As to a portion of the following desa-ibed real property, hereby convey to the CITY OF
CUPERTI NO, a Municipal Corporation of the County of Santa Clara, State of
California, being described as follows:
A portion of the 10.56 acre tract of land conveyed by Thomas Kervin, et ux, to Karl A.
Freicrich by Deed dated January 25, 1909 and recorded January 27, 1909 in Book
337 of Deeds, Page 460, Santa Clara County Records, being also a part of the
Northwest quarter of Section 24, Township 7 South, Range 2 West, Mount Diablo Base
and Meridian and being more particularly described as follows:
BEGINNING at an iron pipe in the center line of McClellan Road at the Northeast
corner of said 10.56 acre parcel of land above referred to;
THENCE from said point of beginning, South 89.57' West, along the center line of said
road 100 feet;
THENCE South 30.00 feet to a point on a line which is parallel to said center line of
McClellan Road and distant 30.00 feet therefrom, measured at right angles;

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTING GRANT OF EASEMENT FOR ROADWAY PURPOSES
FROM CHING SUNG KUO AND KUEI LEE, HUSBAND AND WIFE,
CONSISTING OF APPROXIMA TEL Y 0.0689 ACRES, LOCATED AT
20800 MCCLELLAN ROAD, APN 359-20-034
WHEREAS, Ching Sung Kuo and Kuei Lee have executed a Grant of Easement
for Roadway Purposes which is in good and sufficient form granting to the City of
Cupertino, County of Santa Clara, State of California, easement over certain real property
for roadway purposes, situate in the City of Cupertino, more particularly described in
Exhibit "A" and Exhibit "B", attached hereto and made a part hereof, which is as follows:
All that certain real property situate in the City of Cupertino, County of
Santa Clara, State of California, consisting of approximately 0.0689 acres'
at 20800 McClellan Road.
NOW, THEREFORE, BE IT RESOLVED, that the City of Cupertino accept said
grant so tendered; and
IT IS FURTHER RESOLVED, that the City Clerk is hereby authorized to record
said dedication and this resolution,

forever quitclaim unto the CITY OF CUPERTINO, a municipal corporation, hereinafter
referred to as the "GRANTEE", its successors and assigns, all the right, title, interest,
estate, claim and demand, both at law and in equity, and as well in possession as in
expectancy of the GRANTOR as owner of Lot 14. Block 1. Tract No. 991 of that certain
subdivision of real property situate in the Country of Santa Clara, State of California, and
specifically described in the map thereof filed in the Office of the County Recorder of the
County of Santa Clara on the 12th day of Mav. 1952 in Book 36 of Maps at Pages g
to pump, take or otherwise extract water from the underground basin or any underground
strata in the Santa Clara Valley for beneficial use upon the lands overlying said
underground basin, and GRANTOR hereby irrevocably authorized GRANTEE, its
successors and assigns, on behalf of the GRANTOR and its successors in ownership or
overlying lands in the said lots to take from said underground basin within the said lots any
and all water which the owner or owners of said overlying lands may be entitled to take
for beneficial use on said lands and to supply such water to such owner or owners or
others as a public utility; provided, however, that nothing contained in this instrument shall
be deemed to authorize GRANTEE to enter upon any of the lots delineated upon the
above described map or to authorize GRANTEE to make any withdrawal of water which
will result in damage to any building or structure erected upon said lots.
