GRANT OF EASEMENT

KAISER CEMENT & GYPSUM CORPORATION, hereinafter called.GRANTOR,
hereby grants to the CITY OF CUPERTINO, a municipal corporation, hereinafter called
GRANTEE, the right to excavate for, install, replace (of the initial or,any other size),
maintain and use for storm drain purposes as Grantee shall from time to)time elect within
the hereinafter described property of those certain premises which are/situated in the
City of Cupertino, County of Santa Clara, State of California, as described as follows:

Grantor hereby further grants to Grantee the right and privilege to enter upon
his lands contiguous to and along the line of said hereinabove described strip for the
purpose of locating, constructing, repairing, maintaining, or replacing said storm drain
or appurtenances thereto, and for the purpose of doing any necessary or lawful act in
connection with the construction or maintenance of said storm drain; there is also granted
the right of the use of sufficient land contiguous to said strip on either or both sides
thereof for the purpose of excavation of and deposit of earth and necessary building
material during the time of constructing said storm drain, and any repair thereof.
The foregoing is subject to the following express conditions:
The Grantee agrees to restore the ground surface and any improvements thereon
to its original grade or condition insofar as it is practicable and reasonable to do so.
Grantee hereby agrees to pay any damages which may arise from the laying, maintaining
or operating of said storm drain and agrees to protect, indemnify and save harmless
Grantor and its successors and assigns from and against any and all liability, loss, cost,
damage, expense and claims of every kind and character due to injury to or death of any
person whomsoever or loss of or damage to any property whatsoever, arising directly or
indirectly out of or incident to the existence, use, maintenance or condition of said
storm drain.
IN WITNESS WHEREOF, said parties have executed this Grant of Easement this

County of Santa Clara, County of Santa Clara, State of California, described
as follows:
A strip of land ten foot (10') width measured at right angles, said strip
being a portion of that lot entitled, "McDonald & Dorsa", as shown on
that Record of Survey, filed for record in the office of the Recorder of
the County of Santa Clara, State of California, on May 6, 1968 in Book 237
of Maps at page 9; centerline of the said ten foot strip described as follows:
Beginning at a point along the Southerly line of the Northwesterly 1/4
section of Section 22 measured 957.32 feet westerly from the center of
said Section 22, as shown upon said Record of Survey;
thence from said point beginning S. 4210' 28" E., 154.69 feet;.
thence S. 40 023' 53" E. , 174.69 feet;
thence S. 60037' 38" E. , 66.46 feet;
thence S. 8641' 59" E. , 80.73 feet;
thence S. 10'056' 31" E. , 75.00 feet to the limit of the proposed easement;

RESOLUTION NO. 4620
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTING GRANT OF EASEMENT FOR STORM DRAIN PURPOSES FROM
KAISER CEMENT & GYPSUM CORPORATION CONSISTING OF APPROXI-
MATELY 0.1266 ACRES, LOCATED ON STEVENS CANYON ROAD SOUTH-
ERLY OF RICARDO ROAD
WHEREAS, there has been executed a Grant of Easement for Storm Drain
purposes which is in good and sufficient form granting to the City of Cuper-
tino, County of Santa Clara, State of California, easement over certain
real property for storm drain purposes, situate in the City of Cupertino,
more particularly described in Exhibit "A" and Exhibit "B", attached hereto
and made a part hereof;
NOW, THEREFORE, BE IT RESOLVED, that the City of Cupertino accept said
grant so tendered; and
IT IS FURTHER RESOLVED, that the City Clerk be and he is hereby auth-
orized to record said dedication and this Resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 19th day of December , 1977, by the following vote:
