The term "truck" means any vehicle as defined in the Vehicle Code of California, or as hereafter amended, that exceeds a gross weight of three tons and has a total combination of motor truck, truck tractor and/or trailers of sixty feet or less in length. B. The phrase "interstate truck" means any vehicle as defined in the Vehicle Code of California, or as hereafter amended, that exceeds a maximum gross weight of three tons and has a total combination of motor truck, truck tractor and/or trailers that exceeds sixty feet in length. C. Theterm "publicschool"meansanelementaryor secondary school supported by public funds and providing free education for children in grades K-12. (Ord. 15-2128, § 2, 2015; Ord. 1267, § 1 (part), 1984; Ord. 833, § 2, 1977) 11.32. 020 Routes-Established-Signs. A. The following truck traffic routes within the City are hereby established for the movement of any truck as defined in Section 11.32.010: 2015 S-52 59 Street Limits De Anza Boulevard From the South City Limits to the North City Limits, all portions current! y or hereafter within the City Limits. Foothill Boulevard From McClellan Road to Junipero Serra Freeway (Route No. 280), all portions currently or hereafter within the City Limits. Homestead Road From Stevens Creek Freeway (Ronte 85) to Lawrence Expressway, all portions currently or hereafter within the City Limits. Stevens Canyon From the South City Limits to McClellan Road Road, all portions currently or hereafter within the City Limits. Stevens Creek From the West City Limits to Foothill Boulevard Boulevard and from West Valley Freeway (Route No. 85) to the East City Limits, all portions currently or hereafter within the city limits. Tantau Avenue From Stevens Creek Boulevard to Wolfe Road Homestead Road. Stevens Creek Boulevard to Homestead Road. B. The City Engineer is directed to designate the above-named truck traffic routes by the erection of appropriate approved state standard signs giving notice to the ordinance codified in this chapter. (Ord. 15-2134, § 1, 2015; Ord. 833, § 3, 1977) 11.32.030 Routes-Signs-Compliance. When authorized signs are in place giving notice of designated traffic truck routes, no person shall operate, drive, or cause or permit to be operated or driven a truck as defined in Section 11.32.010 of this chapter on any street or streets within the City other than on a truck traffic route, except as otherwise provided in this chapter. (Ord. 833, § 4, 1977) 11.32.040 Authority to Require Weighing of Vehicle. Any peace officer having jurisdiction within the City, or acting under its authority, shall have the authority to require any person driving or in control of any vehicle as defined in the Vehicle Code of California, or as hereafter 11.32.040 Cupertino -Vehicles and Traffic 60 amended, not proceeding over a truck traffic route to proceed to any public or private scale availabl.e for the purpose of weighing and determining whether this chapter has been complied with. (Ord. 833, § 5, 1977) 11.32.050 Unrestricted Highways-Interstate Trucks. Nothing contained in this chapter is intended to regulate the movement of any vehicle as defined in the Vehicle Code of California, or as hereafter amended, upon any of the following named highways, portions of whi.ch ru:e located within the City, and which are referred to Ill this chapter as "unrestricted highways": De Anza Boulevard (Route # 85) Foothill Expressway Junipero Serra Freeway (Route# 280) West Valley Freeway (Route # 85) Unless otherwise permitted in this chapter, no person shall operate, drive or cause or permit to be operated or drive~, an interstate truck as defined in Section 11.32.010 of this chapter on any street or streets within the City other than on unrestricted highways. (Ord. 1267, § 1 (part), 1984; Ord. 833, § 6, 1977) 11.32.055 School Zones-Prohibited vehicles. A. No person shall operate, drive, or cause or permit to be operated or driven, any truck, as defined in Section 11.32.010 of this chapter, between the hours of 7:00 a.m. and 9:30 a.m. in the morning and the hours of 2:00 p.m. and 4:00 p.m. in the afternoon Monday through Friday, on the following roadway segments: (i) on any roadway which runs contiguous to and is within 500 feet of any public school grounds; (ii) McClellan Road, between Stelling Road and Bubb Road. B. The only vehicles which can operate during the times listed in Section l l.32.055(a) are as follows: (i) Emergency response vehicles; (ii) Any vehicle traveling on an arterial or major collector avenues as defined in the City of Cupertino's General Plan, Chapter 5, "Mobility Element", Figure M-2, including DeAnza Boulevard, Homestead Road, Stevens Creek Boulevard (east of Foothill Boulevard), Wolfe Road (north of Stevens Creek), Bollinger Road (east of DeAnza Boulevard), Bubb Road (north of McClellan Road), Foothill Boulevard (north of Stevens creek), Miller A venue (north of Bollinger Road), Stelling Road (north of Stevens Creek) and Tantau (north of Stevens Creek Boulevard). (iii) Solid waste, garbage, or recycling trucks and street sweepers operating on their established routes; 2015 S-52 (iv) A public utility or licensed contractor while necessarily in use in the construction, installation, or in repair of any public utility, within the City, but only as necessary for emergency repair; or (v) Passenger buses and other public transit vehicles under the jurisdiction of the California Public Utilities Commission, school buses, and employer-sponsored passenger buses provided solely fo the employer's employees, so long as these vehicles do not deviate from their established route(s). C. The Director of Public Works is directed to designate the above-named school zones by the erection of appropriate approved state standard signs giving notice of the restrictions in this section. D. When authorized signs are in place giving notice of the designated school zones, no person shall operate, drive, or cause or permit a truck to be operated or driven in violation of this section unless otherwise exempt under the provisions of subsection B of this section. (Ord. 15-2134, § 2, 2015; Ord. 15-2128, § 3, 2015) 11.32.060 Truck Traffic-Origin and Destination Points. A. Any truck as defined in Section 11.32.010 of this chapter entering the City for a destination point outside the City shall proceed only over a truck traffic route or other unrestricted highway. B. Any truck as defmed in Section 11.32.010 of this chapter on a trip originating within the City and traveling in the City for a destination point outside of the City shall proceed by the shortest and most direct route to the nearest truck traffic route or other unrestricted highway. C. Any truck as defined in Section 11.32.010 of this chapter entering the City for one or more destination points in the City shall proceed only over a truck traffic route or other unrestricted highway, and shall deviate therefrom only by the shortest and most direct route between each destination point and the nearest truck traffic route or other unrestricted highway. D. Any truck as defined in Section 11.32.010 of this chapter on a trip originating in the City, and traveling in the City for one or more destination points in the City, shall proceed by the shortest and most direct route to the nearest truck traffic route or other unrestricted highway, and shall deviate therefrom only by the shortest and most direct route between each destination point and the nearest truck traffic route or other unrestricted highway. E. Any truck as defined in Section 11.32.010 of this chapter traveling in the City for more than one destination point in the City may proceed directly from one destination point to the next destination point by the shortest and mo.st direct route without returning to the nearest truck traffic 60A Truck Traffic Routes 11.32.060 route or other unrestricted highway, if it will result in a shorter distance being traveled on streets upon which such a truck ordinarily would not be allowed to travel notwithstanding the requirements of subsections C and D of this section. (Ord. 833, § 7, 1977) 11.32.070 Exceptions-Pickup or Delivery. For the purpose of this chapter, a "restricted street" is any street which is neither a truck traffic route nor an unrestricted highway. This section does not apply to the time restrictions around school zones as set forth in Section 11.32.055. Except during the times as set forth in Section 11.32.055, nothing contained in this chapter shall prohibit the operation of any commercial vehicle as defined in the Vehicle Code of California, or as hereafter amended, coming from a truck traffic route or unrestricted highway having ingress or egress by direct route to and from a restricted street when necessary for the purpose of making pickups or deliveries of goods, wares and merchandise from or to any building or structure located on the restricted street, or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling, or construction of any building or structure upon the restricted street for which a building permit previously has been obtained. (Ord. 15-2134, § 3, 2015; Ord. 833, § 8, 1977) 11.32.080 Exceptions-Types of Vehicles. Except as provided in Section 11.32.055, the provisions of this chapter shall not apply to any of the following: A. Passenger buses under the jurisdiction of the Public Utilities Commission of California, and school buses; B. Any authorized emergency vehicle as defined in Section 165 of the Vehicle Code of California, or as hereafter amended; C. Any vehicle owned, leased, operated or controlled by: (i) The City of Cupertino, (ii) A contractor retained to provide street sweeping within the City of Cupertino but only while its truck are operating on an established route or traveling to and from an established route, (iii) A public utility or licensed contractor while necessarily in use in the construction, installation, or in repair of any public utility, within the City, (iv) The holder of a franchise issued by the City for the removal of garbage, solid waste, or recycling but only while its trucks are operating on an established route or traveling to and from an established route; and (v) An employer providing transportation to its employees, provided such vehicles deviate from a truck · traffic route or unrestricted highway only by way of a direct 2015 S-52 route to and from a restricted street and only when necessary for the purpose of picking up or dropping off passengers. Any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punished as provided in Chapter 1.12 of this code. Definitions. Applicability. Solar energy system requirements. Application and documents. Permit review and inspection requirements. 16.28.010 Purpose and Intent. The purpose of this Ordinance is to adopt an expedited, streamlined solar permitting process that complies with the Solar Rights Act and AB 2188 (Chapter 521, Statutes 2014) to achieve timely and cost-effective installations of small residential rooftop solar energy systems. The Ordinance expands AB2188 to provide for timely and cost-effective installations of solar panels on small multi-family and commercial buildings. The Ordinance encourages the use of solar systems by removing unreasonable barriers, minimizing costs to property owners and the City, and expanding the ability of property owners to install solar energy systems. The Ordinance allows the City to achieve these goals while protecting the public health and safety. (Ord. 15-2133, part, 2015) 16.28.020 Definitions. For the purposes of this Chapter, the following words and phrases shall have the meanings as defined in this section. a. A "Solar Energy System" means either of the following: i. Any solar collector or other solar energy device whose primary purpose is to provide for the collection, storage, and distribution of solar energy for space heating, space cooling, electric generation, or water heating. ii. Any structural design feature of a building, whose primary purpose is to provide for the collection, storage, and distribution of solar energy for electricity generation, space heating or cooling, or for water heating. b.. A "small residential rooftop solar energy system" means all of the following: 2015 S-52 37 i. A solar energy system that is a simple photovoltaic system no larger than 10 kilowatts or a solar thermal system no larger than 30 kilowatts thermal. ii. A solar energy system that conforms to all applicable state fire, structural, electrical, and other building codes as adopted or amended by the City and all state and local health and safety standards. iii. A solar energy system that is installed on a single or duplex family dwelling. iv. A solar panel or module array that does not exceed the maximum legal building height as defined by the city. c. A "small multi-family or commercial rooftop solar energy system" means all of the following: i. A solar energy system that is a simple photovoltaic system no larger than 10 kilowatts or 30 a solar thermal system no larger than kilowatts thermal. ii. A solar energy system that conforms to all applicable state fire, structural, electrical, and other building codes as adopted or amended by the City and all state and local health and safety standards. iii. A solar energy system that is installed on a triplex, four-plex family dwelling or on a commercial building no more than 10,000 square feet in size. iv. A solar panel or module array that does not exceed the maximum legal building height as defined by the City. d. A "small rooftop solar energy system" either a "small residential rooftop solar energy system" or a "small multi-family or commercial rooftop solar energy system". e. "Electronic submittal" means the utilization of one or more of the following: i. Email; ii. The Internet; iii. Facsimile. f. An "association" means a nonprofit corporation or unincorporated association created for the purpose of managing a common interest development. g. A "common interest development" means any of the following: i. A community apartment project. 16.28.020 Cupertino -Buildings and Construction 38 ii. A condominium project. iii. A planned development. iv. A stock cooperative. h. "Specific, adverse impact" means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified, and written public health or safety standards, policies, or conditions as they existed on the date the application was deemed complete. i. "Reasonable restrictions" on a solar energy system are those restrictions that do not significantly increase the cost of the system or significantly decrease its efficiency or specified performance, or that allow for an alternative system of comparable cost, efficiency, and energy conservation benefits. j. "Restrictions that do not significantly increase the cost of the system or decrease its efficiency or specified performance" means: i. For Water Heater Systems or Solar Swimmtng Pool Heating Systems: an amount exceeding 10 percent of the cost of the system, but in no case more than one thousand dollars ($1,000), or decreasing the efficiency of the solar energy system by an amount exceeding 10 percent, as originally specified and proposed. ii. For Photovoltaic Systems: an amount not to exceed one thousand dollars ($1,000) over the system cost as originally specified and proposed, or a decrease in system efficiency of an amount exceeding 10 percent as originally specified and proposed. (Ord. 15-2133, part, 2015) 16.28.030 Applicability. a. This Ordinance applies to the permitting of all small rooftop solar energy systems in the City. b. Small rooftop solar energy systems legally established or permitted prior to the effective date of this Ordinance are not subject to the requirements of this Ordinance unless physical modifications or alterations are undertaken that materially change the size, type, or components of a small rooftop energy system in such a way as to require new permitting. Routine operation and maintenance or like-kind replacements shall not require a permit. (Ord. 15-2133, part, 2015) 16.28.040 Solar Energy System Requirements. a. All solar energy systems shall meet applicable health and safety standards and requirements imposed by the state, the City, and Santa Clara County Fire Department. b. Solar energy systems for heating water in single-family residences and for heating water in commercial or swimming pool applications shall be certified by an accredited listing agency as defined by the California Plumbing and Mechanical Code. 2015 S-52 c. Solar energy systems for producing electricity shall meet all applicable safety and performance standards established by the California Electrical Code, the Institute of Electrical and Electronics Engineers, and accredited testing laboratories such as Underwriters Laboratories and, where applicable, rules of the Public Utilities Commission regarding safety and reliability. (Ord. 15-2133, part, 2015) 16.28.050 Application and Documents. a. All documents required for the submission of an expedited solar energy system application shall be made available on the City's website. b. Electronic submittal of the required permit application and documents shall be made available to all small rooftop solar energy system permit applicants. c. An applicant's electronic signature shall be accepted on all forms, applications, and other documents in lieu of a wet signature. d. The City's Building Department shall adopt a standard plan and checklist of all requirements with which small rooftop solar energy systems shall comply to be eligible for expedited review. e. The small residential rooftop solar system permit process, standard plan( s), and checklist( s) shall substantially conform to recommendations for expedited permitting, including the checklist and standard plans contained in the most current version of the California Solar Permitting Guidebook adopted by the Governor's Office of Planning and Research. f. The small multi-family or commercial rooftop solar energy system permit process, standard plan(s), and checklist(s) shall be develop~d by the City's Building Department. g. All fees prescribed for the permitting of small rooftop solar energy system must comply with Government Code Section 65850.55, Government Code Section 66015, Government Code Section 66016, and State Health and Safety Code Section 17951. (Ord. 15-2133, part, 2015) 16.28.060 Permit Review and Inspection Requirements. a. The City shall adopt an administrative, nondiscretionary review process to expedite approval of small rooftop solar energy systems. Upon receipt of a complete application which meets the requirements of the approved checklist and standard plan, the City shall issue a building permit or other nondiscretionary permit on the same day for over-the-counter applications or within 3 business days for electronic applications. The building official may require an applicant to apply for a use permit if the official finds, based on substantial evidence, that the solar energy system could have a specific, adverse impact upon the public health and safety. 38A Expedited Permit Process for Small Rooftop Solar Systems 16.28.060 b. Review of the application shall be limited to the building official's review of whether the application meets local, state, and federal health and safety requirements. c. If a use permit is required, a building official may deny an application for the use permit if the official makes written findings based upon substantive evidence in the record that: 1. The proposed installation would have a specific, adverse impact upon public health or safety; and 2. There is no feasible method to satisfactorily mitigate or avoid, as defined, the adverse impact. Such findings shall include the basis for the rejection of the potential feasible alternative for preventing the adverse impact. a. Decisions to require a use permit or to deny a use permit may be appealed by filing a request for appeal, in writing, with a description of the grounds for appeal. The request for appeal must be made within ten (10) business days of the serving or mailing of the building official's determination. A hearing shall be scheduled within thirty (30) days before the Board of Appeals as defined in Cupertino Municipal Code Section 16.02.270. If the appeal is not filed within the time specified above, the applicant shall be deemed to waive the right to appeal. b. Any condition imposed on an application shall be designed to mitigate the specific, adverse impact upon health and safety at the lowest possible cost. c. "A feasible method to satisfactorily mitigate or avoid the specific, adverse impact" includes, but is not limited to, any cost-effective method, condition, or mitigation imposed by the City on another similarly situated application in a prior successful application for a permit. The City shall use its best efforts to ensure that the selected method, condition, or mitigation meets the conditions of subparagraphs (A) and (B) of paragraph (1) of subdivision (d) of Section 714 of the Civil Code defining restrictions that do not significantly increase the cost of the system or decrease its efficiency or specified performance. d. Approval of an application shall not be conditioned upon the approval of an association, as defined in Section 4080 of the Civil Code. e. If an application is deemed incomplete, a written correction notice detailing all deficiencies in the application and any additional information or documentation required to be eligible for expedited permit issuance shall be sent to the applicant for resubmission. f. The City shall require only one inspection for small residential rooftop solar energy systems eligible for expedited review. The City may require two inspections for small multi-family or commercial rooftop solar energy systems if deemed necessary. A separate fire inspection may be performed if the City does not have an agreement with the local fire authority to perform safety inspections on behalf of the fire authority. 2015 S-52 g. The inspection(s) shall be done in a timely manner and should include consolidated inspections. An inspection will be scheduled within two (2) business days of a request and provide a two-hour inspection window on the day of the inspection. h. If a small rooftop solar energy system fails inspection a subsequent inspection is authorized but need not conform to the requirements of this Ordinance.
