidentialstreetwithtotalareain excessof30squarefeetoranasphaltcutofanysizeonaCollectororArterialstreet. 146 Z. /«¸³¯ºº««!meansanypersonseekingand/orthathasobtainedanencroachment permitpursuanttothischapter. Aa. 4º¯²¯º¿!meansanentityconstitutingapublicutilityunderStatelaw. Ab. 1¯®ºof½§¿!meansthesurface,theairspaceabovethesurfaceandthearea belowthesurfaceofanypublicstreet,highway,lane,path,alley,sidewalk, boulevard,drive,bridge,tunnel,park,parkstrip,parkway,waterway,easement, orsimilarpropertyinwhichtheCitynoworhereafterholdsanypropertyinterest. Ac. 6§¹º«³§º«¸¯§²!meansanyrubbish,brush,earthorothermaterialofanynature whichisunused,unwanted,discardedortoberecycled. 14.08.020Encroachmentpermitrequired. A.ExceptasotherwiseprovidedinthisChapter,itisunlawfulforanypersonto encroachormakeorcausetobemadeanyencroachmentwithoutfirstobtainingan encroachmentpermitfromtheCityEngineer. B.Nouseofanyrightofwayoranyotherinterestorpropertypursuanttothischapter shallcreateorvestinaPermitteeanyownershiporotherinterestintherightofway, streetsorotherpropertyorinterestoftheCity.Permitsissuedinaccordancewiththis chaptermayberevokedatanytimedeemednecessarybytheCityEngineer. 14.08.030Exceptionstopermitrequirement. NoEncroachmentpermitshallberequiredforanyofthefollowing: 1.Anysignerected,constructedandmaintainedincompliancewithChapter 19.104.100;or 2.TheactionofanyofficeroremployeeoftheCityengagedinthedischargeof officialduties;or 3.Installationandmaintenanceoflandscapeadjacenttoresidentialproperties inaccordancewithsection14.12.080andmaintainedinaccordancewith 14.08.220 4.Utilitymaintenanceoroperationactivitiesthatdonotrequireexcavationsor installationofnewequipment.Ifthemaintenanceoroperationsworkisona CollectororArterialstreetandlimitsvehicularorpedestriantravel,Utility shallnotifytheCitypriortocommencementofworkandatrafficcontrolplan mayberequired. 147 14.08.040Pavementpreservation. Anystreetthathasbeenconstructed,reconstructed,resurfacedorresealedshallnot thereafterbecutoropenedforaperiodof3years,exceptforemergencystreetcuts. TheCityEngineershallalsograntexemptionsunderthefollowingcircumstances: 1.Relocationworkthatismandatedbyacounty,Stateorfederalagency. 2.Serviceforbuildingsorparcelswherenootherreasonablemeansof providingserviceexists,asdeterminebytheCityEngineer. 3.OthersituationsdeemedbytheCityEngineertobeinthebestinterestof thegeneralpublic. Whengrantingexceptionstothisregulation,theCityEngineermayimposeconditions determinedappropriatetoinsuretherapidandcompleterestorationofthestreetand thesurfacepaving. 14.08.050Permitapplicationprocess. Allpersonsdesiringorintendingtoobtainanencroachmentpermitmustapplywith thePublicWorksDepartmentbysubmittingacompletedapplicationsignedbythe applicant.TheCityEngineershallprescribeandprovideanapplicationformforthe permitrequiredbythisordinance. 14.08.060Fees. A.TheCityCouncilshallestablishascheduleoffeesforencroachmentsbyresolution. B.UnlesswaivedinwritingbytheCityEngineer,feeswillberequiredofanypublic agencywhichisauthorizedbylawtoestablishormaintainanyworksorfacilitiesin, underoroveranypublicstreetorrightofway. C.IndependentcontractorsorUtilitiesunderdirectcontractwiththeCity,forworkin benefitoftheCityareexemptfromfeesunderthisprovisionwhenworkinginbenefit oftheCityandperformingdutiesinthepublicrightofwayinaccordancewiththe termsofthecontract. 14.08.070Securityrequired. 148 A.TheCityEngineermayrequiresecurityinareasonableamountbasedontheproject sizeand/orscope,asreasonablydeterminedbytheCityEngineer,sufficientto reimbursetheCityforcostsofrestoringtherightofway.Anybondamountwillbe basedonanestimateprovidedbythePermitteeandapprovedbytheCityEngineer. Requiredsecuritymayincludeencroachmentbonds,faithfulperformancebonds,labor andmaterialbonds,cash,certificateofdeposit,letterofcreditorothersecuritydeemed acceptablebytheCityEngineer. B.AtanytimetheCityEngineerdeterminesthattheamountofthesecurityis insufficienttocoverpotentialcostsordamageswhichmightresultfromtheproject,the CityEngineermayrequirethePermitteetopostanadditionalbondorcashdeposit,or combinationthereof,asaconditionofcontinuingworkontheproject. C.SecuritydepositsshallnotberequiredofanypublicagencyorUtilitycompany whichisauthorizedbylawtoestablishormaintainanyworksorfacilitiesin,underor overanypublicstreetorrightofway. 14.08.080PermitteetoindemnifyCity. ThePermitteeshallbeliablefor,andindemnifyandholdtheCityharmlessfrom,all harm,injuries,ordamages(including§ººµ¸´«¿¹fees),includingbutnotlimitedto damagetopersonsorproperty,whichoccurinconnectionwithorresultingfromthe ongoinguseoftherightofway.The/«¸³¯ºº««¹liabilityunderthissectionshallnot applytoanyharm,injuriesordamagesresultingfromthe"¯º¿¹negligence,willful misconductorcriminalactsasadjudgedbyacourtofcompetentjurisdiction.Priorto issuanceofthepermit,thePermitteeshallfurnishtotheCityevidenceofinsurance coverageandendorsements(includingselfinsurance,ifapplicable)asdesignatedby theCityfortheliabilityassumedbythePermittee.TheCityshallprovidereasonable noticetothePermitteeuponreceiptofanyclaimofloss,actionordemandand cooperatewiththe/«¸³¯ºº««¹defenseagainstsuchclaim,includingproviding reasonableaccesstoinformation,evidence,andwitnessesnecessarytodefendagainst suchclaim.ThePermitteedoesnotwaiveitsrighttopursueanyorallavailablelegal remediestochallengethevalidityorlegalityofanyapplicablefederal,Stateorlocallaw byitsworkunderthischapter. 14.08.090Permitapprovalandissuance. Within7daysofreceiptofanencroachmentpermitapplication,theCityEngineerwill makereasonableefforttoeither,deemtheapplicationcompleteincompliancewithall 149 requirementsofthischapterandanyotherapplicablelaw,ornotifytheapplicantof deficiencies.Oncetheapplicationisdeemedcomplete,theencroachmentpermitshall eitherbedenied,orapprovedandissuedwithin21days.Permitsmayincludeany conditionstheCityEngineerdeemsreasonablynecessarytoprotectthepublicinterest, safetyandwelfare. 14.08.100Notices,termofpermit. A.Commencementofworkoruse.ThePermitteeshallbegintheworkoruse authorizedbyapermitissuedpursuanttothischapterwithinninety(90)calendardays fromdateofissuance,unlessadifferenttimeperiodisstatedinthepermit.Ifthework oruseisnotcommencedinatimelyfashion,thenthepermitshallbecomevoid,unless anextensionoftimetocommenceworkhasbeengrantedbytheCityEngineer. B.Notices.ThePermitteemayberequiredtoprovidenoticeofinstallationofany facilitiestopropertyownerswithin300feetoftheencroachmentasdirectedbytheCity Engineerand/ortheDirectorofCommunityDevelopment. C.Scheduleofwork.ThePermitteeshallnotifytheCityEngineeratleasttwofull businessdayspriortostartofanywork,exceptforworkperformedinconnectionwith anEmergency.ShouldtheworkstopformorethantwofullconsecutiveCityworking days,thePermitteeshallagainnotifytheCityEngineerasnotedabovepriorto restartingthework.Theworkmustbediligentlyprosecutedtoitscompletionandshall beperformedinsuchamannerastocauseminimuminconvenienceandhazardtothe publictotheextentreasonablypossibleasdeterminedbytheCityEngineer. .ThePermitteeshallnotifytheCityEngineerwhenwork D.Acceptanceofworkoruse oruseiscomplete.TheCityEngineershallaccepttheworkoruseascompletedonly afterthePermitteehasfulfilledallobligationsunderthischapterandtheprovisionsof thepermit,cleanedthesiteofalldebrisandleftthesiteinaneatandworkmanlike condition.TheCityEngineershallindicateacceptancebyendorsingthepermitinthe spaceprovided. 14.08.110Permitvalidfordescribedandapprovedworkoruseonly. Thepermitissuedshallnotbevalidforanyworkoruseotherthanthatdescribedinthe permitandasshownontheapprovedplans.NoMaterialchangestothelocation,size, ortypeofencroachmentshallbeallowedexceptuponauthorizationoftheCity Engineer. 14.08.120Displayofpermit. 150 A.Acopyofanypermitissuedpursuanttothischaptershallbekeptatthesiteofany constructionworkpertainingtotheencroachmentandshallbeshowntoany authorizedrepresentativeoftheCityondemand. B.Apermitissuedforcontinuinguseormaintenanceofanencroachmentinvolvingthe residenceorplaceofbusinessofthePermitteemaybekeptattheresidenceorplaceof businessandshallbemadeavailabletoanauthorizedrepresentativeoftheCitywithin 24hours. 14.08.130Constructionrequirements. ThePermitteeshallcomplywithallconstructionrequirementsestablishedbytheCity Engineer,includingbutnotlimitedtotherequirementssetforthinthissection. A.Standardsofconstruction.Allworkperformedunderthepermitshallconformto applicablelawandrecognizedstandardsofconstructionthatdonotconflictwith CaliforniaPublicUtilityCommission(CPUC)Standards,includingbutnotlimitedto thecurrentCityStandardsrelatingtostreetimprovementsandanyspecialprovisions relatingthereto,exceptthosestandardswhichmayconflictwiththosespecifically requiredbytheCPUCorStateorCityfranchiseagreements. .Priortocommencementofanyexcavation,the B.UndergroundServiceAlert(U.S.A.) PermitteeshallcallU.S.A.forfieldmarkingofexistingundergroundutilitiesin accordancewithapplicablerules. C.Inspectionandapproval.Allworkshallbesubjecttomonitoring,inspection,and approvalbytheCityEngineer. D.Protectionoftraffic.ThePermitteeshallplaceandmaintainadequatesigns, barricades,warninglights,andothersafeguardsnecessarytoprotectthepublic,and shallmaintainsafecrossingsforpedestrianandvehiculartrafficduringtheentire courseofthework.Warningsigns,lightsandsafetydevicesshallconformtothe requirementsofthecurrentStateofCaliforniaManualofUniformTrafficControl Devices. E.Repairs.EachPermitteeshallberesponsibleforrestoringtoitsformerconditionas nearlyasmaybepossibleanyportionoftherightofwaywhichhasbeenexcavatedor otherwisedisturbedordamagedbythePermittee.Iftherightofwayisnotrestoredas providedherein,theCityshallnotifythePermitteeofdeficiencies.IfthePermitteefails 151 torespondwithin5businessdaysofthedateofnotificationorandtheCityengineer deemssaiddeficienciesapublichazard,theCitymaymaketherepairs,andthe Permitteeshallbearthecostthereof.ThePermitteeisresponsibleformaintainingthe workareaatitssolecostandexpenseuntiltheCityacceptstheworkcoveredbythe permit.EachPermitteeshallrepairandcorrectanyandalldefectsanddeficienciesdue toworkmanshipormaterialsinconnectionwiththepermit. F.AsBuiltPlans.Whenconstructioniscomplete,PermitteeshallprovideasetofAs BuiltconstructiondrawingsattherequestoftheCityEngineer. 14.08.140Extendingpermit. TheCityEngineershallgrantthePermitteeatimeextensiontoapermitsubjectto compliancewiththerequirementsofthischapter,providedtherearenoMaterial changestotheoriginalapprovedconstructionplanssincetheinitialissuanceofthe permit.ThePermitteeshallrequestatimeextensiontoapermitbeforethe¶«¸³¯º¹ expirationdate. 14.08.150Releaseorrevisionofbondsandcashdeposits. Anybondorcashdepositsubmittedpursuanttothischaptershallbereleasedonly uponcompletionofallworkandconditionssetforthinthepermitdeemedsatisfactory bytheCityEngineer. 14.08.160Ongoinguseofrightofway. Inadditiontocomplyingwithallrelevantrequirementsforobtainingapermit containedherein,apersonowningfacilitiesin,seekingtoinstallfacilitiesin,orusing rightofwayshallcomplywithallrequirementsofthissectionexceptwheregoverned byotherregulatoryagencies. Thedesign,construction,installation, A.EncroachmentsatnoexpensetoCity. operation,maintenance,relocation,andremovalofthe/«¸³¯ºº««¹facilitiesshallbeat noexpensetotheCityandshallbesubjecttothereasonableapprovaloftheCity Engineertopreservetheintegrityandeffectiveuseofthepublicrightsofwayandto protectthepublichealth,safetyandwelfare. B.Relocationorremovalofencroachment.ThePermitteeshallremoveorrelocateany installationownedbyPermitteethatisinconflictverticallyand/orhorizontallywith anyCityinstallationthatisapropergovernmentaluseoftherightofwayandas subjecttoanyfranchiseagreement.IfthePermitteedoesnotcompleteremovalor 152 relocationwithinareasonableperiodofnotlessthan90daysasrequiredbytheCity Engineer,theCityshallhavefacilitiesremovedatthe/«¸³¯ºº««¹expense.Before proceedingwithrelocationwork,thePermitteeshallobtainappropriatepermitsand approvalsandshallrestoretheareavacatedtoanacceptableconditionasreasonably determinedbytheCityEngineer. C.Requirementsforutilitydistributionfacilities.OwnersofpublicorprivateUtility distributionfacilitiesplacedintherightofwayshallcomplywiththefollowing: 1.Nointerferencewithexistinguses.ShouldtheCitypermitfacilityinstallations (notincludinganyCityownedinstallations)wherethereareexistingfacilities, thePermitteeshallworkaroundexistingfacilities.Shoulditproveimpracticalto workaroundexistingfacilities,requiringtherelocationofanyexistingfacilities, andiftheownerofsaidexistingfacilitiesagreestorelocatethem,theownershall promptlyrelocateitsfacilities.Thereasonablecostofrelocatingexistingfacilities shallbebornesolelybythePermittee.However,ifatleastoneofthefollowing applies,theownershallpromptlyrelocateitsfacilitiesatnocosttothePermittee: Existingfacilitieswerenotproperlyinstalled; a. Facilitiesinstalledunlawfully; b. Federal,State,orlocallawrequiresrelocation. c. 2.Franchisesandauthorizations.ThePermitteeshallobtainfranchises,other authorizationsand/oragreements,ifreasonablyrequiredbytheCityand applicablelaw,andshallcomplywiththeprovisionsofanysuchfranchiseor otherauthorization,providingproofofsatisfactionofanyconditionthereof. 3.Maintenanceoffacilities.FacilitiesownedbyPermitteeinstalledpursuanttothis chaptershallatalltimesbemaintainedinaccordancewiththerequirementsof allapplicablelaws,franchisesandauthorizations.ThePermitteeshallmaintain itsfacilitiesingoodrepairandinasafeconditiontothereasonablesatisfactionof theCityEngineer,orapplicableregulatingagency. 4.Identificationoffacilities.ThePermitteeshallidentifyanyfacilitiesinstalledin therightofwayinaccordancewiththerequirementsofapplicablelaworby meansofanidentificationmethodasdirectedbytheCityEngineer.Such identificationshallbedetectablefromgroundlevelwithoutopeningthestreet. ThePermitteeshallprovidetheCityatelephonecontactnumber,staffedtwenty four(24)hoursperday,sevendaysperweek,toenabletheCitytoreportany 153 concernsregardingthefacilities,including,butnotlimitedto,theremovalofany graffiti/vandalism.IntheeventthattheCityreportssuchconcernstothe Permittee,andwheresuchconcernsarenotinconflictwithapplicablelawsand regulations,thePermitteeshallwithinseventytwo(72)hours,unlessweatheror emergenciesprohibittimelyaction,respondtosuchcallandperformthe requiredrepairorcorrectanyadverseimpacttothe"¯º¿¹orthird¶§¸º¿¹useor operationscausedbythe/«¸³¯ºº««¹facilitiesintherightofwayatnocosttothe City. 5.Compliancewithapplicablelaws.ThePermitteeshallcomplywithallapplicable federal,State,orlocallaws,rulesandregulationsforclearancesandsiting standards,includingbutnotlimitedtoCitynoiseordinances;andCityStandards relatingtostreetimprovements:DesignCriteria,StandardSpecifications,and StandardDetails. 6.Requirementsforabovegroundorsurfacemountedfacilities.Abovegroundor surfacemountedfacilitiesplacedpursuanttothischaptershall,where reasonablyfeasible,beplacedinalocationapprovedbytheCityEngineerandbe consistentwiththefollowingguidelines: a.ConsistentwithCaliforniaPublicUtilityCommissionrequirements. b.Shallbenolargerthanisreasonablynecessarytocontainandprotect therequiredfacilities.Intheeventanyabovegroundorsurfacemounted facilityexceedsseventytwo(72)incheshigh,fiftynine(59)incheswide andtwentyseven(27)inchesdeep,anenvironmentalreviewunder CEQAandanyotherapplicablelawsmustoccurpriortopermitissuance; c.ShallnotobstructpedestriansandshallcomplywiththeAmericans withDisabilitiesActandaccessrelatedregulations,including maintainingpedestrianclearance(freeofallobstaclesforaclearpathof travel,unobstructedpedestrianwalkway)exceptduringerection, construction,placementandmaintenance; d.Shallbesetbackaminimumoftwofeetfromthefaceofthecurbor lessasapprovedbytheCityEngineer; e.Shallnotintrudeintothevehiclevisibilityobstructionareaatstreet cornersorcreatevehicledrivewayobstructions; 154 f.ShallnotbeplacedatstreetintersectioncornersorattheendofT intersectionsreservedfortrafficsignalfacilitiesexceptasapprovedbythe CityEngineer; g.Shallnotobstructpedestrian,technician,orvehicleviewofanytraffic signorsignal; h.Shallbeplacedwithaminimumhorizontalclearanceofeightfeetfrom anysanitarysewerorstormdrainfacility,exceptwhereanexisting cabinetisalreadycloserthaneightfeettoasanitarysewerorstormdrain line,anewcabinetofthesametypemaybeplacedadjacenttothe existingcabinetwithaminimumhorizontalclearanceoffivefeetfrom thesanitarysewerorstormdrainline; i.ShallbesetbackaminimumoffivefeetfromanyCityutilityfacility, trafficsignalfacility,driveway,curbramp,orbluezoneparkingspace,or aminimumofthreeandonehalffeetfromanyother«´º¯º¿¹above groundorsurfacemountedstructurenototherwisespecifiedherein, includingbutnotlimitedtostreetpoles,parkingmeters,andpublicart; j.Shallbesetbackaminimumofeightfeetfromanyfireescapeand/or fireexitexceptasapprovedbytheCityEngineer; k.Shallnotbeplacedonthepropertyof,orimmediatelyadjacentto,any designatedlocal,Stateornationalregisterhistoricallandmarkor structure; l.ShallnotviolateanyCityCodeorpolicyrelatedtoCityownedtrees orheritagetrees,includingbutnotlimitedtotheprovisionsrelatedto alteration,removal,ortrenchingaffectinganyCityownedtree; m.Shallbescreenedbylandscapingwhereappropriateforthelocation. Wherelandscapingisrequired,Permitteeshallbefullyresponsibleforall costsassociatedwithremovalanddisposalofexistingplantmaterial, includingreplanting,modificationsorrepairofallirrigationdisturbedas aresultofinstalling,using,operating,andmaintainingthefacility. Replacementirrigationshallbeinthesamequantity,qualityandof comparablesizetothoseremoved. 155 n.Shallbepaintedorcoatedtoblendinwiththesurrounding environment;graffitiproofcoatingthatalsoblendsshallbeusedif feasible; o.Shallnotemitexcessiveheatorcreateanysafetythreatorharmtothe public. D.AttachmentstobridgesandoverpassesmaybepermittedwithapprovalbytheCity Engineerandotherregulatingagencies. E.UtilitymainlocationsaresubjecttotheapprovaloftheCityEngineer. F.APermitteeshallfurnishtotheCitydetailedmapsandrecorddrawingsdepicting allofthe/«¸³¯ºº««¹facilitiesinspecifiedportionsoftherightofwaywithinthelimits ofanyexcavationbythe"¯º¿L¹»©®mapsanddrawingstobeprovidedfreeofcharge withintwenty(20)calendardaysofanyrequest.Thedetailedmapsandrecord drawingsshallshowtheapproximatelocation,size,description,andnatureofallof /«¸³¯ºº««¹facilities.Thedrawingsandmapsshouldnotbereliedupontodetermine theexactlocationofanyundergroundfacilities.Toensureasafeexcavation,anyone desiringtoexcavatenearthefacilitiesmustcallU.S.A.priortothestartofexcavationto allowforfieldmarkingofexistingundergroundutilities. G.APermitteeshallpotholeitssubsurfacefacilitieswithinfifteen(15)daysofreceiptof awrittenrequestfromtheCitytodoso,unlessthePermitteecancertifywithinonefoot thelocationanddepthofitsfacilitieswherepotholingisrequested.TheCityshallinno eventpayanypotholeexpenses. H.APermitteeshall,atitssoleexpense,maintainmembershipinUndergroundService Alert(U.S.A.)andshallfieldmark,atitsexpense,thelocationofitsfacilitiesupon notificationinaccordancewithStatelaw,includingbutnotlimitedtoGovernment CodeSection4216andfollowing,asitnowreadsormayhereinafterbeamended. I.APermitteeshallinformtheCityinwritingofanymaterialchangeincontact information.SuchwrittennoticeshallbeprovidedtotheCityEngineerwithinsixty(60) daysofthechange. 14.08.170Damagetoexistingfacilitiesfromencroachments. A.ThePermitteeisresponsibleforanydamagetoprivatepropertyandCityfacilities, includingbutnotlimitedtopavement,curbandgutters,sidewalk,landscaping,and 156 utilities,occurringasaresultoforinanywayrelatedtoactivitiesassociatedwiththe /«¸³¯ºº««¹encroachment,includinginstallation,maintenance,repair,operation,and removalof/«¸³¯ºº««¹facilitiesintherightofwaybythePermittee,itsemployeesor agents.The/«¸³¯ºº««¹liabilityunderthissectionshallnotapplytotheextentthat damageiscausedbythesoleoractivenegligence,willfulmisconductorcriminalactsof City,itsagentsoremployees. B.IntheeventofanydamagecausedbyPermittee,thePermitteeshallpaythecostof anyreplacements,repairsorrestorationnecessarytoreturntheproperty,rightofway, facilities,orinstallationstotheconditionthatexistedpriortothedamage. C.Anydamagetosurfaceandsubsurfaceimprovements,suchaspavementorconcrete overanytrench/excavationoradjacentthereto,asreasonablydeterminedbytheCity Engineerwhichresultsfromthe/«¸³¯ºº««¹actsoromissionsshallbethesole responsibilityofthePermittee.ThePermitteeshallcompleteallnecessaryrepairs withinthirty(30)daysofnotificationbytheCityEngineer,orifitreasonablywould requiremorethanthirty(30)daystoperformsuchrepairs,withinatimereasonably necessary,providedthePermitteehasundertakentoinitiatetherepairswithinthe thirty(30)dayperiodanddiligentlypursuessucheffortstocuretocompletion.Ifthe Permitteefailstomakerepairswithintheapplicableperiod,oriftheCityEngineer determinesthedamagetobeapublichazard,theCitymayhaverepairsmadeandbill thecosttothePermittee. 14.08.180Adherencetorulesandregulations. Eachpersonshallcomplywithallrulesandregulationscontainedhereinevenifthe workhasbeenperformedunderanemergencyencroachment.TheCityEngineermay revokeapermitissuedunderthischapteruponviolationofanyofitsprovisionsorthe provisionsofanypermitissuedhereunder. 14.08.190TransferofPermits. Permitsissuedpursuanttothisordinancearenottransferrable.A/«¸³¯ºº««¹agent mayfileanapplicationforanencroachmentpermitonbehalfofthePermitteewithout causingatransferofpermit. 14.08.200Emergencyencroachments. Thisordinancedoesnotpreventapersonfromperformingemergencymaintenanceto repairabrokenordefectivepipe,facilityorconduitlawfullyonorunderapublicright ofwayorexcavatingbyaUtilityasmaybenecessaryforthepreservationoflifeand 157 propertywhenanurgentnecessityarises.However,thepersonperformingan emergencyencroachmentduringnormalCitybusinesshoursshallnotifytheCity Engineerbytelephonewithinfourhoursofbeginningsaidemergencywork.Ifthe emergencyworkmustoccurduringhourstheCityofficesareclosed,thatnoticeshallbe giventoCountyCommunications.Thenoticeshallrelaythenatureandlocationofthe emergency,andthepersonmakinganemergencyuseorencroachmentshallapplyfora permitthenextbusinessday.Utilitiesshallnotberequiredtoobtainanencroachment permitpriortoworkperformedinconnectionwithanEmergency. 14.08.210Abandonmentorremovaloffacilitiesfromrightofway. A.IfaPermitteeintendstoremoveitsfacilities,thePermitteeshallobtainapermit pursuanttothischapterforallfacilityremovalfromtherightofwaypriortosuch removal. B.IfaUtilityintendstoabandonitsfacilities,theUtilityshallnotifytheCityEngineer priortoabandonmentbysendingwrittennoticeatleastthirty(30)dayspriorto abandonment.Allfacilitiesshallberemoved,abandonedinplace,ordedicatednolater thanonehundredeighty(180)daysoftheCityEngineersapproval. C.IftheCitydeterminesaPermittee(otherthanaUtility)hasabandonedprivately ownedfacilities,theCityshallprovidethePermitteewithwrittennoticetoremovetheir facilitiesfromtherightofwaywithinthirty(30)days.Facilityremovalshallbeatno costtotheCity. D.IfthePermittee(otherthanaUtility)takesnoactionwithinthistimeperiod,theCity mayelecttoaccepttitletosuchfacilitiesfreeandclear,orremovethefacilitiesand chargethePermitteewithallreasonablecostsincurredinsuchremoval.Permitteeshall makepaymentwithinthirty(30)daysofthe"¯º¿¹returnofsuchfacilitiestothe PermitteeormakingsuchfacilitiesavailabletothePermitteeforpickupwithinCity limits. E.Encroachmentsthathavebeenmadewithoutapermitorbypersonsnototherwise entitledtooperatewithinpublicrightsofwaypursuanttofederal,Stateorlocallaware notsubjecttotheprovisionsoftheabandonmentprocessdescribedinthissection. F.TheprovisionsofthissectionapplyonlytoCitydeterminationsofabandonmentand notwheretheCityhasrevokedapermitpursuanttosection14.08.020(b). 14.08.220Obstructionsdeemedpublicnuisance. 158 A.TheCityanditsresidentsshareinthecareandmanagementoflandscapewithinthe rightofwaylocatedadjacenttoprivateproperty.Noownerorlegaloccupantofany premisesabuttinguponanyrightofwayshallpermittheexistenceofobstructions definedbythischaptertobeanuisance. B.Thefollowingistobeanonexclusivelistofobstructionswhichunderthischapter aredeemedtoobstructtheviewfromvehiclestravelingonpublicstreetsandthe passageofpedestriansonthesidewalksandofvehiclesontherightsofwayabutting thereonandaredeclaredtobeapublicnuisanceandprohibitedasunlawful: 1.Atreewithlimbsoverhangingtherightofway,thelowestpartofwhichis lessthaneightandonehalffeetabovetherightofway; 2.Landscapeoverhangingthestreet,gutter,sidewalkorobstructingany municipalutilityfacilityorfirehydrant; 3.Anylandscapewhichissosituatedastoobscureandimpairtheunobstructed viewofintersectingtrafficbypassingmotoristsorpedestriansorobscureand impairtheviewofstreet,traffic,andothercontroldevicesandsignsplacedupon thestreetsforthesafetyofthepublic. C.TheCityEngineer,upondeterminingthatoneormoreofthenuisancesprohibited hereinexistorthatanyothersimilarobstructiontothepassageofvehiclesor pedestriansatintersectionsexistsonpremiseswithintheCity,shallgivewrittennotice tothepropertyownerorlegaloccupanthavingchargeorcontrolofthepremisesto removethenuisancesodesignatedtherein,anditisunlawfulfortheownerorlegal occupanthavingchargeorcontrolofthepremisestoneglectorfailtoremovetherefrom theobstructionwithinfivebusinessdaysfromthedateofthenotice. D.IftheCityEngineerfindsthatanyrightofwayobstructionisanimmediateperilor menacetothepublic,toanyperson,ortopedestrianorvehiculartraffic,theCity Managermaycauseittobesummarilyremoved.Uponsummaryremovalofthe obstruction,theCityManagershallprovidewrittennoticetothepropertyownerof actionstaken.AnycostincurredbyorfeesimposedbytheCityintheremoval, alteration,relocation,ordemolitionofanysignpursuanttotheprovisionsofthistitleor anyotherpertinentordinanceoftheCity,shallbepaidbytheownerofproperty abuttingtherightofwayonwhichtheobstructionwaslocated. E.Inadditiontoanyoftheremediesprovidedforhereinorbylawforviolationsof thisChapter,theCityAttorneymaymaintainanactionforinjunctiontorestrainor 159 abatementtocorrectorcompeltheremovalofsuchviolationorviolationsasprovided inthisCode. 14.08.230Penalties. A.Pursuanttothe"¯º¿¹prosecutorialdiscretion,theCitymayenforceviolationsofthe provisionsofthischapterascriminal,civiloradministrativeactions. B.Everyviolationofthischaptershallbeamisdemeanor;provided,however,that wheretheCityAttorneyhasdeterminedthatsuchactionwouldbeinthebestinterest ofjustice,theCityAttorneymayspecifyintheaccusatorypleadingorcitationthatthe violationshallbeprosecutedasaninfraction.Codeenforcementofficers,asdefinedby thisCode,shallhavethepowertoissueadministrativeandinfractioncitationsfor violationsofthischapter. C.Violationsofthischaptermayalsobepunishableasinfractionsoradministrative actionsinaccordancewithChapters1.10and1.12. The words and terms used in this chapter shall have the following meanings unless the context clearly indicates otherwise: A.Abandon or abandoned facilities means facilities not used to provide service for a period of one hundred eighty (180) days, or if the authorizati- of-way held by Permittee is revoked, terminated or abandoned. B.Arterial Street Any street classified as Arterial per the Circulation Element of the Citys General Plan. C.Applicable law means all lawfully enacted and applicable federa laws, ordinances, codes, rules, regulations and orders as may be amended or adopted from time to time. D.Business day means a day on which the main operations of the C are open for business and does not mean any day on which only sp functions are in operation, such as divisions of the City or its agents th a 24/7 schedule. 2 163 E.City means the City of Cupertino, California. Any act that may be taken by the City, the City Council or any agency, department, agent or other entit hereafter authorized to act on the Citys behalf. F.City Council means the governing body of the City of Cupertino, California. G.City Engineer means the City Engineer or his or her designee. H. City Manager means the City Manager or any person authorized or designated by the City Manager to act on his or her behalf. I.Collector Street means any street classified as a Minor Collector or Major Collector per the Circulation Element of the Citys General Plan. J.Construction, operation, maintenance or repair and similar formulations of those terms mean the named actions interpreted broadly, encompas other things, installation, extension, maintenance, repair, repl components, relocation, undergrounding, grading, site preparation, adjusting, testing, make-ready, excavation and tree trimming. The term operation does n encompass or regulate the provision of services or the ownership or use of facilities in rights-of-way or other property subject to the jurisdiction of the City, but refers to activities affecting rights-of-way and other property subject to the jurisdiction of the City. K.Days means calendar days, unless otherwise indicated. L.Emergency means an immediate hazard or danger to life, health o reasonably determined by a Utility. M.Emergency encroachment means an encroachment necessitated by t good, safety, health or welfare by a person with facilities located in the right-of-way. N.Emergency street cut means any street cut by a Utility to repair a facility within the right-of-way to remediate an immediate hazard or danger to life, health o property, as determined at the discretion of the City Engineer. O.Encroach or encroachment includes going upon, over or under -of-way, or using a right-of-way or an area adjacent to a right-of-way in such a manner as to prevent, obstruct or interfere with the intended or normal use of that way, or a modification of its mode of use, including but not limited to: 3 164 1.Excavation or disturbance; 2.Erection, construction, placement or maintenance of any facility; 3.Planting or maintaining any landscaping or hardscape; 4.Placement or maintenance of any waste material, except the place solid waste or recyclables in authorized receptacles for pick-up in accordance with Chapter 6.24. P.Encroachment permit means a permit issued pursuant to and in c with this chapter. Q.Facility or Facilities means any post, sign, pole, fence, guard rail, wall, pathway, sidewalk, driveway, track, surfacing, culvert, drainage facility, pipe, appurtenances, conduit, cable, utility cabinet, embankment, excavation, public improvements, orsimilarproperty constructed or placed in the right-of-way. R.Fence means an obstruction of whatever material or composition designed, intended or used to protect, defend or obscure the inte owner thereof from the view, trespass or passage of others upon S.Hardscape means any constructed flatwork built of concrete, stone, wood, or other such non-pervious or pervious durable material. T.Landscape means any tree, hedge, shrub, grass, groundcover, plant, solid landscape feature or growing thing excluding City Street Trees as defined by Section 14.12.020. U.Material change means any variation from approved plan other than horizontal changes of one foot or less. V.Minor Encroachment means a traffic lane closure or physical im located within sidewalk or landscape adjacent to a residential street. W.Minor Street Cut meansan asphalt cut on a residential street which total area does not exceed 30 square feet. X.Major Encroachment means a traffic lane closure or physical im located within sidewalk or landscape adjacent to a Collector or Arterial street. Y.Major Street Cut means an asphalt cut on a residential street with total area in excess of 30 square feet or an asphalt cut of any size on a Collector or Arte 4 165 Z.Permittee means any person seeking and/or that has obtained an encroachm permit pursuant to this chapter. Aa. Utility means an entity constituting a public utility under State law. Ab. Right-of-way means the surface, the air space above the surface and the area below the surface of any public street, highway, lane, path, all boulevard, drive, bridge, tunnel, park, park strip, parkway, waterway, easement, or similar property in which the City now or hereafter holds any Ac. Waste material means any rubbish, brush, earth or other materi which is unused, unwanted, discardedor to be recycled. 14.08.020 Encroachment permit required. A. Except as otherwise provided in this Chapter, it is unlawful for any person to encroach or make or cause to be made any encroachment without first obtainingan encroachment permit from the City Engineer. B. Nouse of any right-of-way or any other interest or property pursuant to this chapter shall create or vest in a Permitteeany ownership or other interest in the right-of-way, streets or other property or interest of the City.Permits issued in accordance with this chapter may be revoked at any time deemed necessary by the City Engineer. 14.08.030 Exceptions to permit requirement. No Encroachment permit shall be required for any of the followin 1.Any sign erected, constructed and maintained in compliance with Chapter 19.104.100; or 2. The action of any officer or employee of the City engaged in the discharge of official duties; or 2.3.Installation and maintenance of landscape adjacent to residential properties in accordance with section 14.12.080 and maintained in accordance with 14.08.220 3.4.Utility maintenance or operation activities that do not require excavations or installation of new equipment. If the maintenance or operations work is on a Collector or Arterial street and limits vehicular or pedestrian tra shall notify the City prior to commencement of work and a traffi may be required. 5 166 14.08.040 Pavement preservation. Any street that has been constructed, reconstructed, resurfaced or resealed shall not thereafter be cut or opened for a period of 3 years, except for emergency street cuts. The City Engineer shall also grant exemptions under the following circumstances: 1.Relocation work that is mandated by a county, State or federal agency. 2.Service for buildings or parcels where no other reasonable means providing service exists, as determine by the City Engineer. 3.Other situations deemed by the City Engineer to be in the best i the general public. When granting exceptions to this regulation, the City Engineer may impo determined appropriate to insure the rapid and complete restoration of the street and the surface paving. 14.08.050 Permit application process. All persons desiring or intending to obtain an encroachment permit must apply with the Public Works Department by submitting a completed application signed by the applicant. The City Engineer shall prescribe and provide an application form for the permit required by this ordinance. 14.08.060 Fees. A. The City Council shall establish a schedule of fees for encroachments by resolution. B. Unless waived in writing by the City Engineer, fees will be required of any public agency which is authorized by law to establish or maintain any ws or facilities in, under or over any public street or right-of-way. C. Independent contractors or Utilities under direct contract with the City, for work in benefit of the Cityare exempt from fees under this provision when working in benefi of the City and performing duties in the public right-of-way in accordance with the terms of the contract.and performing duties in the public right-of-way in accordance with the terms of the contract shall be exempt from fees under this provision . 14.08.070 Security required. 6 167 A. The City Engineer may require security in a reasonable amount based on the project size and/or scope, as reasonably determined by the City Engineer, sufficient to reimburse the City for costs of restoring the right-of-way. Any bond amount will be based on an estimate provided by the Permittee and approved by the City Engineer. Required security may include encroachment bonds, faithful perfo and material bonds, cash, certificate of deposit, letter of credit or other securitydeemed acceptable by the City Engineer. B. At any time the City Engineerdetermines that the amount of thesecurity is insufficient to cover potential costs or damages which might res City Engineer may require the Permittee to post an additional bond or cash deposit, or combination thereof, as a condition of continuing work on the pr C. Security deposits shall not be required of any public agency or Utility company which is authorized by law to establish or maintain any works or facilities in, under or over any public street or right-of-way. 14.08.080 Permittee to indemnify City. The Permittee shall be liable for, and indemnify and hold the City harmless frall harm, injuries, or damages (including attorneys fees),including but not limited to damage to persons or property, which occur in connection with or ongoing use of the right-of-way. The Permitteesliability under this section shall not apply to any harm, injuries or damages resulting from the Citys negligence, willful misconduct or criminal acts as adjudged by a court of competent issuance of the permit, the Permittee shall furnish to the City evidence of insurance coverage and endorsements (including self insurance, if applicable) as designated by the City for the liability assumed by the Permittee. The City shall provide reasonable notice to the Permittee upon receipt of any claim of loss, action or demand and cooperate with the Permitteesdefense against such claim, including providing reasonable access to information, evidence, and witnesses necess such claim. The Permittee does not waive its right to pursue any or all available legal remedies to challenge the validity or legality of any applicable federal, State or local law by its work under this chapter. 14.08.090 Permit approval and issuance. Within 7 days of receipt of an encroachment permit application, will make reasonable effort toeither, deem the application complete in compliance with all 7 168 requirements of this chapter and any other applicable law, or notify the applicantof deficiencies. Once the application is deemed complete, the encr either be denied, or approved and issued within 21 days. Permits may include any conditions the City Engineer deems reasonably necessary to protect the public interest, safety and welfare. 14.08.100 Notices, term of permit. A. Commencement of work or use. The Permittee shall begin the work or use authorized by a permit issued pursuant to this chapter within ninety (90) calendar days from date of issuance, unless a different time period is stated or use is not commenced in a timely fashion, then the permit shall become void, unless an extension of time to commence work has been granted by the City Engineer. B. Notices. The Permittee may be required to provide notice of installation of any facilities to property owners within 300 feet of the encroachment as directed by the City Engineer and/or the Director of Community Development. C. Schedule of work. The Permittee shall notify the City Engineer at least two full business days prior to start of any work, except for work performed in connection with an Emergency. Should the work stop for more than two full consecutive City working days, the Permittee shall again notify the City Engineer as noted above prior to restarting the work. The work must be diligently prosecuted to i be performed in such a manner as to cause minimum inconvenience and hazard to the public to the extent reasonably possible as determined by the City Engineer. D. Acceptance of work or use. The Permittee shall notify the City Engineer when work or use is complete. The City Engineershall accept the work or use as completed only after the Permittee has fulfilled all obligations under this chapter and the provisions of the permit, cleaned the site of all debris and left the site in a ne condition. The City Engineer shall indicate acceptance by endorsing the permit in the space provided. 14.08.110 Permit valid for described and approved work or use only. The permit issued shall not be valid for any work or use other than that described in the permit and as shown on the approved plans. No Material changes to the location, size, or type of encroachment shallbe allowed except upon authorization of the City Engineer. 14.08.120 Display of permit. 8 169 A. A copy of any permit issued pursuant to this chapter shall be ke construction work pertaining to the encroachment and shall be sh authorized representative of the City on demand. B. A permit issued for continuing useor maintenance of an encroachment involving the residence or place of business of the Permittee may be kept at the residence or place of business and shall be made available to an authorized representative of the City within 24 hours. 14.08.130Construction requirements. The Permittee shall comply with all construction requirements established by t Engineer, including but not limited to the requirements set fort A. Standards of construction. All work performed under the permit shall conform to applicable law and recognized standards of construction that do not conflict with California Public Utility Commission(CPUC) Standards, including but not limited to the current City Standards relating to street improvements and any special provisions relating thereto, except those standards which may conflict with those specifica required by the CPUC or State or City franchise agreements. B. Underground Service Alert (U.S.A.). Prior to commencement of any excavation, the Permittee shall call U.S.A. for field marking of existing underground utilit in accordance with applicable rules. C. Inspection and approval. All work shall be subject to monitoring, inspection, and approval by the City Engineer. D. Protection of traffic. The Permittee shall place and maintain adequate signs, barricades,warning lights, and other safeguards necessary to protect the public, and shall maintain safe crossings for pedestrian and vehicular traff course of the work. Warning signs, lights and safety devices shall conform to the requirements of the current State of California Manual of Uniform Traffic Control Devices. E. Repairs. Each Permittee shall be responsible for restoring to its former condition as nearly as may be possible any portion of the right-of-way which has been excavated or otherwise disturbed or damaged by the Permittee. If the right-of-way is not restored as provided herein, the City shall notify the Permittee of deficiencies. If the Permittee fails 9 170 to respond within 5 business days of the date of notification or and the City engineer deems said deficiencies a public hazard, the City may make the repairs, and the Permittee shall bear the cost thereof. The Permittee is responsible for maintaining the work area at its sole cost and expense until the City accepts the work covered by t permit. Each Permittee shall repair and correct any and all defects and deficiencies du to workmanship or materials in connection with the permit. F. As-Built Plans. When construction is complete, Permittee shall provide a set of As- Built construction drawings at the request of the City Engineer. 14.08.140 Extending permit. The City Engineer shall grant the Permittee a time extension to a permit subject to compliance with the requirements of this chapter, provided there are no Material changes to the original approved construction plans since the in permit. The Permittee shall request a time extension to a permit before the permits expiration date. 14.08.150 Release or revision of bonds and cash deposits. Any bond or cash deposit submitted pursuant to this chapter shal upon completion of all work and conditions set forth in the permdeemed satisfactory by the City Engineer. 14.08.160Ongoing use of right-of-way. In addition to complying with all relevant requirements for obta contained herein, a person owning facilities in, seeking to inst right-of-way shall comply with all requirements of this sectionexcept where governed by other regulatory agencies. A. Encroachments at no expense to City. The design, construction, installation, operation, maintenance, relocation, and removal of the Permittees facilities shall be at no expense to the City and shall be subject to the reasonable approval of the City Engineer to preserve the integrity and effective use of the public rights-of-way and to protect the public health, safety and welfare. B. Relocation or removal of encroachment. The Permittee shall remove or relocate any installation owned by Permittee that is in conflict vertically and/or horizontally with any City installation that is a proper governmental use of the r-of-way and as subject to any franchise agreement. If the Permittee does not complete removal or 10 171 relocation within a reasonable period of not less than 90 days as required Engineer, the City shall have facilities removed at the Permittees expense. Before proceeding with relocation work, the Permittee shall obtain appropriate permits and approvals and shall restore the area vacated to an acceptable co determined by the City Engineer. C.Requirements for utility distribution facilities. Owners of public or private Utility distribution facilities placed in the right-of-way shall comply with the following: 1.No interference with existing uses. Should the City permit facility installations (not including any City-owned installations) where there are existing facilities, the Permittee shall work around existing facilities. Should it prove impractical to work around existing facilities, requiring the relocation of any and if the owner of said existing facilities agrees to relocate promptly relocate its facilities. The reasonable cost of relocating existing facilities shall be borne solely by the Permittee. However, if at least one of the following applies, the owner shall promptly relocate its facilities at no Permittee: Existing facilities were not properly installed; a. Facilities installed unlawfully; b. Federal, State, or local law requires relocation. c. 2. Franchises and authorizations. The Permittee shall obtain franchises, other authorizations and/or agreements, if reasonably required by the applicable law, and shall comply with the provisions of any such franchise or other authorization, providing proof of satisfaction of any cond 3.Maintenance of facilities. Facilitiesowned by Permittee installed pursuant to this chapter shall at all times be maintained in accordance with the requirements of all applicable laws, franchises and authorizations. The Permittee shall maintain its facilitiesin good repair and in a safe condition to the reasonable satisfa the City Engineer, or applicable regulating agency. 4. Identification of facilities. The Permittee shall identify any facilities installed in the right-of-way in accordance with the requirements of applicable law or by means of an identification method as directed by the City Engineer. Such identification shall be detectable from ground level without opening The Permittee shall provide the City a telephone contact number, staffed twent- four (24) hours per day, seven days per week, to enable the City 11 172 concerns regarding the facilities, including, but not limited to, the removal of any graffiti/vandalism. In the event that the City reports such conc Permittee, and where such concerns are not in conflict with applicable laws regulations, the Permittee shall within seventy-two (72) hours, unless weather or emergencies prohibit timely action, respond to such call and per required repair or correct any adverse impact to the Citys or t operations caused by the Permitteesfacilities in the right-of-way at no cost to the City. 5.Compliance with applicable laws. The Permittee shall comply with all applicable federal, State, or local laws, rules and regulations for clearan standards, including but not limited to City noise ordinances; and City Standards relating to street improvements: Design Criteria, Standard Specifications, and Standard Details. 6.Requirements for above-ground or surface mounted facilities. Above-ground or surface-mounted facilities placed pursuant to this chapter shall, where reasonably feasible, be placed in a location approved by the City Engineer and be consistent with the following guidelines: a. Consistent with California Public Utility Commission requirement b. Shall be no larger than is reasonably necessary to contain and protect the required facilities. In the event any above-ground or surface-mounted facility exceeds seventy-two (72) inches high, fifty-nine (59) inches wide and twenty-seven (27) inches deep, an environmental review under CEQA and any other applicable laws must occur prior to permit issuance; c. Shall not obstruct pedestrians and shall comply with the Americans with Disabilities Act and access-related regulations, including maintaining pedestrian clearance (free of all obstacles for a clear path of travel, unobstructed pedestrian walkway) except during erection, construction, placement and maintenance; d. Shall be set back a minimum of two feet from the face of the curbor less as approved by the City Engineer; e. Shall not intrude intothe vehicle visibility obstruction area at street corners or create vehicle driveway obstructions; 12 173 f. Shall not be placed at street intersection corners or at the end of T- intersections reserved for traffic signal facilities except as approved by the City Engineer; g. Shall not obstruct pedestrian, technician, or vehicle view of any traff sign or signal; h. Shall be placed with a minimum horizontal clearance of eight feet from any sanitary sewer or storm drain facility, except where an exis cabinet is already closer than eight feet to a sanitary sewer or storm dr line, a new cabinet of the same type may be placed adjacent to t existing cabinet with a minimum horizontal clearance of five fee the sanitary sewer or storm drain line; i. Shall be set back a minimum of five feet from any City utility facility traffic signal facility, driveway, curb ramp, or blue zone parkig space, or a minimum of three and one-half feet from any other entitys above- ground or surface-mounted structure not otherwise specified herein, including but not limited to street poles, parking meters, and p j. Shall be set back a minimum of eight feet from any fire escape and/or fire exit except as approved by the City Engineer; k. Shall not be placed on the property of, or immediately adjacent to, any designated local, State or national register historical landmark or structure; l. Shall not violate any City Code or policy related to City-owned trees or heritage trees, including but not limited to the provisions related to alteration, removal, or trenching affecting any City-owned tree; m. Shall be screened by landscaping where appropriate for the location. Where landscaping is required, Permittee shall be fully responsible for all costs associated with removal and disposal of existing plant material, including replanting, modifications or repair of all irrigation a result of installing, using, operating, and maintaining the fa Replacement irrigation shall be in the same quantity, quality and of comparable size to those removed. 13 174 n. Shall be painted or coated to blend in with the surrounding environment; graffiti-proof coating that also blends shall be used if feasible; o.Shall not emit excessive heat or create any safety threat or harm to the public. D.Attachments to bridges and overpassesmay be permittedwithapproval by the City Engineer and other regulating agencies. E.Utility main locations are subject to the approval of the City E. F. A Permittee shall furnish to the City detailed maps and record drawings depicting all of the Permittees facilities in specified portions of the right-of-way within the limits of any excavation by the Citysuch maps and drawings to be provided free of charge within twenty (20) calendar days of any request. The detailed maps and record drawings shall show the approximate location, size, description, and nature of all of Permittees facilities.The drawings and maps should not be relied upon to determine the exact location of any underground facilities. To ensure a safe excavation, anyone desiring to excavate near the facilities must call U.S.A. prior to the start of excavation to allow for field marking of existing underground utilities. G. A Permittee shall pothole its subsurface facilitieswithin fifteen (15) days of receipt of a written request from the City to do so, unless the Permittee can certify within one foot the location and depth of its facilities where potholing is requ event pay any pothole expenses. H. A Permitteeshall, at its sole expense, maintain membership in Underground S Alert (U.S.A.) and shall field mark, at its expense, the locatiofacilitiesupon notification in accordance with State law, including but not lim Code Section 4216 and following, as it now reads or may hereinafter I. A Permitteeshall inform the City in writing of any material change in conta information. Such written notice shall be provided to the City Engineerwithin sixty (60) days of the change. 14.08.170 Damage to existing facilities from encroachments. A.The Permitteeis responsible for any damage to private property and City facil including but not limited to pavement, curb and gutters, sidewal 14 175 utilities, occurring as a result of or in any way related to activities Permittees encroachment, including installation, maintenance, repair, opera removal of Permittees facilities in the right-of-way by the Permittee, its employeesor agents. The Permittees liability under this section shall not apply to damage is caused by the sole or active negligence, willful misco City, its agents or employees. B. In the event of any damage caused by Permittee, the Permittee shall pay the cost of any replacements, repairs or restoration necessary to return the-of-way, facilities, or installations to the condition that existed prior C. Any damage to surface and subsurface improvements, such as pavement or concrete over any trench/excavation or adjacent thereto, as reasonably de Engineer which results from the Permittees acts or omissions shall be the sole responsibility of the Permittee. The Permitteeshall complete all necessary repairs within thirty (30) days of notification by theCity Engineer, orif it reasonably would require more than thirty (30) days to perform such repairs, within a time reasonably necessary, provided the Permittee has undertaken to initiate the repairs within the thirty (30) day period and diligently pursues such efforts to cu. If the Permittee fails to make repairs within the applicable period, or if the City Engineer determines the damage to be a public hazard, the City may have repairs made and bill the cost to the Permittee. 14.08.180 Adherence to rules and regulations. Each person shall comply with all rules and regulations containe work has been performed under an emergency encroachment.The City Engineer may revoke a permit issued under this chapter upon violation of any provisions of any permit issued hereunder. 14.08.190 Transfer of Permits. Permits issued pursuant to this ordinance are not transferrable.A Permittees agent may file an application for an encroachment permit on behalf of Permittee without causing a transfer of permit. 14.08.200 Emergency encroachments. This ordinance does not prevent a person from performing emergen repair a broken or defective pipe, facility or conduit lawfully on or under a public right- of-way or excavating by a Utility as may be necessary for the preservation of life and 15 176 property when an urgent necessity arises. However, the person performing an emergency encroachment during normal City business hours shall notify the Engineer by telephone within four hours of beginning said emergency work. If the emergency work must occur during hours the City offices are clos given to County Communications. The notice shall relay the nature and location of emergency, and the person making an emergency use or encroachmen permit the next business day. Utilities shall not be required to obtain an encroachment permit prior to work performed in connection with an Emergency. 14.08.210 Abandonment or removal of facilities from right-of-way. A. If a Permittee intends to removeitsfacilities, the Permittee shall obtain a permit pursuant to this chapter for all facility removal from the right-of-way prior to such removal. B. If a Utility intends to abandon its facilities, the Utilityshall notify the City Engineer prior to abandonment by sending written notice at least thirty ( abandonment. All facilities shall be removed, abandonedin place, or dedicated no later than one hundred eighty (180) days of the City Engineers approval. C. If the City determines a Permittee (other than a Utility) has abandoned privately owned facilities, the City shall provide the Permittee with written notice to remove their facilities from the right-of-way within thirty (30) days. Facility removal shall be at no cost to the City. D. If the Permittee (other than a Utility) takes no action within this time period, the City may elect to accept title to such facilities free and clear, or remove the facilities and charge the Permittee with all reasonable costs incurred in such removal. Permittee shall make payment within thirty (30) days of the Citys return of such facilities to the Permittee or making such facilities available to the Permittee for pickup within City limits. E. Encroachments that have been made without a permit or by persons not otherwise entitled to operate within public rights-of-way pursuant to federal, State or local law are not subject to the provisions of the abandonment process describhis section. F. The provisions of this section apply only to City determinations not where the City has revoked a permit pursuant to section 14.08.020(b). 14.08.220 Obstructions deemed public nuisance. 16 177 A. The City and its residents share in the care and management of l right-of-way located adjacent to private property. No owner or legal occupant of any premises abutting upon any right-of-way shall permit the existence of obstructions defined by this chapter to be a nuisance. B. The following isto be a nonexclusive list of obstructions which under this chapter are deemed to obstruct the view from vehicles traveling on publiand the passage of pedestrians on the sidewalks and of vehicles on the r-of-way abutting thereon and are declared to be a public nuisance and prohibited 1.A tree with limbs overhanging theright-of-way, the lowest part of which is less than eight and one half feet above the right-of-way; 2. Landscape overhanging the street, gutter, sidewalk or obstructing any municipal utility facility or fire hydrant; 3. Any landscape which is so situated as to obscure and impair the ructed view of intersecting traffic by passing motorists or pedestrians impair the view of street, traffic, and other control devices an the streets for the safety of the public. C. The City Engineer, upon determining that one or more of the nuisances prohibited herein exist or that any other similar obstruction to the passag pedestrians at intersections exists on premises within the City, to the property owner or legal occupant having charge or control of the premises to remove the nuisance so designated therein, and it is unlawful fo occupant having charge or control of the premises to neglect or the obstruction within five business days from the date of the notice. D. If the City Engineerfinds that any right-of-way obstruction is an immediate peril or menace to the public, to any person, or to pedestrian or vehicul Manager may cause it to be summarily removed.Upon summary removal of the obstruction, the City Manager shall provide written notice tothe property owner of actions taken. A. Pursuant to the Citys prosecutorial discretion, the City may enforce violations of the provisions of this chapter as criminal, civil or administrative B. Every violation of this chapter shall be a misdemeanor; provided where the City Attorney has determined that such action would be in the best interest of justice, the City Attorney may specify in the accusatory plea violation shall be prosecuted as an infraction. Code enforcement this Code, shall have the power to issue administrative and infraction citations for violations of this chapter. C.Violations of this chapter mayalso be punishable as infractions or administrative actions in accordance with Chapters 1.10 and 1.12. D.In addition to all other remedies set forth in this Chapter, any activities operated, conducted or maintained contrary to the provisions of this chapt and a public nuisance, and the City Attorney may, in the exercis addition to or in lieu of prosecuting a criminal action hereunder, commence an action or actions, proceeding or proceedings, for the abatement, removal a in a manner provided by law. 14.08.240 Appeals. Any person whose permit application is denied or any permittee who is required to abandon facilities may appeal such decision in accordance with Chapter 1.16 of this code. Section 2. Severability. Should any provision of this Ordinance, or its application to any person or circumstance, be determined by a cot jurisdiction to be unlawful, unenforceable or otherwise void, th have no effect on any other provision of this Ordinance or the a Ordinance to any other person or circumstance and, to that end, f are severable. No person or agency, whether public or private shall construct or maintain any encroachment along or across any street, road or highway in the City or make any excavation or cut therein for such purpose without first obtaining a permit so to do in the manner herein provided. Prior to the approval of any encroachment permit which is to be issued as part of a minor residential modification, including, but not limited to mailboxes, fences, permanently installed landscaping enclosures or other permanent features, the Director of Public Works shall give a ten-day written notice of his or her intent to issue such permit to the owners of all properties within two residential units, or 500 feet of the proposed encroachment, whichever is greater. Any person wishing to object to the issuance of such permit shall do so in writing to the Director of Public Works prior to the permit's issuance. Any appeal from Public Works Director's decision regarding the permit may be made to the City Manager as prescribed in Chapter 1.16 of the city's Ordinance Code. B. Encroachment permits issued as part of any street improvement work to be accomplished in the public right-of-way when such improvements and right-of-way or are to be dedicated to the city upon completion and any other activity including but not limited to work by public utilities as part of either maintenance work or a building permit or other like activity will not require any special form of notice. Any person or agency, whether public or private, desiring to construct, lay or maintain any encroachment along or across any street, road or highway under jurisdiction of the City shall make application in writing to the City Council and shall deposit with such application the sum of fifty dollars or a sum of money sufficient in amount, in the opinion of the City Manager, to cover the total cost of the contemplated work, whichever amount is greater, or in the discretion of the City Manager a good and sufficient bond in lieu thereof; provided that the City Manager may in his discretion waive the requirement for the deposit of the sum or bond for public agencies or public utility corporations which are entitled to operate or maintain facilities in public rights-of-way either by operation of law or pursuant to a franchise granted by the City. The deposit or bond is required for the purpose of enduring the proper restoration of the highway and shall be forfeited or called, as the case may be, in the event that the work is not properly done as herein provided. Excavation: 1. Excavation of trenches adjacent to the existing pavement shall be conducted on but one side of the pavement at a time and no excavation shall be started on the opposite side until the trench first excavated has been filled, compacted and surfaced as per requirements below. 2. No more trenches shall be opened than can be properly and completely backfilled in one day. No more than seven hundred feet of trench shall be open at any time on any project unless authorized by the City Manager or his duly appointed representative. 3. One traffic lane shall be kept open and in safe condition at all times. Adequate warning and regulatory signs and other safety measures shall be taken at all times to protect the public who may or must be present in the area where work is being performed. Complete closure of all traffic lanes may be made at the discretion of and in accordance with plans and detours approved by the City Manager or his duly appointed representative. Twenty-four hours’ advance notice must be filed with the City Manager or his duly appointed representative, stating the road to be closed, the limits and approximate duration of closure. Such agencies must also be notified immediately upon reopening of the road to emergency vehicles. 4. The City Manager shall be supplied at all times with the names and telephone numbers of at least two persons in charge of or responsible for the work subject to permit who can be reached for emergency work twenty-four hours a day, seven days a week. B. Backfill: 1. Backfill in all trenches shall be made by mechanical tamping or jetting as specified by the City Manager. Compaction shall be attained by any type of mechanical tamper capable of meeting the compaction requirements. Backfill shall be compacted in lifts of a thickness designated by the City Manager and dependent upon the type of soil and mechanical tamper used. A relative compaction of ninety percent must be obtained on all backfill below two feet of finished grade. A relative compaction of ninety-five percent shall be required in the top two feet of trench within the roadway section. 2. Relative compaction shall be based on state of California Test Method No. 216. 3. No jetting will be allowed within two feet of the surface.Aggregate base material conforming to Section 26- 1.02A of the Standard Specifications, except as herein modified under “Aggregate Base: shall be placed along the entire trench section with a minimum thickness of twelve inches.” 4. The City reserves the right to make as many compaction tests as it deems necessary in order to meet compaction requirements. The costs of such tests shall be borne by the person performing the excavation in, along and across the highway. A prime coat of SC-1 liquid asphalt shall be applied to the surface of the existing trench prior to paving, the rate of application to be determined by the City Manager. 5. On completion of the backfill and prior to placing the pavement in the trench section, the pavement adjacent to the work shall be thoroughly cleaned to the satisfaction of the City Manager. A power broom shall be used if so required by the City Manager. C. Restoration of pavement: y to remove existing high type classes of pavement, such as Portland 1. See minimum requirements below. Asphalt-concrete surfacing conforming to the requirements of Section 39-2.03 of the Standard Specifications may be substituted for existing asphaltic concrete, plant mix surfacing or oil macadam pavement. The type of asphalt-concrete surfacing is to be determined by the City Manager. 2. When a satisfactory permanent repavement of an excavation cannot be made, the City Manager shall require a temporary pavement consisting of thirteen inches of compacted untreated base material and two inches of cold plant mix surfacing meeting the surface of existing pavement and sealed with asphaltic emulsion seal coat. The temporary type of pavement is to remain in place and be maintained until compaction requirements can be met. The temporary pavement shall then be removed to a minimum depth of three inches below the existing surface, and the pavement replaced with three inches of hot plant mix surfacing, the surfacing to be feathered out over the existing pavement to prevent surface water from entering the excavated trench section. The extent of the feathered section is to be determined by the City Manager. The pavement surface is then to be sealed with asphaltic emulsion seal coat. 3. Where the depth of the existing higher type classes of pavement exceeds three inches in thickness, and where the existing imported base material exceeds twelve inches in thickness, the depth shall be restored in kind, with aggregate base and asphalt-concrete surfacing. Existing Portland cement concrete pavement shall be restored in kind in all cases where Portland cement concrete pavement now exists. 4. Roads and highways consisting of existing single and double seal coat or armor coat type of pavement will require a temporary pavement restoration consisting of twelve inches (compacted) of aggregate base material and an application of single seal coat using one-half inch x No. four crushed screenings. Depending on weather conditions, two inches of cold plant mix surfacing may be substituted for a temporary single seal pavement. After a period of from sixty to ninety days, a permanent pavement of single seal coat placed over the temporary single seal coat pavement, conforming to the requirements of Section 37 of the Standard Specifications shall be supplied to the surface, the extent of such pavement overlapping the existing trench to be determined by the City Manager. Only crushed granite screenings or equivalent shall be used in all temporary and permanent pavement restoration. A double seal coat may be applied immediately if trench compaction meets the requirements of this chapter. 5. When a single operation, consisting of crossing the pavement (not confined to a continuous project parallel to and following the general alignment of the road), is proposed on roads of high classification, it will be necessary to bore pipe or jack a casing enclosing the pipe underneath the pavement. If it is proved to the satisfaction of the City Manager that it is not feasible or practical to jack or bore underneath the pavement, the pavement may be cut and restored with twelve inches of compacted untreated base material, six inches of Class “A” concrete keyed five inches outside the edge of the trench on each side and followed by three inches of asphalt-concrete surface and sealed with asphaltic emulsion seal coat. Excavations may be backfilled with sand and pavement replaced in kind when specifically authorized by the City Manager. D. Untreated base: 1. Untreated base material shall conform to the provisions of Section 26 of the Standard Specifications. 2. Miscellaneous: 1. City may, as a condition to granting an encroachment permit, require a field inspection with representatives of both the applicant and the City Manager. A description of the condition of the existing pavement and shoulders will be filed with the City Manager and the applicant. Pavement shoulders disturbed by the applicant’s operations will be restored at the applicant’s expense to the satisfaction of the City Manager. Small utility extensions and lateral connections to existing sanitary sewers may be exempted from the requirements of such prior field inspection. In such event, encroachment permits may be issued upon receipt of request therefor together with a sketch showing location or a written description of the proposed work. 2. Property owners shall be protected from any damage to property and dust nuisance. A water wagon shall be available on demand of the City Manager. 3. Written permission of the City Manager shall be required for excavations made between November lst and March lst. 4. Any noncompliance with these specifications shall be remedied within five days after written notice to do so by the City Manager. Upon failure to conform with the request of the City Manager within the five day period, the City shall be entitled to proceed to correct the deficiency, and the costs thereof shall be the obligation of the applicant. 5. Inspection costs incurred by the City in the progress of the applicant’s operations shall be reimbursed to the City by the applicant. The City shall be the sole judge as to the need of such inspection. 6. The City Manager shall be notified forty-eight hours prior to the actual beginning of any excavation in, along or across any road or highway in the City. 7. No work shall be deemed completed until final approval thereof is made in writing by the City Manager. 8. Applicant may be required to indemnify and save harmless the City, its officers and employees from any suits, claims or sections brought by any person or persons for or on account of any injuries or damages sustained or arising out of the excavations covered by this section. 9. Applicant shall maintain the condition of his excavation and pavement restoration to the satisfaction of the City Manager. (Ord. 130, Art. 1 § 3.4, 1960) 14.08.070 Depositing of Dirt, Rocks, Etc. on City Highways. A. No person shall place, deposit, or dump, or cause to be placed, deposited, or dumped, any dirt, rocks, gravel, mud, or any other objects of any nature or description on the traveled portions of any City highway. B. The City Manager may remove any such dirt, rocks, gravel, mud, or any other objects of any nature or description from the traveled portions of any City highway, and the person, or the principal or employer of the person, causing such dirt, rocks, gravel, mud or any other objects to be placed, deposited, or dumped on such City highway shall be liable to the City for any expense in connection with the removal thereof. C. No person shall drive, operate, tow, or otherwise transport any cleated vehicle on, upon, or across any City highway in a manner which permits or causes the cleats of such vehicles to come into contact with the paved portion of the highway. Atotalofeleven(11)projectswereapprovedatthePlanningCommission level.SomeofthekeyprojectsapprovedatthePlanningCommissionlevel includetheconversionofaportionoftheexistingSearsstoreatVallco ShoppingMallandassociatedsiteandarchitecturalimprovementsforthe BayClubathleticclub,latenighthoursofoperationapprovalforarestaurant attheMarketplaceShoppingCenter,andearlymorninghoursofoperation forPhilzCoffeeattheCrossroadsShoppingCenter. Undertheexistingrules,anyprojectthatisapprovedmaybeappealedtothe approvalauthorityaboveit.Additionally,projectsapprovedattheCouncil levelcanbesubjecttoreconsiderationbytheCounciliftheymeetcertain requirementsintheMunicipalCode.Inthepastfouryears,three(3)projects wereappealedfromPlanningCommissionleveltotheCityCouncil.These includetheCrossroadsShoppingCenterretailpadbuildings,theSaichWay Stationcommercialcenter,andthelatenighthoursandseparatebarfor IslandsRestaurant.Thus,thecurrentprocessallowsforprojectstoproceedin 190 astreamlinedfashion,whilecontinuingtoprovideanopportunityforappeal forcontroversialprojects. D.Parking TheCouncilexpressedconcernaboutwhetherthecurrentcitywideminimum parkingrequirementsforrestaurantsmeettheparkingdemandforrestaurants sufficiently.TheCouncilshouldprovidefeedbackonwhetheritdesiresto initiateastudyofthisissue.Aconsultantmaybehiredtodocomparisonstudies withothercitiesandtoanalyzethecurrentparkingdemandbyuse.Anysuch changeswouldrequireachangeintheZoningOrdinance.
