RESOLUTION NO. 04-234 DRAFT A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO ALLOWING CERTAIN CLAIMS AND DEMANDS PAYABLE IN THE AMOUNTS AND FROM THE FUNDS AS HEREINAFTER DESCRIBED FOR GENERAL AND MISCELLANEOUS EXPENDITURES FOR THE PERIOD ENDING DECEMBER 05, 2003 WHEREAS, the Director of Administrative Services or her designated representative has certified to accuracy of the following claims and demands and to the availability of funds for payment hereof; and WHEREAS, the said claims and demands have been audited as required by law. The report includes all funds in control of the City. Investments The market value of the City's current portfolio totaled $37.4 million at November 30, 2003, with a maturity value of $37.3 million. The City intends to hold investments until maturity to redeem full value of the securities plus interest earnings up through the maturity date. Short-term agency yields remained relatively stable in November. The Local Agency Investment Fund (LAW) yielded 1.572% compared to October's 1.596%, and 2.301% a year ago. The City's portfolio as a whole yielded 2.44% in November. Several of the City's investments in short-term callable federal agency notes were called as yields waned briefly; these were replaced with similar investments of slightly longer duration. As a result, the average length to maturity of the City's portfolio will increase slightly and the investment yield should level out. Although currently stable, it is anticipated that interest rates will rise at a moderate pace for the next several months. Overall, the City's current investment portfolio decreased approximately $1.1 million in November, as planned expenditures exceeded incoming revenues. Although the State has resumed disbursements of the Vehicle license fee (MVLF), remittances are only one-third of the budgeted amount. If this revenue is not backfilled, the total loss in MVLF to the City for the fiscal year is nearly $2.4 million. In December, a $2.8 million draw will be made on the City's bond proceeds account to reimburse the General Fund for Library/Civic Center Project expenditures. In addition, investments have been laddemd to maturity dates that will allow for the projected cash flows required for the library and other capital projects. The investments of the City of Cupertino are in full compliance with our City investment policy and/or State law, and are tiered to adequately provide the City with sufficient cash flows to pay its obligations over the next six months. Revenue/Expenditure Trends In addition to the withdrawal of "backfill" for vehicle license fees, sales tax revenues also declined last month, as the Bay Area continues to experience the affects of the technology-based recession. As mentioned, declining yields on the City's portfolio are not helping the revenue stream. With the backdrop of a 13.4% decline in General Fund revenue, operating expenditures have decreased almost four percent from this time last year. Departmental spending to date is consistent with the 2003-04 operating budget. However, a midyear analysis and recommended budget adjustments will be submitted to the Council early in 2004. RECOMMENDATION: Staff recommends that the City Council initiate reorganization proceedings for the territory designated Monta Vista 02-07, and set a public hearing date of February 2, 2004. BACKGROUND: Annexation Strategy_ On February 2, 1998, the City Council adopted an overall annexation strategy for three of the larger unincorporated pockets in Cupertino: Rancho Rinconada, Garden Gate and Monta Vista (Exhibit C). Subsequently, Rancho Rinconada and Garden Gate neighborhoods were successfully annexed. A proactive incremental annexation strategy was recommended for Monta Vista in 1998 because of overwhelming negative sentiment about annexation. An informal postcard survey cgnducted in 1997 showed residents and property owners against annexation at a ratio of 7 to 1 (16 respondents). In late 2002, the City & County distributed a Monta Vista Annexation Answer Book, held a neighborhood meeting and conducted a new postcard survey of City and County residents in Monta Vista with dramatically different results as described below. Based on the survey results and input from the neighborhood meeting, staff believes a comprehensive annexation of the entire pocket would have a high probability of success. Public Outreach In late 2002, staff conducted extensive outreach with Monta Vista property owners and residents, which included: A) The mailing of the "Monta Vista Annexation News" in early October 2002; B) The mailing of the "Monta Vista Annexation Answer Book" in late October 2002; C) A City-sponsored neighborhood meeting at the Quinlan Center on November 7, 2002; D) A web page on the City of Cupertino's website that provides information on upcoming meetings, answers to commonly asked questions, and documents on-line; and E) Attendance at resident-sponsored neighborhood meetings. DISCUSSION: Ci~_ Taxes and Fees In consultation with the City Attorney and in reliance on a legal opinion of the State Attorney General, the City will be conducting a proceeding similar to the Garden Gate reorganization in 2001. The City will not hold separate elections on the extension of City taxes to this area. Monta Vista residents and property owners will be fully informed of the extension of City taxes and fees to their area in the annexation public hearing mailer. The requirements of Proposition 218 (Taxpayers Right to Vote on Taxes Initiative) will be satisfied by the protest provisions available in armexation law, that is, legal protests to the Monta Vista annexation serve as proxy votes on the extension of City taxes to this area. Next Steps The next steps in the Monta Vista annexation process are as follows: Jan. 5, 2004 City Council initiates proceedings; protest period begins. Feb. 2,2004 City Council holds reorganization hearing. If less than 25% protest, then the Council orders the change in reorganization (i.e., approve the annexation). If protests are greater than Monta Vista 02-07 Reorgardzation January 5, 2004 Page 3 25% but less than 50%, then the Council must schedule an election. If more than 50% protest, than the reorganization is terminated. OR Est. late Feb., 2004 Under State "island annexation provisions," the City Council may, alternatively, order the annexation of the territory without an election. Historically, the City has not conducted island annexation proceedings, and it is doubtful the City could extend City taxes to such an area so annexed without a legal challenge under Proposition 218. If the Council is able to order the change of reorganization, the Local Agency Formation Commission (LAFCO) executive officer should have certified the proceedings, making the annexation official. WHEREAS, the County Surveyor of Santa Clara County has found the map and description (Exhibits "A" and "B") to be in accordance with Government Code Section 56757(c)(2), the boundaries to be definite and certain, and the proposal to be in compliance with LAFCO's road annexation policies; and WHEREAS, the County Assessor of Santa Clara County has found the boundaries of the proposed reorganization described in the aforementioned map and description conforming to lines of assessment or ownership; WHEREAS, the fee set by the County of Santa Clara to cover staff cost for above certifications have been paid; and WHEREAS, the reorganization does not create islands or areas in which it would be difficult to provide municipal services; and WHEREAS, the reorganization is consistent with the adopted general plan of the City and its adopted annexation strategy for urban pockets; and WHEREAS, the city has complied with all conditions imposed by LAFCO for inclusion of the territory in the urban service area of the city; and WHEREAS, as provided in Government Code Section 56757 the City Council of the City of Cupertino shall be conducting authority for a reorganization including an annexation to the City; and WHEREAS, the conducting authority recognizes under Government Code Section 56375.3, it may order an annexation of the territory without an election; Principle #1: All of the residents within the three pockets should have an opportunity to 'annex. - Principle #1 is recommended in recognition of the fact that annexation opportunities such as those currently available are a very rare occurrence. Consequently, these opportunities should be afforded to all residents within the three pockets that have been the focus of this special joint City/Cohnty study. Principle #2a: Annexation of pockets should result in logical City boundaries which are easy to service. Principle #2b: Annexation of Garden Gate and Rancho Rinconada should generally occur in large, contiguous blocks and not on a piecemeal basis. Parcel-by-parcel annexation should only be considered by the City when it results in logical City boundaries which are easy to service and does not create additional pockets. Principles #2a and #2b expresses the previous City Council's desire to not follow the incremental Monta Vista model in conducting annexations. The fragmented, confusing and inefficient system of government service responsibilities these checkerboard annexation patterns create has ongoing, adverse consequences for the community, the City, the County and other service providers. These adverse consequences will continue for decades until the entire pocket has been annexed. Residents and property owners suffer under such conditions since there is no single local government to which they can mm to address the concerns and needs of their neighborhoods. With checkerboard annexation patterns, even simple, local problems may require coordinated, interjurisdictional action disproportionate to the magnitude of the problem. Parcel-by-parcel annexations in Garden Gate and Rancho Rinconada should be carefully scrutinized for their longer-term effects. Staff feels a piecemeal approach to annexation is only warranted under special circumstances and under certain conditions. For example, annexing a pocket area to ensure that the redeveloping use is consistent with the City's general plan land use policies. This situation is applicable to: 1) the unincorporated section of the Stevens Creek corridor in Rancho Rinconada which is developed with numerous older, single-family residences, but is planned for nonresidential or higher density residential in the City; and 2) the county- commercially zoned properties in Garden Gate (Party America site) which has been planned fur a low density residential use or a public/quasi-public use in the City for more than a decade. that notices be sent to the other pocket residents inviting them to piggy-back on the annexation at no cost to them. In addition, the City could agree to waive its annexation fees and pay the · County fees (about $2,700 total) if the annexing property owner could persuade sufficient pocket neighbors to also annex to the City. The pros and cons of this approach can be discussed in detail at a subsequent City Council meeting. 2. Conduct City-Initiated Annexation Hearings at No Cost to Property Owners Throughout th~ public outreach process over att past six months, it has been emphasized that there would be no costs to pocket residents if they annexed in conjunction with a city-initiated process: Most costs are fixed and not geared toward the size of the annexed territory. Rec6mmended Specific Annexation Procedures Rancho Rinconada City_Initiated AnneXations a. Since residents have already expressed a strong interest in annexation, hold City-initiated prezoning and annexation hearings for the entire area at no cost to property owners. b. If an election is required and annexation of the entire area fails, then examine if there was strong support in a sub-area contiguous to the City and annex that portion at a later date. (Note: State law requires the City to wait one year before bringing back a proposal to annex any or all of an area where annexation was rejected by the voters.) 2. Property Owner-Initiated Annexations (including development-related annexations) a. No provisions should be made for parcel-by-parcel, property owner-initiated annexations in Rancho Rinconada, except for areas prezoned "P" where annexation is a requirement of redevelopment. b. Properties in unannexed areas are allowed to developed in the County under County development standards. Garden Gate City-Initiated Annexations. a. If the Rancho Rinconada annexation is successful, encourage Garden Gate residents to petition for annexation, then initiate prezoning and annexation of the entire area or in logical, contiguous blocks at no cost to property owners. 2, Property Owner-Initiated Annexations (including development -related annexations) a. No provision should be made for parcel-by-parcel, property owner-initiated armexations in Garden Gate, except to ensure that redeveloping uses are consistent with the City's General Plan policies, the annexation creates logical, contiguous, service boundaries and does not create additional p6ckets. Send invitations (with a return postcard) to all property owners inviting them to indicate their desire to be annexed (or not to be annexed). Based on responses, City should conduct annexation proceedings for those pockets or portions of pockets where a majority (silent and favoring) exists, at no cost to the property owners. Property Owner-Initiated Annexations (including development-related annexations) a. For those parcels not annexed during this process, annex them as they are developed or as future owners request annexation. Invite pocket neighbors to piggy-back on applicant- annexation at no cost to the neighboring property owners. b. As an alternative, the City will waive its annexation fee and pay County and state annexation fees'if the applicant persuades a sufficient number of pocket property owners to annex their properties with the applicant. c. City staff should work with County staff to devise additional County-implemented inducements to annexation. RECOMMENDATION: Staff recommends that the City Council: 1) Endorse the described annexation strategy for the Cupertino unincorporated pockets of Monta Vista, Garden Gate and Rancho Rinconada and that strategy include the following elements: A. BACKGROUND On February 18, 2003, City Council authorized the City Manager to execute an Interim Agreement with Ricochet Networks, Inc. (RNI), for the payment of power costs for the pole top radio repeater equipment in City right-of-way that was abandoned by Metdcom upon Metricom's bankruptcy. This agreement expired on May 31, 2003 with a provision to renew the agreement for an additional period of four months with the mutual agreement of the parties. On June 16, 2003, City Council authorized the City Manager to execute a Renewal Agreement for the Interim Agreement with Ricochet Networks, Inc. (RNI). This agreement will expire on September 30, 2003. On September 15, 2003, City Council authorized the City Manager to execute a second Renewal Agreement for the Interim Agreement with Ricochet Networks, Incl. (RNI). This agreement expired on December 31, 2003. The City would like to renew the agreement for an additional five months with an expiration date of May 31, 2004. During this time the City will continue to negotiate with RNI to take over the former Metricom system in our jurisdictions for their use. At the end of this time, the City will either have negotiated a satisfactory long-term agreement with RNI, or Public Works will disconnect and remove the equipment. RECOMMENDATION: Staff recommends that the City Council take the following action: 1. Approve the gateway design as shown in the plan set. BACKGROUND On December 4, 2000, the City Council approved a Use Permit to allow two new buildings at the Marketplace shopping center. A one-story building was proposed at the southeast corner of Stevens Creek Boulevard and Portal Avenue, which is nearly complete. A two-story building was proposed at the southwest comer of Stevens Creek Boulevard and Perimeter Road. The construction of that building will start in early 2004. As a condition of approval, the City Council required the shopping center to design, install and maintain a neighborhood gateway on South Portal Avenue where the existing "chokers" are. The gateway must be constructed and landscaped prior to occupancy of the new buildings in the shopping center. The applicant sent out conceptual designs to the neighborhood in 2001, which had the name Wilson Park. A number of residents called in response to the handout stating that it should be named Williston Park, reflecting the neighborhood name. After a delay in construction due to litigation between the shopping center and a tenant, a final draft design was sent out to the neighborhood in the fall of 2003, this time with the name Williston Park. DISCUSSION Gateway Name The naming of the feature has been an issue with the residents. When the feature was named Wilson Park, residents responded in support of Williston Park. Likewise, when the feature was named Williston Park, different residents stated they preferred Wilson Park. South Portal Avenue Gateway Feature 2 WiIliston Park The majority of the neighborhood is part of the Wflliston Park subdivision in 1967. Other neighborhoods in the City have used the subdivision name as the de facto name of the neighborhood. Examples include: Fairgrove, Oak Valley, Monta Vista, Inspiration Heights, Linwood Acres, Garden Gate and Rancho Rinconada. Wilson Park Wilson Park is located adjacent to the Williston Park subdivision. Many residents consider Wilson Park as the defining feature of their neighborhood. Also, because there is such a strong similarity between the subdivision name and the park's name, there may be potential confusion if the gateway is named after the subdivision. Without a clear majority in support of either name, staff recommends that the gateway not have a formal name. The enclosed plan set does not have a formal name, but does have a small plaque with the name of the subdivision (Wiiliston Park) and a note showing the gateway was donated by the shopping center. Gateway Design Though there is not agreement on the formal naming of the gateway, the residents expressed support for the design. Originally, a crosswalk was not part of the design, but based on the residents' input, it is now in the final draft. Only one resident ' contacted staff in opposition to the gateway; Mr. Eugene West of 10208 Cold Harbor Avenue is opposed to the existing chokers and believes they should be removed. Maintenance and Liabili _ty The center's management accepts responsibility for routine maintenance, but is concerned with taking responsibility for liability in cases of accidents. When the City Council approved the project on December 4, 2000, it was with the understanding that the City would not be responsible for any aspect of the gateway. BACKGROUND At this time, Fine Arts Commission is the only city commission created by ordinance that has seven members; all others commissions have five or fewer. Recently, Commissioner Rita Young moved out of the area, and resigned her position. A few months later, Commissioner David Kim also resigned because he was assigned to a project out of state. Vacancy notices were posted and noticed in the news media, so the City Council can fill both of those positions during the commission interviews scheduled for January 12 and 13. However, the City Council may wish to take this opportunity to reduce the commission size, since it can be done without removing a seated commissioner. The Fine Arts Commissioners have enjoyed participating in a larger group, but have indicated that they would understand mad accept the Council's action if the size were reduced. A smaller commission may have less difficulty in achieving a quorum, and encourages all of the members to participate fully in the group's work. Also, the Fine Arts Commission has traditionally been one of the commissions for which there are few applicants. PUBLIC PRESENTATIONS There were no Public Presentations. Presentation on the History of the Current Board Structure Michael Evanhoe, Chief Development Officer, reviewed the events that led to the formation of VTA, beginning with legislation in 1989. He stated that near the end of the 1980's, policy makers and the public throughout the state agreed that the state's transportation problems had to be solved in order to maintain California's economy and quality of life. At the same time, it became clear that adding more lanes of roadway could no longer be the only solution for relieving traffic congestion. The Legislature decided that a new, multi-modal approach was needed and that the land-use decision-making process needed to address transportation and air quality impacts. This new approach was embodied in the state legislation entitled the Traffic Congestion Relief and Spending Limit Act (Proposition 111) and brought the most significant change to the state's transportation planning process in over a decade. With the passage of Proposition I 11 came the requirement that urbanized counties create or designate a congestion management agency (CMA). As the CMA of Santa Clam County, the CMA is responsible for preparing and implementing annual congestion management programs (CMP's). This merger created a special district responsible for bus and light rail operations, congestion management, specific highway improvement projects, a_nd countywide transportation planning. As such VTA is a transit provider and a multi modal transportation planning organization. He introduced three former elected officials who worked to create the merged organization and the current Board structure: California Transportation (CTC) Commissioner Diane McKeuna, former Supervisor, Santa Clara County Board of Supervisors; Shirley Lewis, former Council Member, City of San Jose; and Joarme Benjamin, former Council Member, Town of Los Gatos. Commissioner McKenna informed the Committee that an original intent was to link land use and transportation for efficiency in decision-making and maximum use of resources. She noted the cities, including the County of Santa Clara, were organized into five groups that linked communities of interest together as it was important not to dwarf the small cities and expressed concern that the City of Milpitas' proposal may so do. Commissioner McKerma also cautioned, based on her experience, that the physical size of a governing board will seriously hamper its ability to conduct business. Ms. Lewis added that the creation of VTA, to address the transportation needs of Santa Clara County, also gave the County better vision for land use opportunities. She stated VTA AD-HOC RESTRUCTURING PROPOSAL COMM1TrEE Page 2 of 4 September 4, 2003 o the composition of the Board of Directors was developed to give way to a positive atmosphere for decision-making. Another significant factor in the final composition of the VTA Board of Directors was the compromise with then Mayor Tom McEnery, who was concerned about San Jose's equitable representation in relation to population throughout the County. Ms. Benjamin stated that the city groupings were expected to communicate among their membership and discuss issues of interest going to the VTA Board of Directors. Member Williams took his seat at 4:41 p.m. Commissioner McKerma stated that she sees the current two year Board Member term as a detriment to continuity and discussed the value of longer terms on the VTA Board of Directors. Transportation issues are complex she noted, particularly with the myriad of local, regional and federal issues incorporated into the decision making process. She encouraged consideration of longer terms to maximize representation. City of Milpitas' Proposal to Restructure the VTA Board of Directors The Committee discussed the proposal submitted by the City of Milpitas (Milpitas Proposal) and the desire for representation on the VTA Board of Directors to be part of the decision making process. The discussion included the need to evaluate and understand the consequences of the Milpitas Proposal. Chairperson LaPoll acknowledged Morgan Hill Mayor and Policy Advisory Committee (PAC) member Dennis Kennedy who stated that his city grouping includes the City of Gikoy and the City of Milpitas. Mayor Kennedy discussed his experience with the current Board composition and noted it had not worked well to have one representative from his city grouping on the Board of Directors. He concluded his comments stating he supported the Milpitas Proposal as it gives everyone a seat at the table. Chairperson LaPoll acknowledged Palo Alto Council Member and VTA PAC Member Yoriko Kishimoto who supports the restructure of the VTA Board of Directors to include a tr~ giving the transit user a direct voice in the decision making process. Council Member Kishimoto noted the PAC has not discussed the Milpitas Proposal or any proposal to restructure the VTA Board of Directors. Ms. Cindy Maxwell, City of Milpitas responded to the committee stating the City of Milpitas' motivation is to simply have a voice and to actively participate in the decision making process on the VTA Board of Directors. She added the City of Milpitas would be open to other proposals that would allow everyone an oppormrfity to participate in the decision making process at the Board of Directors' level. The Committee agreed with Commissioner McKerma's comments concerning the size of the Board of Directors and expressed concern about increasing the Board of Directors' membership, noting potential gridlock in the decision making process and abihty to conduct business due to quorum considerations. First St. Campbell, CA 95008 Dear Mayor Furtado and Campbell City Council: The Santa Clara County Valley Transportation Authority (VTA) is currently faced with critical decisions that will significantly impact the quality of life in every community throughout the County and the economic vitality of the Silicon Valley region. Each and every one of the residents and businesses located in your jurisdiction will experience the impacts of increased fees, reduced services and a slow down in completing transportation construction projects. Due to the organizational structure of the VTA Board, these critical decisions are being made without the direct participation of all member jurisdictions. Currently, there are nine cities that do not have a voting seat on the Board of Directors. Though Milpitas appreciates the work of other jurisdictions who represent us on the Board, it does place an unequal burden of responsibility on those who may not be familiar with our jurisdiction's concerns and issues. As indicated in the attached City Council Resolution, the City of Milpitas requests that a formal public discussion of the VTA Board structure be initiated by our fellow Santa Clara County jurisdictions. ORDINANCE NO. 1926 DRAFT AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING CHAPTER 17.32 OF THE CITY'S ORDINANCE CODE REGARDING TEMPORARY SIGNS WHEREAS, the City of Cupertino has previously banned temporary signs from the public right-of-way for purposes of preventing visual clutter and minimizing liability concerns; and WHEREAS, there are temporary events, such as, festivals, garage sales, elections and residential open houses of importance to the community, neighborhoods and residents that rely on temporary signs to provide information and directions for potential participants; and WHEREAS, these temporary events are primarily in residential and institutional districts that do not have the public exposure and permanent signs found in commercial districts; and WHEREAS, these temporary events do not need permanent signage, but it is in the interests of the City of Cupertino to allow temporary signage for the reasons aforementioned; and WHEREAS, there are locations in the public rights-of-way where temporary signage of limited size and quantity should not obstruct the safe passage of vehicles and pedestrians, not obstruct handicapped accessibility, not interfere with public signage and utility structures, and not obstruct sight lines for comer triangles or driveway site triangle; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CUPERTINO HEREBY ORDAINS AS FOLLOWS: 1. Amendment Chapter 17.32 of the City's ordinance code is hereby amended to read as follows: § 17.32.010 Temporary Signs--- LOCATION. A__tL. No person shall paint, mark, or write on, post, attach or otherwise affix, any temporary sign to or upon any public property, sidewalk, crosswalk, curb, curbstone, fence, wall, public playground equipment and/or facilities, street lamp post, hydrant, tree, shrub, tree stake or guard, railroad bridge or crossing, pole for electric light or power or telephone or telegraph (or other communication service) or upon any fixture of the fire alarm or police telegraph system or upon a lighting system, public bridge, drinking Ordinance No. 1926 Page 2 fountain, street sign or-traffic sign, traffic control pole or cabinet, utility transformer vaults, or any other building, structure or device permanently affixed on public property. Additionally, no temporary sign shall be placed, posted or otherwise affixed in the public fight- of-way, except as provided in this section. Notwithstanding any provision to the contrary described in Section 17.32.010(A) above, temporary signs may be placed upon the public right-of-way as prescribed in the subsection below: 1. Shall only be located in the public right-of-way of a residential or institutional district, as defined in this Title. 2. Shall be no larger than four square feet of sign area per sign side with no more than two sides per sign. 3. Shall be no more than three feet tall measured from the grade of the sidewalk or adiacent ground level. 4. Shall have a maximum length of any part of the sign of three feet. C. Unless otherwise provided for in this chapter, all temporary signs, whether or not located in the public right-of-way: 1. Shall not be located on the street or on street medians. 2. Shall not be illuminated. 3. Shall not be located on private property without the oral or written consent of the owner or other person entitled to possession of said property. 4. Shall maintain at least 36 inches of clear and continuous width along a sidewalk or pathway plus any other area needed for handicapped accessibility. 5. Shall not restrict in any way the safe vision of any vehicular or pedestrian traffic or obstruct any directional or safety sign or other sign permitted by the City. 7. All parts of the sign shall be set back a minimum of eighteen (18) inches from the face of the curb or from the edge of the street, bicycle or vehicle travel lane, whichever is the greatest distance from the edge of the street, bicycle or vehicle travel lane. 8. The temporary signs in the public right-of-way other than political signs shall be removed by sunset. D. Persons who place temporary signs in public rights-of-way are encouraged to notify and seek concurrence of adiacent property owner(s) and resident(s) before placing temporary signs. E. The provisions of Section 17.32.010(B), (C) & (D) shall not be applicable to the following: Ordinance No. 1926 Page 3 1. Special-event flags and streamers may be permitted on a temporary basis in all commemial districts in conjunction with a grand opening or special promotional activity. Flags will also be permitted in residential zones to identify model homes which are part of a new development. B. No special-event flag may be higher than 20 feet above ground level. C. No more than two flag poles shall be permitted for each model home for a maximum of one year. D. The number of flags or streamers permitted for a commercial activity shall be subject to the approval of the Director in conjunction with a comprehensive plan for the special-event promotion. Flags and streamers may be permitted for a two-week period. E. Special event flags or streamers shall be completely removed not later than five days after the special event to which they pertain is scheduled and are otherwise governed by the provisions of ~ 17.32.090. § 17.32.030 GARAGE SALE SIGNS. A. Signs advertising a bona fide garage sale activity, as defined in Chapter 5.16 of this municipal code, shall be permitted which are less than eight square feet in area and six feet in height. These signs are to be located on the property where the sale is being conducted. B. Three additional garage sale signs may be allowed in the public right-of-way in accordance with the restrictions stated in Section 17.32.010.s~w res ~ 17.32.9!0B ~,-".d C. A. New projects under construction, including subdivisions of five units or more, may be permitted signs which state the name of the project and/or the contractors and developers involved with its construction. The signs shall be subject to the approval of the Director. B. No more than two freestanding signs containing the name of thc project, the owner, address and telephone number, leasing information, dates of anticipated completion and a listing of thc contractors involved in the project are permitted for each project. C. Each sign shall be no larger than 32 square feet per side and no taller than six feet in height. D. Projcct announcement signs may be permitted for a maximum of one year or until all of thc units arc sold, whichever comes first. Extensions may be granted by the Director if the project has not been completed. § 17.32.060 RESIDENTIAL REAL ESTATE SIGNS. A. Subject to the restrictions contained in [ 17.32.010, real estate signs shall be permitted in all zones for the purpose of announcing house sales, rentals and open houses. B. On-Site Requirements. Each parcel with a unit for sale or rent is permitted one sign per street frontage, with a maximum of two signs per parcel. Only one sign may Ordinance No. 19~6 Page 5 be building-mounted. Each sign is limited to four square feet per side. Freestanding signs shall not exceed six feet in height and shall be subject to the requirements stated in: 17.32.010. C. Off-Site Signs Announcing House Sales or Rentals. Signs located off-site announcing house sales or rentals are subject to the same requirements as on- site signs, as stated in division (B) above and ~ 17.32.010. D. Off-Site Open House Signs. Each parcel with a unit for sale is permitted a maximum of tbxee si~x open house signs subject to the requirements stated in ~ 17.32.010. § 17.32.070 SALE, RENT OR LEASING SIGNS. A. Sale, rent or leasing signs shall be permitted in all zones except residential zones. Signs for residential zones are stated in ~ 17.32.060. B. The signs may include the name of the real estate agent or owner, the address, phone number and any other pertinent information. C. Each parcel shall be allowed to display one sale/rent/lease sign on each public street frontage. Each sign face shall be limited to 32 square feet, with a maximum of two faces per sign. Each sign shall be limited to a height of six feet. "V" shaped signs are prohibited. D. A building mounted sale/rent/lease sign me.y be used in lieu of a freestanding sale/rent/lease sign. One building mounted sign may be placed on each building elevation facing an adjacent public street; provided that, a freestanding sale/rent/lease sign as described in division (C) above is not displayed concurrently on that public street frontage. The sign shall be restricted to 32 square feet of face area and shall be located and displayed in accordance with the provisions of ~ 17.24.080 of this title regarding clearance, obstruction and roof-line line level. E. Signs for purposes of sale, rent or lease shall be permitted for display off site. Display of off-site signs shall be confined to private property, subject to the approval and cooperation of the property owner upon whose property the off-site sign is to be located. The off-site signs shall be limited to one sign per street frontage, with a maximum of two signs per off-site parcel. The off-site signs shall have a maximum of two faces, and shall not exceed 32 square feet in area per face, nor exceed a height of six feet. The location of the off-site signs is subject to ~ 17.32.010. F. (1) For sale/rent/lease signs may be installed up to 30 days prior to any tenant vacancy. (2) Inunediately following the close of sale, rent or lease of the space or building the sale, rent or lease sign shall be removed. G. For sale/rent/lease signs may not reasonably obstruct the visibility of any permanent ground sign. § 17.32.080 SUBDIVISION DIRECTIONAL SIGNS. A. Subdivision directional signs for developments within the city may be permitted in all zones other than residential, to direct customers along the most direct route through the city. Subdivisions not in Cupertino shall not be permitted subdivision directional signs. Ordinance No. 1926 Page 6 B. A total of three such signs per subdivision shall be permitted within the city as determined by the Director. C. Each sign shall not exceed six feet in height and 32 square feet in area and have no more than two sign surfaces. "V" shaped signs are prohibited. D. The signs may be permitted for a one-year period or until all units are sold by the subdivision developer, whichever comes first. Extensions may be granted by the Director if the project has not been completed. E. The location of subdivision directional signs shall be subject to 5 17.32.010. F. Applications for subdivision directional signs shall include a list of all other existing signs for the same subdivision, indicating the sign surface area and street location of each sign. § 17.32.090 TEMPORARY AND SPECIAL EVENT SIGNS AND PROMOTIONAL DEVICES. The Director may issue a permit for temporary special event signs, banners, pennants or balloons and promotional devices in all commercial, industrial, office or institutional districts subject to all criteria set forth in this section. A. (1) Each business may be permitted use of one temporary special event sign subject to the tenant schedule in divisions (C) and (D) below. Each business may have the use of temporary signs for a maximum of 120 days in a calendar year, but not to exceed 30 days during any permitted period. Each business may be granted a maximum of 12 permits in a calendar year. A minimum period of two weeks shall be required before a subsequent permit is granted. (2) One additional temporary sign and one additional promotional device may be allowed during the first year of operation for a new business entity for purposes of announcing the grand opening of the business entity. (3) A portable freestanding temporary sign shall not exceed six feet in _height and 32 square feet per face, with a maximum of two faces. Portable temporary freestanding signs, such as A' frame or sandwich board signs, may not be set into the ground and must be removed at the close of business each day. (4) A temporary banner shall be building mounted only, shall have only one face not exceeding 100 square feet in area and shall be placed on the building in accordance with the limitations specified in [ 17.24.080 regarding clearance and roof-line level. B. (1) Special promotional devices, such as large balloons or searchlights, may be approved for a maximum three-day period or five days for grand openings, four times within a calendar year, subject to the following: (a) Parking is not displaced; (b) The device is compatible with adjoining uses; of major concern is proximity to residential properties; (c) The device is not located in a landscaped front setback area; (d) Tethered balloons used for special promotional purposes may not exceed a height of 25 feet above the building where the special event is occurring; and (e) Meets the tenant schedule in divisions (C) or (D) below. (2) The Director, shall review a requested use of any special promotional device, such as searchlights, hot air balloons, fides, traffic/parking directional signs within the Ordinance No. 1926 Page 7 public right-of-way and the like, in relation to the type of activity and the appropriateness of the activity to the surrounding neighborhood. (3) There is no specific limitation on the number of traffic/parking directional signs which may be used on a site on the specific day of the special promotional or temporary event. (4) However, the Director shall review the number and placement of signs requested to be placed in the public right-of-way and may restrict the number and placement of such signs in order to ensure that adequate sight distance and traffic safety clearances are maintained as required in 5 17.32.010. C. (1) Notwithstanding any provision to the contrary contained in this chapter, but subject to any maximum duration regulations contained in this chapter, all special event temporary signs must be completely removed not later than five days after the conclusion of the special event to which they pertain.
