GRANT OF SIDEWALK EASEMENT
LINCOLN CUPERTINO ASSOCIATES LIMITED, a California Limited
Partnership, hereinafter called Grantor, hereby grants to the � f
City of Cupertino, a municipal corporation, hereinafter called
Grantee, the right to excavate for, install, replace, maintain
and use for sidewalk purposes as Grantee shall from time to time
elect within the hereinafter described property of those certain
premises which are situated in the City of Cupertino, County of
Santa Clara, State of California, and described on Exhibit "A"
attached hereto.
Grantor hereby further grants to Grantee the right acid
privilege to enter upon its lands contiguous to and along the
.line of said hereinabove described strip for the purpose of
locating, constructing, repairing, maintaining, or replacing
said sidewalks or appurtenances thereto, and for the purpose of
doing any necessary or lawful act in- connection with the con-
struction or maintenance of said sidewalk; there is also granted
the right of the use of sufficient land contiguous to said strip
on either or both sides thereof for the purposes of excavation
of and deposit of earth and necessary building material during the
time of constructing said sidewalk, and any repair thereof.
The foregoing is subject to the following express conditions :
The Grantee agrees to restore the ground surface and any im-
provements thereon to its original grade or condition insofar as
it is practicable and reasonable to do so.
IN W TNESS WHEREOF, Grantor has executed this Grant of Easement

A portion of Parcel 2, as shown upon that certain map entitled "Parcel Map
being a Subdivision of Lot 9 of Tract 3743 (Book 186 of Maps , Pages 36 and
37)" which map was filed for record in the Office of the Recorder of the
County of Santa Clara, State of California on December 12, 1978 in Booti
432 of Maps at Page 3, consisting of two parts and more particulary
described as follows:
Part 1
A strip of land 11 feet in width contiguous to the most southerly property
line of said Parcel 2, said line also being the northerly boundary of
Rodriques Avenue. Said strip begins at a point on said line 215 feet from
the most easterly boundary of Parcel 1 as shown on said Parcel Map , and

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTING GRANT OF EASEMENT FOR SIDEWALK FROM LINCOLN
CUPERTINO ASSOCIATES LIMITED CONSITING OF APPROXIMATELY
0.071 ACRE LOCATED ON THE NORTHWEST CORNER OF TORRE AVENUE
AND RODRIGUES AVENUE
WHEREAS, there has been executed a Grant of Easement for
Siriawalk Purposes which is in good and suf-
ficient form granting to the City of Cupertino, County of Santa Clara, State
of Calfornia, easement over certain real property for
Sidewalk purposes, situate in the City of Cuper-
tino, more particularly described in Exhibit "A" and Exhibit. "B" , attached
hereto and made a part hereof.
NOW, THEREFORE, BE IT RESOLVED, that the City of Cupertino accept said
grant so tendered; and
IT IS FURTHER RESOLVED, that the City Clerk be and he is hereby authorized
to record said dedication and this Resolution.
