municipal corporation, "CITY".
COUNTY, for and in consideration of the sum of FIFTY ONE THOUSAND AND 00/100 DOLLARS,
$51,000.00. grants to CITY, its successors and assigns. a right of way and easement to install. inspect.
maintain, repair and replace a twenty-four (24) inch storm sewer pipeline and appurtenances thereto. to
be used for transporting storm water through said pipeline to Permanente Creek. Such right of way and
easement shall be ten (10) feet in width on and through that certain land belonging to COUNTY. located
in the County of Santa Clara, State of California as described in the legal description attached hereto as
Exhibit "A",
Coextensive with this right is the further right in CITY, its successors and assigns. of reasonable ingress
and egress over and on land belonging to COUNTY to effect the purposes of the easement. This right is
conditioned on the reasonable exercise thereof for the benefit of the CITY. and in the event of excessive
use, use for non-CITY purposes, or use by means otherwise injurious to the COUNTY, COUNTY shall
have the right to extinguish the easement.
*Soecial Conditions*
CITY shall reseed at a rate of 25 Ibs, per acre, with native grasses. any stripped or exposed area left
upon completion of project; shall replace any understory shrubs removed or damaged due to
construction with 5 gallon native plant material at a rate of 1:1 and shall replace any non-dead trees
smaller than 12-inches in diameter, as measured at 4.5 feet above the surface of the ground, removed or
damaged due to construction with 15 gallon native trees at a rate of 3:1. COUNTY hereby assumes
responsibility for ongoing landscape maintenance. CITY shall exercise extreme diligence while working
in the vicinity of the Park and is hereby strictly prohibited from removing any living tree greater than 12-
inches in diameter.
CITY shall use precautionary measures to inhibit subsidence. however, in the event subsidence occurs
