Planning Commission Recommendation
• On August 27,2013,the Planning Commission reviewed
the subdivision and rezoning application
• Unanimously recommended approval:
• Proposed lot sizes/patterns and zoning designations
are consistent with the General Plan and surrounding
residential pattern, "Low Density Residential (1-5
dwellings per gross acre)".
• Rezoning from R1-10(minimum lot size of 10,000 sq ft)
to R1-7.5(minimum lot size of 7,500 sq ft), consistent
with predominate zoning classification of the
neighborhood

Environmental Review
■ The ERC reviewed the Initial Study and recommended approval
of the Mitigated Negative Declaration
Key issues of interest:
• Trees—Only one protected tree exists on-site per City's Protected
Tree Ordinance(Tree#38,36"Coast Live Oak tree). Although
impacted with elevated levels of pesticides,plan for remediation is
in place to save the tree per County of Santa Clara,Department of
Environmental Health.
• Soil Remediation—Elevated levels of lead,arsenic,and pesticides
were found in site samples,most likely attributed to prior
agricultural and gardening use. Project is required to remediate the
site by removing and disposing of::mpacted soil as prescribed by
County of Santa Clara,Department:of Environmental Health.
Public Comments
At the Planning Commission hearing,a few residents expressed
concerns regarding the following pertaining to the future homes:
• Impacts to existing solar panels
• Privacy trees (species/structural impacts)
• Undergrounding of utility lines on adjacent properties

Recommendation
Staff recommends that the City Council approve Mitigated
Negative Declaration EA-2012-04, Rezoning application Z-
2012-01, and Tentative Map TM-2012-03 in accordance with
the draft resolution and draft ordinance.
