SPECIAL CITY COUNCIL MEETING
PLEDGE OF ALLEGIANCE
At 6:30 p.m. Mayor Gilbert Wong called the Special City Council meeting to order
and led the Pledge of Allegiance.
ROLL CALL
Present: Mayor Gilbert Wong, Vice Mayor Rod Sinks, and Council members Barry
Chang, Orrin Mahoney, and Mark Santoro. Absent: None.
CEREMONIAL MATTERS AND PRESENTATIONS
1. Subject: Present proclamation to Jaqui Guzman and her family in recognition
of their volunteer service
Recommended Action: Present proclamation
Mayor Wong presented the proclamation to Jaqui Guzman.
Mayor Wong reordered the agenda to take up Oral Communications next.
ORAL COMMUNICATIONS
Anjali Kausar wished Mayor Wong a happy birthday.
Darrel Lum noted issues with viewing the November 3 and 6 minutes from the website.
Jack McKeown talked about impending issues regarding lack of infrastructure to
support the increasing population, asked what the ratio was in the General Plan for

open park space for residents, and urged limiting further development of dense urban
housing within Cupertino.
Gary Latshaw representing the Loma Prieta Chapter of the Sierra Club spoke on
Stevens Creek Corridor urging Council to finish the restoration process with Phase 2.
Lisa Warren distributed an email from Peter Pau to Council member Chang that she
was copied on saying that she was impossible to please in regards to her comments on
the Housing Element sites.
Ari Strod distributed pictures of the Cupertino Sports Center and other sports centers
regarding the installation of TV monitors on the treadmills. He said that he doesri t like
them because he cari t see outside and asked Council to discuss this issue.
Art Cohen representing Bluelight Cinemas invited everyone to a free event on
December 11 at 6:30 p.m. to meet three actors from the original Star Trek television
series. He noted that each actor is also an author and will donate a book to the
Cupertino Library Foundation. Mr. Cohen also announced some new programs taking
place at Bluelight Cinemas.
California Assembly member Evan Low congratulated the new Mayor, Vice Mayor and
incoming Council members and noted that certificates would be given to the outgoing
Council members for their service.
Yu Ying noted proposed projects such as a new City Hall and Library expansion and
urged Council to spend Cupertino's money wisely.
Deepika Kapil (speaking on behalf of two other people) distributed a document titled,
"What is happening to Cupertino." She urged Council to stop cutting down trees for
development, dori t raise building heights more than 60 feet, require more building
setbacks, add more parks, and spread out the growth in the City.

Minutes December 2-3, 2014
Nagapriya Tiruthany said that when the new Biltmore Apartments were built, cars
have been parking on both sides of Rodrigues making it very narrow for bikes. She
urged Council to push developers to add more parking spaces on site and to add
more green space as well.
Lisa Warren talked about property owners neglecting trees on undeveloped land
and then getting permission to remove them because they are sick or dead when
the property is developed. She also said that the area around Sedgwick, Hyde, and
Cupertino schools should be treated as another tri-school area regarding traffic
concerns, and that impact on schools can and should be considered with any new
development. �
Tim Brand said that he believes the current Council is the right group to solve the
housing crisis currently being discussed in Cupertino.

1. Subject: Second Reading and enactment of the Municipal Code Amendment
regarding the Protected Tree Ordinance
Recommended Action: Conduct the second reading and enact Ordinance
No. 14-2126: "An Ordinance of the City Council of the City of Cupertino
Amending Chapter 14.18 of the Cupertino Municipal Code relating to
Permit thresholds citywide, streamlining the tree removal process for R1,
A1, A, RHS, and R2 zones and modifications for readability"
Description: Application, No(s): MCA-2013-01; Applicant(s): City of
Cupertino; Location: citywide; Adoption of amendments to Chapter 14.18,
Protected Trees, of the Cupertino Municipal Code to streamline and update
the tree removal review and approval process, and to improve
readability/consistency
Council members Vaidhyanathari and Paul said that they had listened to the
tape and read the documents regarding the first reading of this item.

Associate Planner Tiffany Brown reviewed the staff report.
Noel Eberhardt representing other Block Leaders asked Council to authorize
the City staff to make the tree trimmings available to the residents for use as
compost rather than giving it over to recycling.
Jennifer said that Cupertino is well known for its beautiful trees and urged
Council to keep the Bay Laurel and other native trees on the list.
Roy Hampton said he likes the new ordinance but noted one issue in the
ordinance regarding exemptions. He urged Council to remove the Bay
Laurel since it harbors disease to other Oaks and to not add the London
Plane because it drops balls.
Assistant Director of Community Development Gary Chao explained that
there was a typo in the first paragraph of the ordinance Section 14.18.110,
where it refers to the tree removal exemption Section 14.18.150, and that
staff would correct that.
City Clerk Grace Schmidt read the title of the ordinance.
Wong moved and Chang seconded to read Ordinance No. 14-2126 by title only
and that the City Clerk's reading would constitute the second reading thereof
and directed staff to correct the ordinance as noted above. Ayes: Chang, Paul,
Sinks, Vaidhyanathan, and Wong. Noes: None. Abstain: None. Absent: None.
Wong moved and Chang to enact Ordinance No. 14-2126. Ayes: Chang, Paul,

PUBLIC HEARINGS
2. Subject: General Plan Amendment, 2014-2022 Housing Element, associated
Rezoning, Zoning map and text amendments and Specific Plan
Amendment, and related actions for environmental review to consider
citywide amendments to the City's General Plan, including the Housing
Element, Heart of the City Specific Plan, Vallco Shopping District, heights,
densities, commercial, retail, residential allocations, and recommendations
on the Housing Element sites, and to rescind all actions taken on these
issues during the November 10, 2014 Council meeting.

Recommended Action:
A. Rescind all actions taken on November 10, 2014 and consider the issues
anew, disregarding prior votes and directions; and
B. Conduct a public hearing and take actions on the recommendations of the
Planning Commission which recommends that the City Council take the
following actions in accordance with the Draft Resolutions (Attachments A-
P) with the exceptions noted in Attachment G:
1. Adopt Resolution No.14-210 for Certification of an Environmental Impact
Report, adoption of Findings and a Statement of Overriding Considerations,
and adoption of Mitigation Measures and a Mitigation Monitoring and
Reporting Program, (EA-2013-03), in substantially similar form to the
attached Resolution (Attachment A);
2. Adopt Resolution No. 14-211, GPA-2013-01 in substantially similar form
to the attached Resolution (Attachment B and as amended by Attachment
G), for:
a. Draft General Plan (Community Vision 2040); and
b. General Plan Map Amendments.
3. Adopt Resolution No. 14-212 to authorize staff to, in substantially similar
form to the attached Resolution (Attachment C and as amended . by
Attachment G): �
a. Forward the Draft 2014-2022 Housing Element to the State Department of
Housing and Community Development (HCD);_.and
b. Use the prioritized list of Alternative Housing Element sites (in case one
or more of the adopted sites are not accepted by HCD as Housing Element

4. Conduct first reading of Ordinance 14-2124, "An Ordinance of the City

Sinks moved and Wong seconded and the motion carried unanimously to adjourn
the meeting to December 3 at 7:45 p.m. for purposes of continued public hearing,
consideration, deliberation, and decisions on Item #2 on the December 2, 2014
Agenda, Subject: General Plan Amendment, 2014-2022 Housing Element, associated
Rezoning, Zoning map and text amendments and Specific Plan Amendment, and
related actions for environmental review to consider citywide amendments to the
City's General Plan, including the Housing Element, Heart of the City Specific Plan,

Vice Mayor Chang made comments regarding keeping an open mind at
every meeting and listening to everyone before making any decision and he
also noted that he meets with developers and residents if asked on any
issue. He said that any money donated was used for campaign purposes
only and he never asked for any reimbursement from the City. He said he
has no conflict of interest.
Housing Element consultant Barbara Kautz with Goldfarb and Lipman
responded to Council questions.
After some deliberation, Council took a short recess.
Council recessed from 11:13 p.m. to 11:24 p.m.
Wong moved and Chang seconded to adopt Resolution No. 14-210 for
Certification of an Environmental Impact Report, adoption of Findings and
a Statement of Overriding Considerations, and adoption of Mitigation
Measures and a Mitigation Monitoring and Reporting Program, (EA-2013-
03), in substantially similar form to the attached Resolution (Attachment A).
He rescinded the motion to allow staff time to look over the details for all
the motions.
Council recessed from 1:11 a.m. to 2:00 a.m.
Wong moved and Chang seconded the following:
Adopt Resolution No. 14-210 certifying the Environmental Impact Report
for the General Plan Amendment, Housing Element Update and Associated
Rezoning Project; and Adopting Findings and a Statement of Overriding
Considerations, Mitigation Measures and a Mitigation Monitoring and
Reporting Program with the changes outlined in the Housing Element
Resolution pertaining to the Priority Housing Sites. The motion carried
unanimously.
Adopt Resolution No. 14-211 approving a General Plan Amendment to
reallocate and replenish development allocation, amend the General Plan
Land Use Map and Development Standards, Comply with State Law and
Reorganization, and Improve Presentation and Readability with the
following changes:

a. Modify the Citywide Development Allocation (Table LU-1) as follows:
(i) Retain existing Development Allocations except Vallco Shopping
District should show 2,000,000 s.f. of office allocation and 389
residential units (as a Plan A Priority Housing Site). If there is no
Specific Plan adopted by May 31, 2018, the City will consider removing
office allocation and 389 residential units:
(ii) Identify residential allocation in the appropriate Special Areas in
conformance with the Priority Housing Sites.
b. Modify the Community Benefits Program (Policy LU —1.3) to remove the
program specifics and replace with general language as a placeholder

in conformance with the General Plan. The motion carried unanimously.
Wong moved and Chang seconded to read Ordinance No. 14-2124 to rezone
certain sites for conformance with the General Plan and Housing Element
with a modification to be consistent with the changes as reflected in
Resolutions 14-211 (General Plan Amendment) and 14-212 (Draft Housing
Element) by title only and that the City Clerk's reading would constitute the
first reading thereof. Ayes: Sinks, Chang, Paul, Vaidhyanathan, and Wong.

Wong moved and Paul seconded to read Ordinance No. 14-2125 to amend
various chapters in Title 18 and Title 19 and add a chapter in Title 13 and
Title 19 for conformance with State Law, consistency, and to improve
readability by title only and that the City Clerk's reading would constitute
the first reading thereof with the following changes:
a. Modify the Community Benefits Program (Section 19.144.070) to remove
the program specifics and replace with general language to reflect the
Council decision on the General Plan.
b. Modify Chapter 19.80, Planned Development, to reflect that sites
requiring a Specific Plan shall be governed by the Specific Plan.
Ayes: Sinks, Chang, Paul, Vaidhyanathan, and Wong. Noes: None. Abstain:
None. Absent: None.
Staff noted that they would do more outreach to the community.
