CC Exhibit 05-05-15 (Closed Session) Item No. 2 Conference with Legal Counsel CC slslts- z Karen B. Guerin C-D Qt &K From: Lyn Faust <lynfaust@yahoo.com> Sent: Tuesday, May 05, 2015 3:18 PM To: City Council Subject: Lehigh Southwest Cement Co. Mayor Sinks and Fellow City Council Members, As a long time Cupertino resident (since 1973), 1 have been concerned about and involved with Quarry/Cement Plant related.issues in our community. During the 1990s, I, and other concerned residents, worked with the Cupertino City Council (CCC), most especially Mayor Don Burnett, to help the Voss/Stevens Creek Quarry come into compliance with a variety of air/water quality issues. Not only was the City very supportive, but the Santa Clara County Board of Supervisors was as well. The results were impressive and I have praised that Quarry for their turn around. More recently; when the previous City Council was approached and asked to lend their support for an Amicus Brief dealing with concerns about Lehigh's operations, I, and many others, were extremely disappointed in the lack of support by our Council. While this business resides in the County and not our City, and was grandfathered in since it's existence preceded Use Permits, it IS in our backyards and we breathe unhealthy air as a result of their operations. Neighboring cities around us lent their support to that effort. I found it embarrassing that as a City we didn't step up at that time. We do seem to see progress in minimizing the pollutants from such operations when pressure is brought to bear on the entities involved. While I am disappointed to find out so late that this item will be discussed in Closed Session this evening, I am encouraged that further discussion will ensue. I am hopeful that you will do right for our residents and will lend the support needed to help both the business and community members cooperate to achieve the highest health standards possible going forward. WE LIVED IN THE LOST ALTOS AREA FOR OVER 40 OF THOSE YEARS. WE NOW LIVE IN CUPERTINO AT RANCHO DEEP CLIFF AND HAVE BEEN HERE FOR OVER TWO YEARS. WE HAVE NEVER SEEN DUST AND DIRT LIKE THIS EVER. YOU CAN WRITE YOUR NAME ON TABLES AND FLOORS AFTER TWO DAYS IF YOU . DON'T DUST EVERY DAY. I BREATHE THIS SAME AIR AND I AM CONSTANTLY CLEARING MY THROAT. I HAVE TO THINK-THIS IS AN UNSAFE ENVIRONMENT. LEHIGH OBVIOUSLY HAS DISREGARDED THE LOCAL ENVIRONMENT AS EVIDENCED BY THEIR RECENT FINE OF OVER FIVE MILLION DOLLARS. THE TRUCKS ARE ANOTHER ANNOYANCE AND SAFETY HAZARD AS THEY WHIP UP AND DOWN STEVENS CANYON ROAD. ALL THE SEWERS ON THE ROAD AND THERE ARE MANY ARE DEPRESSED AND HITTING THEM FEELS THE SAME AS A LARGE POTHOLE. THE ROAD HAS NOT BEEN REPAIRED SINCE WE HAVE LIVED HERE. THIS WOULD BE A GEAT PLACE TO LIVE IF WEREN'T FOR THE QUARRY AND LEHIGH. SINCERELY, STEVEN AND DONNA HICKS 10933 CANYON VISTA DRIVE CUPERTINO, CA 95014 408 352 5202 SHICKSVINEgAOL.COM i
