Exhibit CC 05-20-2014 Item #13 Reorts, Emails, PowerPoints, Plan sets a , plc Foothill Live-Work,Desk Item for Agenda Item#13 5/20/2014 City Council Hearing Statement from the applicant regarding additional privacy modifications to the design: Home 6 along the West has been an issue with the adjacent neighbor due to perceived privacy concerns . In order to alleviate any concerns we have implemented taller windows along the 2nd floor of the west facade. We have altered our ol:jiginal design and now propose to locate the sill heights high above the finished floor to preserve views up towards the sky while eliminating direct views down towards our adjacent neighbors. Most of the windows show a sill height of 4 feet 10 inches from the 2nd floor, higher above the finished floor elevation compared to a more typical 3 feet 6 inch sill height. We are proposing that all the bathroom windows and 1 Egress window will be glazed with obscure glass also eliminating any direct views towards our adjacent neighbors (See diagrams on Sheets DSK 10-12). There are a total of six windows on that facade. 5 of which will be tall windows and 1 that will be an Egress window. The windows with clear glass will be located high enough that it would be impossible for someone to look down towards any neighbors. The one lower window is an Egress window and therefore cannot have a higher sill height like the other 5, however, it will not have clear glass eliminating any privacy concerns. Lastly, we are also proposing to shift the rear Deck of Home 6 from its South facade to the East facade (See diagrams can Sheets DSK 13-14). This will eliminate any concerns with the neighbors that the deck is too close and will impact privacy. I have met with Mr. Nazhand on several occasion over the last many months we have been processing for our development application. Mr. Nazhand was in complete support of the project until recently. Recently he became concerned about the visual impact of our project. We then came up with a very environmentally sound solution which is we will be planting year round evergreen hedge like foliage (Foliage) on our side of the party wall fencing that is on the City of Cupertino drought resistant Fist of approved plants. The initial planting of the Foliage will be higher than any of our roof Iine,r, which will screen Mr. Nazhand view of any of our homes. Mr. Nazhand doesn't like the Foliage because he said 'it would block his sunlight. We the had a sunlight study done and it proved that there would be very little loss of sunlight on any given day. As you can see from the message bellow from my architect in red I received today, the legal height limit for a home in this zone is 30 feet from grade. Our original design due to our lowering the grade was 22 feet measured from the existing grade along Silver Oak Way. Mr. Nazhand voiced his concerns to the planning commission about the height of lot #6 and we agreed to lower Lot#6 even further (again please see my architects message below in red). Additionally, we have we have gone even further in our attempt to appease Mr. Nazhand and designed obscure glass on the windows facing Mr. Nazhand property and we have relocated the deck. So as you can see we feel we have gone to great lengths to attempt to address Mr. Nazhand concerns. Hopefully, the City Council members will understand that we have taken every one of Mr. Nazhand concerns seriously and have come up with solutions to his every concern. Not only will the Foliage screen Mr. Nazhand view form our proposed new homes it will also have some quitting acoustical benefits form the traffic on Foothill. In order e to have a more appropriate scale, it was decided to sink Home "6" under grade so that the home would be similar in height to the adjacent buildings. Our original design for Home "6" was well under the height limit with a 22 foot building height measured from the existing grade along Silver Oak Way. At the Planning Commission hearing the project was approved with the condition that we lower Home "6" by 5 feet. We took the project back to the drawing board and eliminated the sloping roofs and sunk the building some more to achieve the recommended 5 feet. As it currently stands, Home "6's" building height is 16 feet 7 inches from the existing grade. The current building height is well under the maximum 30 feet height limit by almost half. Aside from the height changes to Home "6", we are also making sure that all the appropriate windows along the neighboring facades are obscure to allow for more privacy. Home 6's deck that was previously on the South facade has been relocated to the East facade, out of sight from any neighbors on the adjacent properties. I know you must be very busy but I would highly appreciate, invite and encourage you to visit my house so I can demonstrate the negative impact unit#6 will have for my unit and my parents beside my other two neighbors(Jeff is included on the CC list). It will affect our daily lives and reduce my property value not mentioning giving up privacy, overall light exposure and direct sunlight in my house. Unfortunately, it is not visible by looking at the drawings provided in the link especially since they are not accurate and I found some mistakes and possible misrepresentations or misprints.The best way for you to really understand and feel the degree of this negative impact for us is actually to see it in person. I am sure if you put yourself in my condition after experiencing the negative impact,you would be against unit#b including not giving them the right to have access of looking directly inside my backyard, bedroom and living room.
