(a) Grounds for an administrative citation. An administrative citation may be issued upon findings made by the City Manager, or his or her designee, when any person or food vendor has provided EPS foam food service ware to a customer or violated any other provision of this Chapter. (b) Administrative citation fine amounts. Upon findings made under subsection (a), the person or food vendor shall be subject to an administrative citation pursuant to Chapter 1.10 of this Code. Fines for the administrative citation are as follows: (1) First citation: One hundred dollars ($100.00). (2) Second citation for the same violation within the same twelve month period: Two hundred dollars ($200.00) (3) Third or any subsequent citation for the same violation within the same twelve month period:Five hundred dollars ($500.00) (4) Each day that any person or food vendor violates the provisions of this chapter a new and separate violation occurs. (c) Administrative citation appeals and disposition shall be processed in accordance with Chapter 1.10 of this Code. (Ord. 14-2116, § 1 (part), 2014) 9.15.140 Severability. If any section, subsection, subdivision, sentence, clause, or phrase of this Chapter is for any reason held to be unconstitutional or otherwise void or invalid, by any court of competent jurisdiction the validity of the remaining portion of this Chapter shall not be affected thereby. It is unlawful and a violation of this chapter for a person holding a valid parking permit issued pursuant hereto to knowingly permit the use or display of such permit on a motor vehicle other than that for which the permit is issued. Such conduct shall constitute an unlawful act and violation of this chapter both by the person holding the valid parking permit and the person who so uses or displays the permit on a motor vehicle other than that for which it is issued. C. It is unlawful and a violation of this chapter for a person to copy,produce or otherwise bring into existence a facsimile or counterfeit parking permit or permits without written authorization from the Director of Public Works. It shall further be unlawful and a violation of this chapter for a person to knowingly use or display a facsimile or counterfeit parking permit in order to evade limitations on parking applicable in a permit parking zone. D. Any person who violates any of the provisions of this chapter shall be guilty of an infraction, and upon conviction thereof,be punished as provided in Chapter 1.12.
