Dear Hcmeowner:
We have been going through our files in the Building Department, and contacting those
people with permits remaining "open".
. According to our inspection records, this permit has not been finaled by the Building
Department. The last inspections of record were in September, of 1995. Many times an
inspector will sign the permit in the field, but overlook reporting all of the information to
the clerical staff for input into the computer. If this is the situation and your permit card
shows the final sign-off, would you please contact us so we may complete our computer
records? If the permit is not signed off, please call to schedule an inspection for final
closure of the permit.
Because of the large volume oF paperwork within the building department, we cannot
separately monitor the progress of each permit. We ask that you give this notification
your immediate attention. If we do not hear from you within ten (10) working days, we
will dispose of the file and remove the records from our computer.

Permits are not typically finalized through a special ceremony. I don’t doubt a special ceremony took place and I
don’t doubt a plaque was presented, however, I do question if the permits were signed off at the time. If you
could provide me the signed permit job card, I will be happy to review it. Unfortunately, a plaque does not
substitute for a signed job card and can not be used to verify compliance with the building code standards.
I did send you the letter sent to the owner on March 20, 1998. Clearly on that day the City tried to reach out to
notify the owner the permits have expired. I would be interested to know how the owner responded to this
letter. If the permits were signed off (during the ceremony or not) there should be a simple letter from the
owner responding to the City stating such back in 1998. If you could send me that information that will be very
helpful.
I would not hold on to the thought that just because a ceremony took place, the contractor at the time called for
all required inspections and the project was properly finaled. There have been on occasion dedication
ceremonies held for projects where the agencies were still working behind the scenes to close out
administrative loose ties. Not ideal but it has happened. And to your point, it was detected the project was not
finaled given the formal letter sent to the owner in 1998. The 100 year-old windows used was probably a
requirement and probably inspected but without a FINAL sign-off, we can not verify the project in its entirety
meets the building standards established at that time. My previous email gives you the direction needed for you
to give the current owner and/or potential buyers information on how to mitigate expired permits.

Here is some more information on what happened and why we are asking for your help. This home is part of a
small development of 5 homes built by Emily Chen. This, the 5th was a remodel and addition and was the last
home completed. At the time of completion the permits were finalized at a special ceremony hosted by the city
of Cupertino. The building department was there, the Cupertino historical society was there, Rich was there,
others were there to see the permits signed off and the plaque was presented. The Miller House 1. We can
bring you the plaque. We believe there is likely someone still at the city who can verify this. It is really doubtful
that the development could slip by undetected without final permits with all the publicity going on at the time
about it.
To further show it was done according to Cupertino’s specifications, the city required builder, Emily Chen, to use
5 100 year old windows from another home to assure all work was to the citys specifications.
What we need, since it appears the city and county no longer have records is for Cupertino to give us a
document that can show we complied with the codes at the time and that we not be required to update to
current codes.

I attached the only permits we have on file for this address. Records do not show this property as listed on the
National Register of historic places. If this parcel qualifies or is determined to be eligible as a Qualified Historical
Building or Property by National, State, or local registers, please send me the documentation so we could
include this in our records.
Regarding the Remodel and Addition permit (BP#27326) issued on Nov 22, 1994, our records show the
contractor did not follow through with the proper final inspections and the permit is deemed expired. A letter
was sent to the homeowner stating this on March 20, 1998. The letter is attached to the permit file. Even
though this is not current practice today, the letter noted the plans and documents would be disposed of if the
homeowner did not respond within 10 working days from the time the letter was sent.
To answer your question, the only records that can be presented to potential buyers is an expired permit for the
1994 remodel and addition but will obviously not be an indication the City was given the opportunity to inspect
the building to meet code. For those inquiring how to formally approve and final expired permits, we require
new plans and documents stamped and signed by a licensed professional to be submitted as a new
application. Those plans will be reviewed and approved per current code and all work not previously inspected
will be addressed and all work necessary for the building to meet current code will be inspected prior to the final
of the new permit.
The property appears to be annexed from the City of San Jose on July 1, 1979 as part of the San Jose – Cupertino
Reorganization. You may want to put in a request to search the City of San Jose records to find permits or
records for the original construction.

We need your help. We are putting a historic home on the market that had an addition and remodel, and was
also moved from one location to another on the property--new foundation. Record does show a newer
effective year but not why.
It was part of a development by Emily Chen. And permits were finaled at a special ceremony with the Cupertino
Historic Society.
After the improvements, home was sold. We have submitted a search form for plans and permits in
Cupertino—the county search only produced a couple partials—but they did a measure and though
miscalutated, shows the addition and a picture of home with addition.
Help needed: What can be produced by Cupertino for the new buyers, to show work was done to code and how
can we get that documentation as quickly as possible.
