Bugay(Chopra residence) Location: 11204 Mt. Crest Drive Two-Story Permit to allow a 1,564 square foot first floor and a 311 square foot second floor addition to an existing 4,080 square foot, two story single family residence; Minor Residential Permit to allow two new second story balconies; Residential Exception to allow a 17', 6" first floor front yard setback where 20' is required Design Review Committee decision final unless appealed. Staff Member Schroeder explained that the application has been referred to the Design Review Committee because of the Residential Exception application. Part of the proposed addition includes a garage which encroaches 2', 6" into the required 20' front yard setback. The intent of the 20' setback is to ensure for enough room for parking, provide adequate light and air between buildings and the street and to help reduce the visual mass of the residence. When the garage door doesri t open onto the street, 2 Design Review Committee August 7,2014 the City usually allows a 15' side yard setback. This flag lot is unusual in that the front yard lot line slants inward approximately 40degrees in rather than being parallel with the street. Due to the slanted front lot line and the way the existing is residence is situated on the lot, the proposed garage will need to be treated as though it has a side facing entrance. It is not visible from the street and there is adequate additional parking. The Two-Story and Minor Residential permit meet all the requirements of the City's Municipal Code requirements. A certified Arborist has reviewed the plans and has requested to have additional trees planted on site to meet the privacy screening requirements. This requirement has been incorporated into the draft resolution. Commissioner Takahashi asked for clarification as to the species and number of trees to be planted. Chair Lee wanted to know if the additional tree requirement was because of the proposed new balconies. Staff inember Schroeder explained that the balconies as well as some new windows created the need for additional privacy screening even though it is an existing two story residence. Commissioner Takahashi then asked to see the elevation site plans. Chair Lee and Cominissioner Takahashi asked about the setback requirement for the garage. Staff Member Schroeder explained that the 20 foot setback is applied to rectangular shaped lots where when facing the house, someone sees a large massed structure. The 15 foot setback for side entry garages is applied as the structure someone is looking at is visually smaller and has less of an impact. The applicant said that they are looking forward to the moving into their new residence and raising their family. He thanked George for all his help. He has reviewed the conditions of approval and has no objections. A neighbor, Rob Karr, asked about how long the construction would take as all of the surrounding neighbors are retired and home during the day but was not opposed to the project. Staff inember Schroeder went over the construction hours and mitigation requirements. Another neighbor, Lanny Ng, wanted to know if a new fence could be installed in place of the wire one that now exists in order to reduce noise and add privacy. A neighbor, Steve Lew, spoke to the concerns about noise, dust and privacy. He stated that his house is extremely close to the project site. He would like construction to start later in the day since he works from home and doesn't want the background noise to affect his calls. He would also like to have a solid material fence installed for privacy. Staff inember Schroeder said that the City does not require fences. If property owners install fences, the City will review the fence for placement and height, but cannot compel a property owner to install one. He encouraged the neighbors to have a private discussion regarding that. The construction hours have been established in order to allow the most daylight hours to get the work done. The Building Department has a Best Management and Practices sheet the lists noise and dust mitigations that must be adhered to during construction. He said that some construction sites have a dedicated person who can be worked with to resolve complaints. He again encouraged the neighbors to communicate with each other regarding when construction will begin and how long it will take. Chair Lee asked the neighbors if they had spoken to the applicant regarding their concerns prior to the meeting. Ms Ng said she had not. She came to the meeting to discuss it because it is a privacy issue. She was asked if she would be willing to help pay for a new fence. She said she would wait to see how temporary fence works to keep the dust and noise down and would speak to the applicant after that going further. Staff inember Schroeder suggested a site specific Construction Management Plan could be developed to help enforce the required mitigations. The Committee discussed what sort of language could be incorporated into a Management Plan and what sort of recommendations could be included in the conditions of approval. Commissioner Takahashi spoke to the increased aesthetic for the neighborhood with the improvement of the existing house. He acknowledged that the Committee could not require a fence, but asked that the neighbors take advantage of the temporary fence to make sure that a solid permanent fence is really 3 Design Review Committee August 7,2014 what they all want. He is in favor of a simple site specific Construction Management Plan that outlines ways to minimize disturbances. He feels that over regulating the construction facilitates could prolong the project time line and create an enforcement issue. Chair Lee concurred with Commissioner Takahashi s comments. She encouraged the neighbors to work together on the fence issue. She would like the draft resolutions to be modified to incorporate the need for a site specific Construction Management Plan. Both Committee members felt that the conditions applied to the application for approval were sound and that the signage would not be a nuisance to the neighbors. They supported Staff's recommendations. That the literal enforcement of the provisions of the Sign Ordinance will result in restrictions inconsistent with the spirit and intent of the ordinance. The proposed sign is consistent with the intent of the Sign Ordinance in that it minimizes glare and distraction to motorists, bicyclists, pedestrians, and neighborhood residents. The LED numerals function similar to the existing plastic numerals in that they change depending on fluctuatiuns in fuel pricing. The lighting intensity will also be similar and has the ability to be reduced if deemed necessary by the City. 2. That the granting of an exception will not result in a condition which is materially detrimental to the public health, safety, or welfare. Draft Resolution EXC-2014-11 October 2,2014 Page-2- The proposed sign will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, or welfare. The project includes automatic dimming technology to reduce glare and will not include animated messages. 3. That the exception to be granted is one that will require the least modification of the prescribed design regulations and the minimum variance that will accomplish the purpose. The strict application of the ordinance standards would not allow the LED technology that is currently being used in other service stations throughout the region. The illumination intensity and appearance of the sign addresses the intent of the City's Sign Ordinance since they would not create distractions nor impact the City's aesthetic appearance. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, subject to the conditions which are enumerated in this Resolution beginning on Page 2 thereof, the application for a Sign Exception, Application no. EXC-2014-11, is hereby approved; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application no. EXC-2014-11 as set forth in the Minutes of Design Review Committee Meeting of October 2, 2014, and are incorporated by reference as though fully set forth herein. SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS Approval is based on the plan set received on August 22, 2014 entitled, "Shell, 20999 Stevens Creek Blvd., Cupertino, CA 95014," drawn by Sign Development Inc., consisting of 13 sheets labeled 1-13; except as may be amended by conditions in this resolution. 2. ACCURACY OF PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 3. EXCEPTION APPROVAL A Sign Exception is hereby granted to allow an additional wall sign and LED gasoline price signage and a new background to replace the existing sign face on an existing ground sign at an automobile service station. The color of the LED numerals shall be red, and the background shall be black. 4. ENHANCEMENTS TO EXISTING SIGNS The following enhancements are required for the existing ground sign: a. Insta115" high address numerals on both sides of the sign. b. Add additional landscaping at the base of the signs as determined appropriate by the Director of Community Development. LED SIGNAGE LIGHTING COLOR LED Lighting colors will be limited to red, blue or violet, or other color as approved by the Director of Public Works. Green or yellow lighting will not be permitted. 6. ILLUMINATION INTENSITY AND HOURS OF ILLUMINATION The intensity of the ground sign shall not exceed 250 foot-lamberts. All illuminated signs shall be turned off by 11:00 p.m. A letter from the business operator shall be provided prior to final building permit approval acknowledging this condition of approval and incorporated in the building permit plans. 7. LED SIGN REQUIREMENTS The following requirements shall apply to the LED fuel price sign: a. The sign shall not display animated messages, including flashing, blinking, fading, rolling, shading, dissolving, or any other effect that gives the appearance of movement. b. The sign shall not include any audio messages. c. The sign shall utilize automatic dimming technology to adjust the brightness of the signs relative to ambient light so that at no time shall a sign exceed a brightness level of three-tenths foot candles above ambient light, as measured using a foot candle (Lux) meter aimed directly at the sign face at a distance of 100 feet from the sign. d. An ambient light measurement shall be taken prior to final inspections using a foot candle meter at some point between the period of time between 30 minutes past sunset and 30 minutes before sunrise with the sign turned off to a black screen. e. Immediately following the ambient light measurement taken in the manner required above, an operating sign light measurement shall be taken with the sign turned on. f. The difference between the ambient light measurement and the operating sign light measurement shall be three tenths foot candles or less. g. The sign shall contain a default mechanism that will cause the sign to revert immediately to a black screen if the sign malfunctions. h. The LED copy may only contain fuel price numerals. i. The sign shall comply with Section 13532 of the State of California Business and Professions Code and all other State regulations regarding LED signage. 8. LIGHTING INTENSITY VERIFICAT'ION Prior to final ins ections of sign permits, a licensed lighting engineer shall confirm that the lighting intensity is in compliance with the conditions of approval in this resolution. 9. SIGN EXCEPTION REVIEW/ADDITIONAL RESTRICTIONS If complaints are received related to the intensity of the LED signage under this Sign Exception, and the complaints are not addressed immediately by the property management, then the Design Review Committee shall conduct a public hearing on the Sign Exception at which time, the approval for LED signage may be modified or revoked. SIGN PERMITS REOUIRED The applicant shall consult with the City's Building Division to obtain the necessary sign permits for this project. 11. TEMPORARY SIGNS Temporary signs shall comply with the Temporary Sign regulations of the City's Sign Ordinance Chapter 19.104 of the Municipal Code). A temporary sign permit is required for all banners, a- frame or other freestanding signs (except those required by the State of Califomia), and promotional devices. 12. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 13. INDEMNIFICATION To the extent permitted by law, the applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant and City shall use best efforts to select mutually agreeable legal counsel to defend such action, and the applicant shall pay all compensation for such legal counsel, following the applicant's receipt of invoices from City, together with reasonable supporting documentation. Such compensation shall include reasonable compensation paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. If the applicant and the City cannot in good faith agree on joint counsel, the City shall have the right to retain counsel of its own choosing, separate from the applicant's litigation counsel. 14. NOTICE OF FEES DEDICATIONS, RESERVATIONS, OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Governinent Code Section 66020(a), has begun. The nearest residence is approximately 275 feet of the project site’s property line. Prior Sign Exception Approval On December 17, 2003, the Design Review Committee approved a Sign Exception (EXC-2003-07) on the site to allow two signs when one was allowed. The Planning Commission supported the additional sign for visibility purposes since the property is located on a corner with two street frontages. DISCUSSION: Application request The applicant, Sal Pablo, of Sign Development Inc., representing the property owner, Judy Hui, of Shell Service Station, is proposing to replace an existing ground sign along the Stevens Creek frontage of the site. The existing internally illuminated sign cabinet would be replaced with a new internally illuminated cabinet with light-emitting diode (LED) price numerals. A substantial portion of the background of the sign would be opaque in order to minimize glare. The existing cabinet and sign base dimensions would remain the same. The City’s Sign Ordinance requires signs with directly visible light sources (Section 19.104.220 F) and non-permanent changeable copy letters or numerals to be reviewed and approved by the Design Review Committee with a Sign Exception application. (Table 19.104.180 B). In addition to modifying the existing ground sign, the applicant is proposing an additional wall sign on the Food Mart where only one sign was originally approved. The Food Mart building is located in the center of the lot with fueling stations of either side. The additional sign will allow for identification on both sides of the building frontage where fueling is taking place. LED Signage The City’s Sign Ordinance does not specifically address exposed LED signage on fuel price ground signs given its relatively new implementation in other automobile service stations throughout the region . Under the current ordinance provisions, LED fuel price signage is not permitted since it has a directly visible light source and since the price signs are made up of light bulbs, they are not considered a permanent, durable material. The restrictions against directly visible light sources are intended to limit glare and distraction to motorists, bicyclists, pedestrians, and residents in the neighborhood. The requirement for high quality, durable material in changeable sign copy is intended to avoid unsightly, reduced quality signage that would diminish the City’s aesthetic appearance. As part of the proposed project, the LED numerals would be equipped with an automatic brightness control that would be adjusted based on the ambient light condition, including a reduction in intensity by up to 90 percent. The cumulative illumination intensity of each sign is within the 250 foot lamberts allowed by the City’s Sign Ordinance as indicated on the plans. The sign differs from electronic readerboard signs in that it does not include periodically changing or animated messages. The proposed LED numerals would remain static, except for when the price of gasoline changes (typically once or twice per day). The conditions of approval for the project require the following in order to minimize glare and distractions to passersby: Restrictions on illumination intensity, EXC-2014-11 20999 Stevens Creek Boulevard October 16, 2014 Page 3 A requirement that the signs be turned off by 11:00 PM Restrictions against animated messages Utilization of automatic dimming technology to adjust brightness consistent with the restrictions on illumination intensity Licensed lighting engineer testing and confirmation that the signs meet the illumination restrictions Modify the proposed green LED lights to red LED lights The LED numerals function similar to the existing plastic numerals in that they change depending on fluctuations in fuel pricing. The LED numeral technology will enhance convenience by allowing service station operators to control fuel prices remotely without having to manually change individual numerals . The LED numerals feature energy efficient illumination with lighting intensity similar to internally illuminated plastic letters. The proposed opaque background of the sign will further reduce light glare. OTHER DEPARTMENT/AGENCY REVIEW The City’s Building Division, the Santa Clara County Fire Department, and the Santa Clara County Sheriff’s Department reviewed the project and have no objections. A condition of approval requiring a change in the LED bulb color from green to red has been added to address the Public Works Department’s concern that the green lights would interfere with the controlled intersection. PERMIT STREAMLINING ACT This project is subject to the Permit Streamlining Act (Government Code Section 65920 – 65964). The City has complied with the deadlines found in the Permit Streamlining Act. The Design Review Committee’s decision on this project is final unless appealed to the City Council within 14 calendar days of the decision. CONCLUSION Staff recommends approval of the project since the conditions of approval address all concerns related to the proposed project and all of the findings for approval of the proposed project, consistent with Chapter 19.104 of the Cupertino Municipal Code, may be made.
