CC 03-17-2015 CUPERTINO APPROVED MINUTES CUPERTINO CITY COUNCIL Tuesday, March 17, 2015 SPECIAL CITY COUNCIL MEETING ROLL CALL At 4:30 p.m. Mayor Rod Sinks called the Special City Council meeting to order in Cupertino City Hall Conference Room A, 10300 Torre Avenue. Present: Mayor Rod Sinks, Vice Mayor Barry Chang, and Council members Darcy Paul and Gilbert Wong. Absent: Savita Vaidhyanathan. CLOSED SESSION At 4:30 p.m. Council went into closed session and reconvened in open session at 6:45 p.m. in the Cupertino Community Hall Council Chamber, 10350 Torre Avenue. 1a. Subject: Conference with Legal Counsel-Anticipated Litigation; Initiation of Litigation pursuant to paragraph (4) of subdivision (d) of Gov't Section 54956.9: One Case Mayor Sinks announced that Council authorized Cupertino to join an amicus brief request to be filed by the Town of Los Altos Hills subject to review with a cap on expenditure of$1,000. 1. Subject: Public Employment (54957) -Title: City Attorney Mayor Sinks announced that Council obtained a briefing and gave direction. 2. Subject: Public Employee Performance Evaluation (54957) - Title: City Attorney Mayor Sinks announced that Council gave direction to the City Manager regarding the City Attorney position. City Council Minutes March 17, 2015 COMMISSION INTERVIEWS 3. Subject: Interview applicants for the Technology, Information, and Communications Commission (TICC) Recommended Action: Conduct interviews and make appointments Council interviewed four individuals and appointed Keita Broadwater and Vaishali Deshpande to full terms ending January 2019. REGULAR CITY COUNCIL MEETING PLEDGE OF ALLEGIANCE At 6:45 p.m. Mayor Rod Sinks called the Regular City Council meeting to order in Cupertino Community Hall Council Chambers, 10350 Torre Avenue and led the Pledge of Allegiance. ROLL CALL Present: Mayor Rod Sinks, Vice Mayor Barry Chang, and Council members Darcy Paul and Gilbert Wong. Absent: Savita Vaidhyanathan. CEREMONIAL MATTERS AND PRESENTATIONS 1. Subject: Update from Captain Rick Sung regarding crime statistics Recommended Action: Receive the update Written communications for this item included a PowerPoint presentation. Captain Rick Sung gave an update on crime statistics via a PowerPoint presentation and answered questions from Council. Council received the update. City Cou cil Minutes March 17, 2015 POSTPONEMENTS 2. Sul'ect: General Plan Amendment (GPA) for changes to development allocations tha was originally noticed for tonight's agenda was re-noticed to April 21 Cit,r Clerk Grace Schmidt noted that the General Plan Amendment (GPA) for cha riges to development allocations originally noticed for tonight's agenda was re- noticed to April 21. Council received the notification. ORAL COMMUNICATIONS Peggy Gr'Iffin talked about issues with increasing student population and urged Council to think about long-term impacts of rezoning and community benefits. Darrel Lum talked about the 7 target opportunity areas in Cupertino regarding height, density, and setback requested by the property owners and asked Council for feedback regarding these target areas in the GPA. Stephen SI harf announced that the Cupertino Residents for Sensible Zoning had received its FPPC number, www.crszaction.or . He talked about Measure D from a few years ago in which residents voted no at that time to turn Vallco into a residential area. Robert McKibbin showed an organization chart of Cupertino noting that the City Council represents the residents of Cupertino. He talked about the upcoming GPA Council agenda item on April 21 and urged Council to consider the impacts on the schools and to listen to the residents. Arthur Lu showed a City Council score card he.had put together rioting-votes by past City Council members regarding development.in Cupertino. Liang-Fang Chao showed a PowerPoint presentation regarding over-capacity in the Cupertino)Union School District (CUSD). Alex Park, student from Monta Vista High School talked about his and another student's proposal go partner with the City to place garbage cans on the sidewalk along McClellan Road to help with littering issues. City Council Minutes March 17, 2015 Jon Willey talked about the online survey on the draft Community Benefits Program and how it pertains to building planes. He noted some of the residential comments and distributed a hard copy of the document he was referring to. Lisa Warren talked about the General Plan Amendment process and urged Council to not lose sight of the big picture. She mentioned a Los Altos City Council meeting which talked about a moratorium in that City and handed out information regarding that meeting. Stephen Hsieh talked about cars making illegal U-turns in the crosswalk on Torre Avenue. CONSENT CALENDAR Wong moved and Chang seconded to approve the items on the Consent Calendar with the exception of item numbers 9 and 10 which were pulled for discussion. Subject: Approve the March 3 City Council minutes Recommended Action: Approve the minutes 5. Subject: Accept Accounts Payable for period ending February 20, 2015. Recommended Action: Adopt Resolution No. 15-012 accepting Accounts Payable for the period ending February 20, 2015. 6. Subject: Accept Accounts Payable for the period ending February 27, 2015. Recommended Action: Adopt Resolution No. 15-013 accepting Accounts Payable for the period ending February 27, 2015. 7. Subject: Accept Accounts Payable for period ending March 6, 2015. Subject: .Notice of Intent to Vacate a Portion of the Cordova Road Roadway Easement, Along 10645, 10655, and 10665 Cordova Road Recommended Action: Adopt Resolution No. 15-015 to notice the public of the int int to vacate a portion of Cordova Road, and set a public hearing on April'7, 201 at 6:45p.m. Dir ctor of Public Works Timm Borden answered questions from Council. Ching moved and Wong seconded to adopt Resolution No. 15-015 to notice the pul�hc of the intent to vacate a portion of Cordova Road, and set a public hearing on (April 7, 2015 at 6:45p.m. The motion carried with Vaidhyanathan absent. 10. Subject: Update of Master Street Tree List Recommended Action: Adopt Resolution No. 15-016 to update the Master Street Tree List Written communications for this item included an email from Jennifer Griffin. Director of Public Works Timm Borden explained the item further and he and Assistant Director of Public Works Roger Lee answered questions from Council. Jennifer Griffin said that this item should not be under, the Consent Calendar because of its complexity. She also talked about chemical sprays being used successfully in other areas to control beetle infestation. Staff answered questions from Council: Paul moved and Sinks seconded to postpone the item to April 7. The motion carried with Wong abstaining and Vaidhyanathan absent. 11. Subject: Public Building Solar Installation-Service Center Recommended Action:Accept City.project 12. Subject: Sport Center Tennis Court Retaining Wall Replacement Recommended Action: Accept City Project SECOND READING OF ORDINANCES None PUBLIC HEARINGS—None ORDINANCES AND ACTION ITEMS City Council Minutes March 17, 2015 13. Subject: Consider cancelling meeting(s) in the summer Recommended Action: Provide direction to staff Council directed staff to bring this item back to a future Council meeting. Subject: Construction Project Update Report (Continued from March 3) Recommended Action: Receive Construction Project Update Report Written Communications for this item included a staff PowerPoint presentation. Director of Public Works Timm Borden gave an update report on construction projects via a PowerPoint presentation. Council received the presentation. City Manager David Brandt reported that Cupertino won the first place award for its Block Leader program. He noted that the program has been around for at least a decade and helps to advance diversity in the community. A picture was shown of Council member Wong and the program manager Laura Domondon Lee receiving the award at the National League of Cities conference. 15. Subject: Report on Committee Assignments Recommended Action: Report on Committee Assignments Council members highlighted the activities of their committees and various community events.
