Teriyaki Experience
In June 2008 we spent$300,000.00 to start our fast food business Teriyaki
Experience in Vallco Mall (Cupertino).When we signed the lease our rent was $7,500.00.
The total lease was for 20 years: 10 years with two 5 year optional additions.Also, when
we signed the lease, the mall management manager, Mr. Mike Rohde, promised us that
there would be 90% occupancy in the Food Court and that the mall would be filled with
stores to attract business.
Then he said they would give us six months rent-free. This was in January 2009, but the
management never gave us six-month free rent.And they promised us that the Food Court
would be full of other restaurants,which never happened. We started the business in
January 2009, paying$7,500.00 in rent and after 2 to 3 months passed by we saw the mall
was very slow with little customers coming to this mall.
Then we asked him what's going on with all the false promises you made, we asked him to
do something about this because we cannot afford this much rent in a dead mall.And the
Food Court was empty, only 5 to 6 restaurants occupied the mall, and very few new stores
had opened.
Only on the weekends did we see a little business, with the rest of the week being very
slow.When we continually asked why no other restaurants were occupied, he said he
would lower my rent.
Mr. Rhohe amended the original lease with a lower rent every year. The original term of the
lease,which was 20 years in total,was never changed over the years.
At one time, there were concerts for seniors or childrens' events hosted in the Food Court.
People who participated in the events would stay to walk around, dine and shop. These
events brought customers. But they have stopped hosting any event for a long time.
Fortunately,the AMC and 3 anchor stores still brought in some customers. Over the years,
we have established a good customer base and the business is.good.We are slowly paying
off our$300,000 loan to start this business.
In March 2014, my husband had a heart attack and passed away. I have two teenage sons. I
am the only one left to work to feed and educate my sons. Since Teriyaki Experience is
earning good income then, I decided to quit my job of 10 years at nVidia to work full-time
at the shop. Now I have no other source of income and am still paying off the $300,000 loan
for Teriyaki Experience.
In June 2014,after 3 months of my husband's death, Mr. Mike Rohde the manager of Vallco,
came to me and gave me a paper sign to lower the rent, not at my request. I signed it. The
document is a new one-year lease and it canceled the original lease,which has a term of 20
years.
I did not know at all that someone wants to buy Vallco and tear it down until much much
later. However, Mr. Mike Rohde is actively working with the broker sell the mall.We later
found out in a youtube video.And it says that they have been working on this deal for two
years. I did not know that.
Then again Mr. Mike came to me in June 2015 to sign the papers, saying he would give me
one-year of free rent, but I refused. He said I will only charge you$1 rent
per month from July 1.2015 to Dec 31.2015 and also will give you back the$6,000.00 you
paid me in rent from January 1st 2015 to June 31.2015, but I refused. I told him I spent
$300,000.00 on this store and you are only giving me $6,000.00 back. I don't want this
unfair deal.
Then he got furious with me and gave me a 30 days' notice to close down and leave. I told
him if you give me money, then I can survive and feed my family or else I'm not going
anywhere because I have no other income.
Come July end,he came and said we cannot give you any money because you don't have a
lease. I told him you forced me to sign the lease and threatened me if I don't sign you will
kick me out on July 31. 2015. Then you gave me a notice to empty the store by December
31.2015. I was helpless because my English is not good and I had recently lost my
husband.
I told him if you put your life in my shoes, then you will know the true struggles of life. I am
the one who knows how hard it is to live without a husband and without any source of
income with two kids. I requested you so many times to help me but you deceived me by
replacingin my 20-year lease with one-year lease.
Mr. Mike Rhode tricked me into canceling the 20-year lease after my husband's death,
when he knew that Vallco will be torn down in one year. Now, Sand Hill is not willing to
compensate me because I have no lease. I will lose the $300,000 store that we invested in.
I went to the City Of Cupertino council meeting and explained everything because I don't
have any money to hire a attorney to fight this case against Sand Hill. I just want Sand Hill
Property to help me relocate or reimburse me so that I can pay my loan balance or move
onto some other location.
