Proposed Negative Declaration

Project Description
SCH:
The California Department of Transportation (Department), in cooperation with the Santa Clara Valley
Transportation Authority (VTA), proposes to convert-the existing High- Occupancy Vehicle (HOV)
lanes on State Route (SR) 85 to express lanes. Use of the HOV lanes is currently restricted to vehicles
with two or more occupants, motorcycles, and certain alternative fuel vehicles. The conversion of the
HOV lanes to express lanes would allow single- occupant vehicles (SQVs) to pay a toll to use the lanes,
while HOVs would continue to use the Lanes for free. The exprem,lanes would extend along the entire
24.1 -mile length of SR 85 and 1.5 miles of United States Flighvva' .101 (US 101) from the southern end
of SR 85 to Metcalf Road in San Jose.
The project would also convert the SR 85/US 101 HOV'diirect connectors in San Jose to express lane
connectors, add signs to 4.1 miles of US 101 north of SR 85 in Mountain View and Palo Alto and to 1.8
miles of US 101 between Metcalf Road and Bailey.Avenue in San Jose, and add an.auxiliary lane to a
1.1 -mile segment of northbound SR 85 between South: De Anza Boulevard and Stevens Creek_
Boulevard in Cupertino. The total project length is 33.7 miles..
Determination
This proposed Negative Declaration (ND) is included.to give notice to interested agencies and the
public that it is the Department's intent to adopt an ND for this project.-This does trot mean that the
Department's decision regarding the project is final. This ND is subject t6 change based on comments
received by interested agencies atxdA public.
The Department has prepared an Initial' Stud y (IS) for this project, and pending public review, expects to
determine from this study thalthe proposed project would riot have a significant effect on the
environment. for the following reasons::.. .
The proposed project would have no effect on agricultural and forest resources, land use and planning,
mineral resources, public services, and recreation. In addition, the proposed project would have less than
significant effects on aesthetics,'air quality biological resources, cultural resources, geology and soils,
paleontology, greenhouse gas emissions, hazards and hazardous materials, hydrology said water quality,
noise, population and housing, transportation/traffic, and utilities and service systems.

The Department is the National Environmental Pollicy Act (NEPA) lead agency per assignment
of responsibilities by the Federal Highway Administration (FHWA) pursuant to Title 23,
United States Code (USC), Section 327. The Department is also the California Environmental
Quality Act (CEQA) lead agency for the project_ The project is proposed in cooperation with
VTA, which is responsible for providing regional limding.
The purpose of the project is to manage traffic in the congested HOV segments of the freeway
between SR 87 and 1 -280, and maintain consistency with provisions defined in Assembly Bill
2032 (2004) and Assembly Bill 574 (2007) to implement express lanes:in an HOV lane system
in Santa Clara County.
This Initial Study /Environmental Assessment (IS/EA) addresses the proposed project's
potential to have adverse impacts on the environment. Potential impacts and avoidance,
minimization, and mitigation measures are summarized in Table S -1.

SR 85 and US 110 1 Express Lanes
This.study follows and updates the Santa
Clara County HOT Lane Feasibility Study that
was completed ip 20o5. The study involves
the preliminary engineering, conceptual
alternatives and public outreach work to
develop express lanes on SR 85 and the US
1o1 corridor. The study analysis.will recom-
mend an implementation plan for the Silicon
Valley Express Lanes program with a recom-
mendation to cOr12Y aXiS ' r ool lanes
