CC 11-03-2014 CUPERTINO APPROVED MINUTES CUPERTINO CITY COUNCIL Monday,,November 3, 2014 SPECIAL CITY COUNCIL MEETING ROLL CALL At 5:30 p.m. Mayor Gilbert Wong called the Special City Council meeting,to order in Cupertino City Hall Conference Room A, 10300 Torre Avenue. Present: Mayor Gilbert Wong, Vice Mayor Rod Sinks, and Council members Barry Chang, Orrin Mahoney, and Mark Santoro. Absent: None. CLOSED SESSION At 5:30 p.m. Council went into closed session and reconvened in open session at 6:45 p.m. in the Cupertino Community Hall Council Chamber, 10350 Torre Avenue. 1. Subject: Conference with Legal Counsel-Initiation of Litigation pursuant to subdivision (c) of Section 54956.9: One Case Mayor Wong announced that the City Council obtained a briefing from legal staff and gave direction. REGULAR CITY COUNCIL MEETING PLEDGE OF ALLEGIANCE At 6:45 p.m. Mayor Gilbert Wong called the Regular City Council meeting to order and led the Pledge of Allegiance. ROLL CALL Present: Mayor Gilbert Wong, Vice Mayor Rod Sinks, and Council members Barry Chang, Orrin Mahoney, and Mark Santoro. Absent: None. City Council Minutes November 3, 2014 CEREMONIAL MATTERS AND PRESENTATIONS Mayor Wong reordered the agenda to take up item number 3 before item number 2. . 3. Subject: Present proclamation to Bonnie Belshe, History Teacher of the Year for the State of California Recommended Action: Present proclamation Mayor Wong presented the proclamation to Bonnie Belshe. 2. Subject: Certificates of appreciation recognizing volunteer students from the Silicon Valley Korean School " Recommended Action: Present certificates . Mayor Wong presented the certificates to the students. 4. Subject: Update from the Santa Clara Valley Water District Board Director Nai Hsueh Recommended Action: Receive update Written communications for this item included a PowerPoint presentation and the Drought 2014 Monthly Status.Report for October. Santa Clara Valley Water District Board Director Nai Hsueh gave an update via a PowerPoint presentation. Council received the update. 5. Subject: Update by John Ristow from the Valley Transportation Authority (VTA) regarding the Highway 85 Express Lane Project n: Receive update Recommended Actio ec . Written communications for this item included responses to Council questions from the October 21, 2014 City Council meeting. John Ristow gave an update on the Highway 85 Express Lane Project, responding to questions Council raised at the last City. Council meeting. Mary Robertson, resident of Saratoga, said that an October, 2010 project study noted the project would be obsolete by 2023 and the report suggested increasing the toll or the number of carpoolers to three, which would cause carpoolers to drop out. She asked that the cities encourage VTA to look at other forms of mass transportation City Council Minutes November 3, 2014 such as light rail. POSTPONEMENTS Certification of the EIR, General Plan Amendment, Draft Housing Element, Rezoning, Specific Plan Amendment, and Municipal Code Amendments was re-noticed for the Special City Council meeting of Monday, November 10, 2014. City Manager David Brandt noted that the Planning Commission' was unable to give its recommendation at the regular meeting and had continued the meeting an additional week to discuss the item further. This prevented the November 3 noticing to be advertised within the legal 10-day period. Mahoney moved and Sinks seconded to hear this item on Monday, November 10, 2014. The motion carried with Chang and Santoro voting no. ORAL COMMUNICATIONS The following individuals spoke on the fatal bicycle accident that had recently occurred: Sharana Math Allen Yao Wen Hai Zheng Feng Ye \ Liang-Fang Chao Kristen Lyn YuTei Jennifer Hao Eric Yang Shubha Ramachandrappa Rich Williams Joan Owyang-Lee Eddie Lee John Mumy Heather Mumy Winston Shiah Rusha Ouyang Ameita Tiusana Xiaoke Tao Aidong Chen City Council Minutes November 3, 2014 Comments included: issue with trash cans in bike lane; issue with drivers crossing into bike lane; add a crossing guard in high traffic areas around schools; paint all bike lanes and add lights; no trucks one hour before and one hour after school in session; educate kids about biking with traffic; ban trucks on residential roads; more speed bumps around schools; no turn on red in a bike lane; make sure bike lane is 3 feet wide as per state law; more obvious division between bike lane and vehicles; no trucks on McClelland, Bubb, and Rainbow; encourage mass transportation; issues with bikers not obeying the laws;jaywalkers; add fences or partitions along the bike lanes at important intersections around the schools; separate sidewalk to have bikers on one side and pedestrians on the other at least during high traffic time; add a VTA bus stop along McClelland. Subject: Approve the October 21 City Council minutes Recommended Action: Approve the minutes 7. Subject: Accept Accounts Payable for period ending October 17, 2014 Recommended Action: Adopt Resolution No. 14-208 accepting Accounts Payable for the period ending October 17, 2014 8. Subject: Application for Alcoholic Beverage License for The Melt, 20803 Stevens Creek Boulevard, Suite 110 Recommended Action: Recommend approval for Alcoholic Beverage License for The Melt, 20803 Stevens Creek Boulevard, Suite 110 9. Subject: Amendment to the professional services contract with 4Leaf, Inc. for plan review services for the Main Street Project Recommended Action: Authorize the city manager to sign an amendment to the Professional Services Agreement with 4Leaf, Inc. for plan review services for the Main Street project adding $60,000 to the original contract of $156,226, for a total amount not to exceed $216,226 SECOND READING OF ORDINANCES 10. Subject: Approval of an Ordinance amending Chapter 2.08 of Title 2 of the Cupertino Municipal Code to add section 2.08.145 to codify the existing call for council review Recommended Action: Conduct the second reading and enact Ordinance No. 14-2123: "An Ordinance of the City Council of the City of Cupertino amending the Cupertino City Council Minutes November 3, 2014 Municipal Code Chapter 2.08 of Title 2 to include Section 2.08.145 relating to call for Council review" Mahoney moved and Sinks seconded to read Ordinance No. 14-2123 by title only and that the City Clerk's reading would constitute the second reading thereof. Subject: Authorize new position categories in the salary schedule for the Cupertino Employee Association's Compensation Program and accept salary schedule and title changes for classifications in the Unrepresented Employees' Compensation Program Recommended Action: Adopt Resolution No. 14-209 amending the Cupertino Employee Association's (CEA) Compensation Program and the Unrepresented Employees' Compensation Program salary schedules Interim Director of Administrative Services Kristina Alfaro reviewed the staff report via a PowerPoint presentation. Council member Chang stepped away from the dais before the vote on this item. Santoro moved and Mahoney seconded to adopt Resolution No. 14-209 amending the Cupertino Employee Association's (CEA) Compensation Program and the Unrepresented Employees' Compensation Program salary schedules. The motion carried with Chang absent. REPORTS BY COUNCIL AND STAFF City Manager David Brandt noted that Council would be hosting a facilitated meeting on November 6 beginning at 7:00 p.m. at the Quinlan Community Center to receive community ideas about traffic and bike safety. He also noted that there would be a public workshop on November 5 in the Community Hall for input on alternatives for the McClellan Ranch Blackberry Farm Park Master Plan, and to remember to vote on November 4. Council members highlighted the activities of their committees and various community events. City Council Minutes November 3, 2014 Mayor Wong asked for a moment of silence for Ethan Wong who was a student at Monta Vista High School, a member of Boy Scout Troop 408, and a member of the cross country team at Monta Vista.
