JobsandEconomicImprovementthroughEnvironmentalLeadershipActof2011(AB900) InJune2012,theproposedAppleCampus2Projectwascertifiedasthe¹º§º«¹first EnvironmentalLeadershipDevelopmentProject(LeadershipProject)bytheGovernorsOffice pursuanttotheJobsandEconomicImprovementThroughEnvironmentalLeadershipActof 2011(AB900).AkeyrequirementofAB900isthattheCaliforniaAirResourcesBoard(CARB) verifiesthattheprojectdoesnotresultinanynetadditionalemissionofgreenhousegases, includinggreenhousegasemissionsfromemployeetransportation.OnJune14,2012,CARB verifiedthattheprojectwillnotresultinanynetadditionalgreenhousegasespriorto certificationbytheGovernor. EnvironmentalImpactReport(EIR) TheCaliforniaEnvironmentalQualityAct(CEQA)requiresthatallStateandlocalgovernments considertheconsequencesofprojectsoverwhichtheyhavediscretionaryauthority.TheEIR createdasaresultofreviewunderCEQAmustdisclosethesignificantenvironmentalimpacts oftheprojectand,inaddition,identifythefollowing: Significantcumulativeimpactsoftheprojectincombinationwithpast,presentand reasonablyforeseeablefutureprojects. Mitigationmeasuresandalternativestoreducetheseeffects; Significantimpactsthatcannotbeavoided; Growthinducingimpacts;and Effectsfoundnottobesignificant. CEQAprovidesforoneagencytobetheLeadAgencychargedwiththeresponsibilityof preparingtheEIR.Inthiscase,becausetheCityofCupertinowillhavethegreatest responsibilityforapprovingtheprojectasawhole,theCityistheLeadAgency. AFinalEIRhasbeenpreparedinaccordancewiththerequirementsoftheCalifornia EnvironmentalQualityAct(CEQA).ThepurposeoftheEIRisnottorecommendapprovalor denialofaprojectbuttoprovideinformationtobeusedintheplanninganddecisionmaking process.CEQArequiresdecisionmakerstobalancethebenefitsofaproposedprojectagainst theenvironmentaleffects,alongwithotherfactors. Asamitigationmeasure,theapplicantshalleitherprovideenoughfundsfortheacquisition of1.1acresofpropertybytheCityforfutureparkdevelopmentoragreetopurchase(unless otherpropertycurrentlyownedbytheapplicantisproposed),designate,dedicatetothe Cityandmakepubliclyaccessible1.1acreselsewhereintheCityasParksandRecreation (PR).Thismitigationmeasurewouldreducethesignificantimpactduetotherezoningof thepropertytoalessthansignificantlevel.Therezoningoftheparkhasbeenidentifiedasa significantimpactintheLandUse,PlanningPolicyandPublicServicesandUtilities sectionsoftheEIR. b.CalabazasCreekTrail The"¯º¿¹GeneralPlanindicatesthatatrailshouldbeprovidedalongCalabazasCreek whenpropertyinthatareadevelops.Theprojectapplicanthassignificantsecurityconcerns withatrailalongCalabazasCreek,whichrunsthroughtheprojectsite,duetotheattributes oftheprojectanditsuses.Therefore,asamitigationmeasure,theapplicantwouldbuildan alternatecreektrailsharingthepublicsidewalkbetweentheintersectionofPruneridge AvenueandNorthTantauAvenueandCalabazasCreekatVallcoParkway.Thetrailwill includeappropriatelandscaping,signage,pavementtreatmentthatreferencesthecreek and/orwateranddecorativefencingattheTantauAvenueovercrossingatI280. Themitigationmeasurealsoincludesthepaymentof$250,000tostudythefeasibilityofa trailalonganexistingdrainagechannelthatrunsparalleltosouthboundI280betweenN. DeAnzaBoulevardandCalabazasCreekandthensouthalongthewesternbankofthe CalabazasCreektoVallcoParkway.However,evenwiththesemitigations,theproposed projectdoesnotfullyimplementtheprovisionsoftheEnvironmental Resources/SustainabilityElementoftheGeneralPlanrelatedtotheprovisionoftrailsand theprovisionofbikeandpedestrianaccess,resultinginasignificantandunavoidable impact. 2.BiologicalResources Theapplicantisproposingtheremovalofamaximumof3,620treesandrelocationofatleast90 treeswiththeproposedproject.Thetreesremovedwillbereplacedwithatleast6,200Protected Treesinaccordancewiththe"¯º¿¹ProtectedTreeOrdinance(foranetincreaseof2,494trees). Treesplantedonsitewillbeconsidered ¶¸µº«©º«ª!perthe"¯º¿¹definitionofProtectedTrees. TreesrelocatedincludeaMemorialtreededicatedtoaformerHPemployee,a33inchdiameter Oaktreeandseverallargeredwoodtrees(19inchesK25inchesindiameter)thatareplantedin agrovearoundthecurrentGlendenningBarnlocation.Theconsultingarboristhasconfirmed thatthetreereplacementplanproposedbytheapplicantisconsistentwiththe"¯º¿¹Protected TreeOrdinancerequirements. 3.CulturalResources TheGeneralPlanidentifiestheGlendenningBarn,whichislocatedontheprojectsite,asa historicresourceintheCity.Theprojectproposestorelocatethebarneitheronoroffsite.The 13 StudySessionforApple2CampusEIROctober1,2013 Page10 DraftEIRconcludesthatwithimplementationofmitigationmeasuresidentifiedthiswouldbea lessthansignificantimpact. Mitigationmeasuresrelatedtothepossibilityofaffectingarchaeologicalresourcesaretypical fornewdevelopment,requiringtheretentionofaqualifiedarchaeologisttomonitorthe groundbreakingactivitiesandthepreparationofamonitoringplanfortheproject.The mitigationmeasureprovidesdirectionwithregardtoreportingthediscoveryofarchaeological resourcesonthesite,includingwhenthearchaeologicalmonitorisnotpresentatthesite. Mitigationmeasureshavealsobeenidentifiedrelatedtothepossibilityofaffecting paleontologicalresourcesorNativeAmericanremains. 4.Transportation AsrequiredbyCEQA,theimpactsoftheprojectontrafficarecomparedtotheimpactsof «¾¯¹º¯´­©µ´ª¯º¯µ´¹!attheprojectsiteontraffic.These «¾¯¹º¯´­©µ´ª¯º¯µ´¹!arethephysical environmentalconditionsinthevicinityoftheprojectasofthedateofpublicationoftheEIR NoticeofPreparation.AtthetimetheNoticeofPublicationwaspublished,theoccupancyofthe sitewaslessthanfulloccupancyoftheprojectsitebuildingsbecausemanyHPandApple employeeshadalreadybeenrelocatedawayfromthesite.Thus,theseverityofimpacts identifiedintheEIRismagnifiedcomparedtoananalysisthatevaluatestheprojectagainstfull occupancyofexistingbuildings.Theanalysisusesthefollowingdataregardingnetemployee impacts,tripdistributionandtripgenerationforAppleCampus2: Whiletheemployeecapacityoftheexistingbuildingsis9,800,theEIRusesanemployee countof4,844(thenumberofemployeesworkingattheprojectsiteatthetimeofissuance oftheNoticeofPreparation)asthebaselinefortheimpactanalysis.Theanalysisismore conservativethanValleyTransportationAuthority(VTA)guidelines,whichallowfor «¾¯¹º¯´­©µ´ª¯º¯µ´¹!toincludemaximumoccupancyoftheexistingbuildingsona projectsite.However,thisfulloccupancywasaddressedaspartofthe !§©±­¸µ»´ª! scenariointheEIR. Tripdistributionfortheprojecthasbeenbasedonthecurrentemployeedistribution providedbytheapplicant.Whenthisinformationisavailable,itprovidesforamuch higherlevelofaccuracywithregardstoexpectedtravelpatternstoandfromthesite. ApplecurrentlyhasaTransportationDemandManagement(TDM)programparticipation levelof28%nonsingleoccupancyvehicles,meaningthat28%oftheirexistingemployees usealternativemodesoftransportationsuchasbuses,bikes,carpools,walkingandpublic transportation.AppleisproposingtoincreasetheirTDMprogramtoa34%participation levelfortheproposedproject.The34%TDMlevelwillbeaconditionofapprovalforthe projectandwillreducetheseverityofidentifiedtrafficimpacts. Tripgenerationhasbeenbasedontheactualtripgenerationdatacollectedat ¶¶²«¹ InfiniteLoopcampusandadditionalbuildingsleased/controlledbyApplelocatedsouth ofMarianiAvenue. 14 StudySessionforApple2CampusEIROctober1,2013 Page11 Thetrafficstudyanalyzestheprojectunderthreescenarios: TheExistingplusprojectscenarioanalyzestheimpactsoftheprojecttrafficcombined withexistingtrafficvolumesatthestudyintersections; TheBackgroundplusprojectscenarioanalyzestheimpactsoftheprojecttrafficcombined withexistingtrafficvolumesplusprojectedtrafficvolumesfromprojectsapprovedbut notbuiltandprojectsforwhichapplicationsareunderreview; TheCumulativeplusprojectscenariostudiestheimpactsoftheprojecttrafficcombined withexistingtrafficvolumes,plusbackgroundtrafficvolumes,plustrafficvolumesfrom reasonablyforeseeablefuturedevelopmentprojects.ForthisEIR,thecumulativescenario studiedistheyear2020,sincetheCityof"»¶«¸º¯´µ¹GeneralPlancurrentlycoversthis timeframeandtheapplicanthasindicatedthatallphasesoftheprojectareexpectedtobe completedbeforetheyear2020. a.IntersectionImpacts: Therearetenintersectionswhereimpactshavebeenidentifiedtobesignificant.Sixofthese arewithinCupertino: DeAnzaBoulevardandHomesteadRoadKBackgroundplusProject StevensCreekBoulevardandDeAnzaBoulevardKCumulativeplusProject StevensCreekBoulevardandTantauAvenueKBackgroundplusProject WolfeRoadandVallcoParkwayCumulativeplusProject VallcoParkwayandN.TantauAvenueExistingplusProject HomesteadRoadandN.TantauAvenueBackgroundplusProject Mitigationmeasureshavebeenidentifiedatfiveofsixintersectionswithinthe"¯º¿¹ jurisdiction,whichwouldmitigatetheimpactstoalessthansignificantlevel.Thesixth intersectionatDeAnzaBoulevardandStevensCreekBoulevardwillcontinuetohave significantunavoidableimpactsattheCumulativeplusProjectscenario.Thisisbecausethe identifiedmitigationmeasureoffundingafairsharetowardtheinstallationofadvanced trafficsignalequipmentalongtheDeAnzaBoulevardcorridorwillhelplessentheseverity oftheimpact.However,itwillnotreducetheimpactatthisintersectiontoalessthan significantlevel.Theprovisionofanexclusivesouthboundrightturnlanefromsouthbound DeAnzaBoulevardtowestboundStevensCreekBoulevard,whichwouldreducethe impact,wouldnotbefeasibleduetophysicalconstraintsofanexistingbuildingatthe intersection. Fouroftheintersectionswithsignificantimpactsareoutsidethe"¯º¿¹jurisdiction: WolfeRoad@I280Northboundramps(Caltrans)KExistingplusProject StevensCreek@CalvertDrive&I280ramps(west)(CityofSantaClara)Existing plusProject 15 StudySessionforApple2CampusEIROctober1,2013 Page12 StevensCreekBoulevard@LawrenceExpresswayRamps(east)(CountyofSanta Clara)BackgroundplusProject LawrenceExpressway@I280Southboundramps(CountyofSantaClara/Caltrans) BackgroundplusProject Mitigationmeasureshavealsobeenidentifiedforthefourintersectionsoutsidethe"¯º¿¹ jurisdiction.However,implementationoftheidentifiedmitigationmeasurescannotbe guaranteedattheseintersections.Theagenciesresponsibleforapprovingimprovementsat theseintersectionshavetheultimatediscretiontoapprovetheimprovementswhichwould mitigatetheimpacttoalessthansignificantlevelattheseintersections. b.FreewaySegmentImpacts: TheEIRalsonotesasignificantimpactat29mixedflowfreewaysegmentsand3High OccupancyVehicle(HOV)freewaysegments.Theidentifiedmitigationmeasurerequires theprojectapplicanttopay$1,292,215asafairsharecontributiontowardplanned transportationprojectsthatwouldimprovetrafficoperationsoftheimpactedfreeway segmentsandprovideaddedtransportationcapacityonparallelfacilities:(1)SR85Express Laneproject(convertingtheexistingHOVlanetoatolllanetoallowsingleoccupant vehiclestodriveintheHOVlaneforafee)betweenMountainViewandSanJose,(2) eliminatingtheexistingbottleneckonsouthboundI280betweenElMonteAvenueand MagdelenaAvenue;and(3)eithertheBusRapidTransit(BRT)stationsproposedwithin Cupertino,oranalternativeimprovementorstudytowardstheimprovementofthe impactedI280corridororaparallelcorridorthatwouldprovidecapacity. c.CorridorOperations: 6µ²¬«1µ§ª TheEIRalsoidentifiesanimpactduetotheproposedprojectdesignattheprojectaccess drivewayonWolfeRoad.Theprojectproposesthreeleftturnsturningontosouthbound WolfeRoad.ThetrafficconsultantpreparedatrafficprogressionmodelfortheWolfeRoad corridorbetweenHomesteadRoadandVallcoParkway.Thethreeleftturnswouldcreate potentialsafetyimpactsduetoweavingthatisanticipatedasvehiclesturningleftfromthe projectdrivewayontosouthboundWolfeRoadattempttomergewithinashortdistanceto accesstheI280freewayramps.TheFinalEIRincludesthefollowingmitigations: Therecommendedmitigationwouldrequiretheprojectsponsortoredesignthe drivewaytoincludeonlytwoleftturnlanes. Thealternatemitigationwouldallowfortheconstructionofthreeleftturnlanes,but wouldrequiretheimplementationofaprogramtomonitortheoperationofthelanes upto9monthsafterfulloccupancyoftheproject,withpenaltiesfortheoccurrenceof unsafeweaving.If,aftermonitoring,theCitydeterminesthatthethreeleftturnlanes poselongtermsafetyproblems,theprojectsponsorwouldberequiredtoreducethe numberofleftturnlanesfromthreetotwo. 16 StudySessionforApple2CampusEIROctober1,2013 Page13 ThemodelindicatedthattherewouldbedelaystononAppletraffictravelinginthe southbounddirectionduringthePMpeakhourduetothelargevolumeofApplevehicles thatwouldexitthecampusduringthistime.However,thesedelaysarenotidentifiedas impactsunderCEQAsincetherearecurrentlynothresholdsofsignificanceforoperational delay,asthereareforintersectionLevelofService(LOS). 5§²²©µ/§¸±½§¿ ThetrafficconsultantalsopreparedatrafficprogressionmodelforVallcoParkwaybetween WolfeRoadandTantauAvenue.Themodelshowedthatthecurrentlyapproved improvementsonVallcoParkwayresultinexcessivedelaysintheeastbounddirection. ThisisnotaCEQAimpactbutisanoperationalissueduetoincreasedprojecttraffic.Asa result,thetrafficconsultantrecommendsareconfigurationofVallcoParkway,between PerimeterRoadandN.TantauAvenuetoprovidetwoeastboundtravellanes,two westboundtravellanes,bikelanesineachdirection,andanadditionaltrafficlightatthe MainStreetparkinggarageentrance.Thisconfigurationwouldpreservethestreetparking improvementsapprovedforadjacentprojectsalongVallcoParkway. d.ImpactstoPedestrians: Inadditiontotrafficimpacts,theEIRalsoidentifiessignificantandunavoidableimpactsto pedestrians.Duetotheneedtoprovidetworightturnlanesintotheprojectsite,a significantimpacthasbeenidentifiedforpedestriansevenwiththeimplementationofa feasiblemitigationmeasure.Additionally,asignificantandunavoidableimpactisidentified atthesixoff/onrampsforI280onN.WolfeRoadduetotheincreasedtrafficvolumes.The closureofPruneridgeAvenue(discussedlater)wouldalsoresultinsignificantimpactsto pedestrianfacilities.However,theprojectwillbeimprovingpedestrianconditionsatmany locations,includingtheprovisionofdetachedsidewalksinvariouslocations,aswellasthe removalof ¶µ¸±©®µ¶!islandsattheHomesteadRoad/TantauAvenueandStevensCreek Boulevard/TantauAvenueintersections.A ¶µ¸±©®µ¶!islandallowsfreerightturnsby vehicleswithoutstoppingatthetrafficlightandmakesitdifficultforpedestrianstocross. Removingthe ¶µ¸±©®µ¶!islandswillrequirecarstostopatthetrafficlightbeforeturning rightandmakeitsaferforpedestrians. e.CutThroughTraffic ThepotentialcutthroughroutesfortheneighborhoodtothenorthofHomesteadRoadin SunnyvaleandtotheeastofTantauAvenueinSantaClaradonotrepresentroutesthatare superiortoroutesonthemainarterialsandcollectors.Therefore,thepotentialforcut throughtrafficwouldnotrisetothelevelofasignificantimpact. Whilenotrequiredasmitigationfortheproject,theaconditionofapprovalwillrequirethe applicanttofundaneighborhoodcutthroughtrafficstudyandprovidefundstoimplement trafficcalmingimprovementsandneighborhoodpermitparkingprogramsintheamountof $250,000totheCityofSantaClaraand$500,000totheCityofSunnyvale. 17 StudySessionforApple2CampusEIROctober1,2013 Page14 f.Parking WhileparkingavailabilityisnotconsideredtoanenvironmentalimpactunderCEQA,the secondaryenvironmentalimpactsfromthelackofparkingorexcessparkingareconsidered environmentalimpacts.Therefore,theEIRdiscussesparkingforinformationalpurposes andtoevaluatesecondaryenvironmentalimpacts. Appleproposestoprovide10,980parkingspacesonitscampustomeettheparking demandforitsuse.Anticipatedparkingdemandwasdeterminedbyconductingaparking studyof ¶¶²«¹currentcampusatInfiniteLoopandpropertiesatMarianiAvenue.The parkingratioassumesaTDMrateof34%asproposedbytheproject.Ofthesespaces,9,240 spaceswillbeprovidedwiththedevelopmentofPhase1intwostructuredparking facilities,thebasementofthemainbuildingandtwosurfaceparkinglots.Thebalance,1,740 parkingspacestoservethe600,000squarefeetofdevelopmentlocatedontheproperties eastandwestofN.TantauAvenue,willbeprovidedinPhase2oftheproject. TheParkingordinancerequirestheprovisionofbicycleparkingat5%ofthenumberof requiredvehicularparking.Applewouldberequiredtoprovide600spacesforbothphases. Appleplanstolocatebicycleparkingspacesinconvenientareasaroundtheentirecampus. Atotalofatleast2,000bicycleparkingspaceswillbeprovidedaspartoftheproject. Aparkingmanagementplanisrequiredtoallowthepropermanagementofparkingduring specialeventsattheAuditorium. -«¯­®¨µ¸®µµª/§¸±¯´­ TheEIRdiscussestheissueofneighborhoodparkingandevaluatessecondary environmentalimpactstoneighborhoodssurroundingtheprojectsite.TheEIRconcludes thatadequateparkingisbeingprovidedfortheprojectbasedonactualparkingdata collectedforthesameuseat ¶¶²«¹InfiniteLoopandMarianiAvenuecampus.Therefore, nosignificantenvironmentalimpactsareexpectedandthereisnosignificantindicationthat neighborhoodparkingwillbeanenvironmentalimpactissue.Whilenotrequiredas mitigationfortheproject,thefundsprovidedbytheapplicantintheamountof$250,000to theCityofSantaClaraand$500,000totheCityofSunnyvale(discussedaboveinthecut throughtrafficsection)canbeusedtopayforpermitparkingprograms,ifdeemed necessarybytherespectivecities.Inaddition,aconditionoftheprojectrequiresthe applicanttoidentifyandconstructadditionalonsiteparking,subjecttofurther environmentalreview,ifparkingmonitoringstudiessubsequentlyidentifyapersistent shortageofprojectparking. g.PruneridgeAvenueVacationandClosure TheprojectapplicantisproposingthevacationandclosureofasegmentofPruneridge Avenue,betweenN.TantauAvenueandN.WolfeRoad.Whiletheapplicantisproposing tomakeupgradestotheexistingpedestrianandbicycleinfrastructurearoundtheproject siteandalongVallcoParkway,noequivalenteastwestconnectorisbeingprovided.The 18 StudySessionforApple2CampusEIROctober1,2013 Page15 removalofthissegmentofPruneridgewouldrestricteastwestpedestrianandbicycle accessbetweenN.TantauAvenueandN.WolfeRoad.Theproposedprojectwouldnot fullyimplementprovisionsrelatedtocirculationintheGeneralPlanduetotheproposed closureofPruneridgeAvenue.Therefore,theDraftEIRconcludesthattheclosureof PruneridgeAvenueisasignificantandunavoidableimpactoftheproject. AsignificantimpactisalsoidentifiedduetothereroutingofbusRoute81,becauseofthe closureofthissegmentofPruneridgeAvenue.Thebuslinehasbeenproposedtobe reroutedtotravelalongVallcoParkwayinsteadofalongPruneridgeAvenue.Thereareno feasiblemitigationmeasurestorestorethistransitaccess;therefore,theimpactissignificant andunavoidable. 5.Noise TheEIRevaluatesnoiseimpactsandidentifiesanddiscussesmitigationmeasurestoensurethat noiselevelsremainbelowthethresholdsidentifiedinthe"¯º¿¹CommunityNoiseControl Ordinance(Chapter10.48oftheMunicipalCode)andtheGeneralPlan.Constructionnoisewill bemitigatedbytheimplementationofarobustconstructionmanagementplanandthe installationofa15foottemporarysoundwallaroundtheperimeterofthesite.Thesoundwall willbesetbackasmuchasfeasibletoallowlineofsightseparationbetweentheadjacent propertyandtheprojectsite. Theprojectwouldmakeasignificantcontributiontocumulativenoiselevelsalongtwo roadwaysegmentsaroundtheprojectsite,basedonthresholdsidentifiedinthe"¯º¿¹General Plan.Theseroadwaysegmentswouldexperienceincreasesof1.0dBAorgreaterintrafficnoise levelsundercumulativeplusprojectconditionsandwouldexceedthemorestringentstandard usedintheEIR.Thiswillbemitigatedtoalessthansignificantlevelbyresurfacingtheseroad segmentswithRubberizedHotMixAsphalt,orsimilarquietpavement.Withthe implementationofthismeasurethe¶¸µ°«©º¹contributiontothecumulativeimpactwouldbe reducedtoalessthansignificantlevel. 6.AirQuality TheEIRidentifiesmitigationmeasurestomitigatethesignificantairqualityimpactsduringthe constructionoftheproject,includingensuringthatallexposedsurfacesarewateredtwicea day,limitingthevehiclespeedsonsiteto15milesperhour,eithershuttingallequipmentnotin useorlimitingidlingtimeonsiteto2minutes,suspendingallexcavation,gradingand/or demolitionactivitywhenthewindspeedsexceed20milesperhourandensuringthatalltrucks andequipmentarewashedpriortoleavingthesite.However,evenwiththesemitigation measures,theimpacttoAirQualityduringconstructionwillremainsignificantand unavoidable. Theimpacttoairqualityduringoperationoftheprojecthasalsobeenidentifiedasasignificant impact.Whileamitigationmeasurehasbeenidentifiedtoincreasethenonsingleoccupant 19 StudySessionforApple2CampusEIROctober1,2013 Page16 vehiclemodesharefrom28%to34%(withanassociatedreductioninvehicleemissions),the impactwillremainsignificantandunavoidable. 7.GreenhouseGasEmissions(GHG)andSustainability Greenhousegasemissionsareattributedtoglobalclimatechangeandincreasesintheaverage temperatureofthe$§¸º®¹atmosphereandoceansintherecentdecades.Thisisprimarily attributedtoincreasedamountsofcarbondioxideandotherGHGsasaresultofhuman activities.GHGsarereleasedbytheburningoffossilsfuels,landclearing,agricultureandother activitiesleadingtoanincreaseinthegreenhouseeffect.GHGemissionsaretypicallymeasured «·»¯¼§²«´º¹!orCOe. intermsofpoundsortonsof ". 22 eduringthefouryear Theprojectisanticipatedtoproduce47,883metrictonsofCO 2 constructiontimeperiod.TheBayAreaAirQualityManagementDistrict(BAAQMD),the regionalagencythatregulatessourcesofairpollutionwithinthenineBayAreacounties,does nothaveanadoptedquantitativethresholdforconstructionGHGemissionbutrecommends theincorporationofconstructionpracticesthatwouldreduceemissions.Theconstruction managementplan,whichispartoftheprojectandwouldbeenforcedthroughthe"¯º¿¹ conditionsofapproval,wouldensurethatspecificconstructionmeasuresareimplementedto reduceconstructionrelatedGHGemissionstoalessthansignificantlevel.Itisalsoanticipated thattheproposedprojectwillproduce8,745metrictonsofCOeperyearnetnewemissions 2 abovetheAugust2011baseline.Theprimarysourcesofemissionsassociatedwiththeproject arevehicles.Thisamountstoabout2.7metrictonsofCOeperemployeeperyear,whichiswell 2 belowtheBAAQMDthresholdof4.6metrictonsofCOeperemployeeperyear.Therefore, 2 theseemissionswouldnotbeconsideredsignificant. TheReducedDensityalternativeKdevelopasmallercampusonthesiteconsistingof approximately2.2millionsquarefeetofoffice,research,anddevelopmentspaceto accommodate8,000employees,foratotalheadcountlowerthantheNoProject alternative.Ancillaryandutilitydevelopmentsquarefootagewouldremainthesame. PruneridgeAvenuewithinthesitewouldbevacated. TheEIRidentifiestheReducedDensityalternativeasbeingenvironmentallysuperiortothe PruneridgeAvenueandReducedConstructionalternativesbecauseitwouldavoidorreduce significanttraffic,noise,andairqualityimpactsduetolowerlevelsofconstructionand employmentonsitecomparedtotheproject.Thereductioninoperationaltrafficimpactsis particularlyimportant,becauseincreasedtrafficaffectsmostmembersofthecommunityand wasoneofthekeyconcernsidentifiedbythecommunityduringtheEIRscopingsession. ResponsetoCommentsandTextRevisions Over300commentswerereceivedduringthe46daypublicreviewperiodoftheDraftEIR. Overhalfofthecommentswereinsupportoftheprojectandnotregardingtheadequacyofthe EIR.Manyoftheremainingcommentswereinsupportoftheproject.Somehadconcernsabout theimpactsfromtheincreasedtrafficaroundtheprojectsite. AllcommentsreceivedduringthepublicreviewperiodandthatpertaintotheEIRhavebeen addressedintheResponsestoCommentsDocument.TextrevisionstoclarifytextintheDraft 21 StudySessionforApple2CampusEIROctober1,2013 Page18 EIRandupdatestoreflectadditionalanalysisordiscussionhavealsobeenmade.The ResponsestoCommentsdocumenttogetherwiththeDraftEIRandTextRevisionstotheDraft EIRareconsideredtobetheFinalEIR.Becausenoneworsubstantiallymoreseveresignificant impacts,andnonewmitigationmeasuresoralternativesthatwouldclearlylessenthe significantimpactsoftheprojectthattheprojectsponsordeclinestoadopt,wereidentifiedafter circulationoftheDraftEIR,recirculationoftheEIRisnotrequired. CommentswerealsocollectedafterthecloseoftheEIRpublicreviewperiod.AsofSeptember 19,2013,32commentswerereceived.Ofthe32commentsreceivedafterthecloseofthe commentperiod,abouthalfsupportedtheproject.Noneofthecommentsreceivedraisedissues thatwouldrequiretheidentificationofnewimpacts,mitigationmeasures,orproject alternatives,orchangethefindingsoftheDraftEIR.WhileCEQAdoesnotrequirethattheCity respondtothecommentsreceivedafterthecloseofthepublicreviewperiod,staffwillprovide thesecommentswiththeagendapacketsforthepublichearingsfortheprojectatPlanning CommissionandCityCouncil.
