D-210 GRANT DEED, SANTA CLARA VALLEY WATER DISTRICT RECORD WITHOUT FEE UNDER SECTION 6103 GOVERNMENT CODE OF THE STATE OF CALIFORNIA AFTER RECORDING, RETURN TO: Santa Clara Valley Water District 5750 Almaden Expressway San Jose, CA 95118 NO CONSIDERATION Document No.: 2017-21.03 GRANT DEED SANTA CLARA VALLEY WATER DISTRICT,a public corporation of the State of California, hereby grants to the CITY OF CUPERTINO, a chartered municipal corporation in the State of California, for public street purposes, all that certain real property situate in the City of Cupertino, County of Santa Clara, State of California, described as follows: Being a portion of the lands granted to the Santa Clara County Flood Control and Water Conservation District (now the Santa Clara Valley Water District) in the deed recorded in Bojk 5351 of Official Records at page 160, in the office of Recorder, County of Santa Clara, State of California to wit: Beginning at the southeast comer of Lot 49 of that certain map entitled "Tract 2335" and recorded in Book 105 of Maps at page 40, Santa Clara County Records; thence along the northerly line of said lands, as described in said deed, N89°55'23"E 60.00 feet; thence leaving said line S00°01'23"W 50.00 feet; to the southerly line of said lands; thence along said southerly line, S89°55'23"W 60.00 feet; thence leaving said line N00°01'23"E 50.00 feet to POINT OF BEGINNING. Containing 3,000 square feet or 0.069 acre of land more or less. RESERVING, therefrom unto Grantor, an easement for water management and/or storm water drainage purposes in, upon, over, and across the above-described property. Said easement area shall be kept clear of any type of building, fences, structures, pavement, or trees, unless prior written approval is obtained from District excepting nonetheless those structures and/or pavement existing as of the date hereof together with the right of Grantee to maintain, repair, reconstruct, and inspect same. Grantee acknowledges that District shall have no liability for the repair of any landscaping harmed or destroyed in the easement area due to District use thereof now or in the future. With regard to any flood control structure, Grantor agrees to take responsibility for the maintenance and repair of the existing and any replacement flood control structure when Grantor determines such work is necessary. The easement reserved hereby shall include the right to construct, reconstruct, inspect, maintain, and repair a channel, protection works, and appurtenant structures, together with the right to trim or remove such trees or brush within the easement area as may constitute a hazard to persons or property or may interfere with the use of said area for the purposes granted. It also shall include the right to enter upon said easement area with vehicles, tools, implements and other materials, take therefrom and use, earth, ORIGINAL 8770Decd.rsm 1 of 3 SCVWD Document No. 2017-21.03 rock, sand, and gravel for the construction, maintenance, and repair of said channel, protection works, and appurtenant structures by said District, its officers, agents, employees, and by persons under contract with it and their employees whenever and wherever necessary for flood control or storm drainage purposes, provided however, that District shall indemnify and hold harmless Grantee and Grantee's successors from any losses, claims, or demands arising from this reservation of easement or use thereof. Neither this reservation nor anything herein contained shall be construed as an assumption or acceptance by Grantor of responsibility for the construction,reconstruction, repair,or maintenance in a condition not dangerous or defective of any roadway or structure erected by Grantee or its assigns, within said easement area, except to the extent that such construction, reconstruction, repair, or maintenance is the proximate result of the negligence or intentional misconduct of Grantor or its agent.
