ORDINANCE NO. 1748
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AMENDING TITLE 19 OF THE CUPERTINO MUNICIPAL CODE BY
REZONING A PARCEL LOCATED AT 10346 SOUTH STELLING ROAD
TO SINGLE FAMILY RESIDENTIAL 7.5 (RI 7.5)
WHEREAS, an application was filed by the City of Cupertino (Application 9-Z-96) for
the rezoning of property from RI-I0 ag.; and
WHEREAS, upon due notice and after one public hearing the Planning Commission
recommended to the City Council that the rezoning be granted; and
WHEREAS, the properties to be rezone are presently in R-I-I0 ago zone; and
WHEREAS, a map of the subject property is attached hereto as Exhibit A as a proposed
amendment to the Master Zoning Map of the City of Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1 That the properties described in attached Exhibit B be and hereby are
rezoned to Single Family Residential Rl 7.5; and that Exhibit A & B attached hereto is made
part of the Master Zoning Map of the City of Cupertino.

Parcel One:
Beginning at a point in the Easterly line of Stelling Road, distant thereon North 704.00 feet
from the point of intersection of said Easterly line of Stelling Road, with the Northerly line of
McClelland Road, said point of intersection also being the Southwesterly corner of Section 13,
Township 7 South, Range 2 West, M.D.B, & M.; running thence North along the Easterly line
of Stelling Road, 176.00 feet; thence running North 89° 58' East and parallel with the
Northerly line of McClelland Road, 247.50 feet; thence running South and parallel with the
Easterly line of Stelling Road, 176.00 feet; thence running South 89° 58' West and parallel
with the Northerly line of McClelland Road, 247.50 feet to the point of beginning.
Excepting therefrom the following described parcel of land:

Being a strip of land twenty-five (25) feet in width, measured at right angles, a portion of that
certain parcel of land described in the deed to Bennett, recorded in Book 1910 of Official
Records, of Santa Clara County, at Page 260, et seq., more particularly described as follows:
Beginning at the intersection of the Southerly line of the above-referred parcel with the
Easterly line of Stelling Road, at 40 feet in width, and running thence along last-mentioned
line, due North 176.00 feet; thence North 89° 58' East, 25.00 feet to the intersection with
a line drawn parallel to and distant Easterly, at right angles, 45.00 feet from the centerline
of Stelling Road, as aforesaid; thence along last mentioned line, due South 176.00 feet;
thence South 89° 58' West, 25.00 feet to the point of beginning, and containing 0.101 acres
of land, more or less.
Parcel Two:
According to the official plat thereof, an easement for the installation and maintenance of pipe
lines over a strip of land 10 feet in width, the Easterly line of which is described as follows:
Beginning at the Southeasterly corner of the above described 1.00 acre tract; and running
South and parallel with the Easterly line of Stelling Road, 704 feet to the Northerly line of
McClelland Road.
