r hereinafter called Grantor, hereby grant to the CITY OF Cto, RECEIVED,
a municipal corporation, hereinafter called Grantee, the right to
excavate for, install, replace (of the initial or anv;,other size) ,
maintain and use for sidewalk purposes as Grantee shall from ti-ma to
time elect ;within the hereinafter described property of those certain
premises which are situate in the City of Cupertino, County of Santa
Clara, State of California, and described as follows :

All that certainP arcel of land situated in the City of Cupertino, County
of Santa Clara, State of California, described as follows: .
BEGINNING at the northeast corner of Parcel 1 in the southerly line of
Homestead Road as said parcel and road are shown on that certain map entitled
"Parcel Map, Division of Lands of J. Cyril Johnson and La Prele Johnson, being
a portion of the San Antonio Rancho", filed for record on Jure 1, 1979, in Book
442 of Maps, at Pages 38, 39 and 40, records of said County; thence north
890 01' 22" west along the southerly line of said Homestead Road 56.52 feet to
the beginning of a non-tangent curve concave to the northeast having a radius of
20.00 feet, a radial line from said point bears south 890 01' 22" east; thence
southeasterly along the arc of said curve 31.42 feet through a central angle of
900 00' 00"; thence south 890 01' 22" east parallel with said Homestead Road
34.74 feet to a point on the easterly line of said Parcel 1; thence north
060 04' 23" east along said easterly line 20.08 feet to the POINT OF BEGINNING.
Contains 0.024 acres, more or less.
Grantor hereby further grants to Grantee the right and
privilege to enter upon his lands contiguous to and along the
line of said hereinabove described strip for the purpose of
locating, constructing, repairing, maintaining, or replacing said
sidewalks or appurtenances thereto, and for the purpose of doing
any necessary or lawful act in connection with the construction or
maintenance of said sidewalk; there is also granted the right of
the use of sufficient land contiguous to said strip on either or both
sides thereof for the purposes of excavation of and deposit of earth
and necessary building material during the time of constructing said
sidewalk, and any repair thereof,
The foregoing is subject to the following express conditions :
The Grantee agrees to restore the ground surface and any improve-
ments thereon to its original grade or condition insofar as it is
practicable and reasonable to do so,

0.051 ACRES LOCATED ALONG HOMESTEAD ROAD AT FALLEN LEAF
LANE
WHEREAS, there has been executed a Grant of Easement for Sidewalk
Purposes which is in good and suf-
ficient form granting to the City of Cupertino, County of Santa Clara, State
of Calfornia, easement over certain real property for Sidewalk
purposes, situate in the City of Cuper-
tino, more particularly described in Exhibit "A" and Exhibit "B" , attached
hereto and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED, that the City of Cupertino accept said
• grant so tendered; and
IT IS FURTHER RESOLVED, that the City Clerk be and he is hereby authorized
to record said dedication and this Resolution.
