ORDINANCE NO. 1732
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING
CHAPTER 19 OF THE CUPERTINO MUNICIPAL CODE BY REZONING
APPROXIMA TEL Y 1.29 ACRES TO PERMIT THE
CONSTRUCTION OF OFFICE SPACE, AUXILIARY PARKING AND LANDSCAPING
IMPROVEMENTS LOCATED ON THE EAST SIDE OF
DE ANZA BOULEVARD NEAR SCOFIELD BOULEVARD
WHEREAS, an application was filed for the rezoning of property to change the Master
Zoning Map designation from parking to an office development; and
WHEREAS, upon due notice and after public hearings, the City Council granted the
rezoning; and
WHEREAS, the property to be rezoned is presently identified in Application No. 2-Z-83
to be used for surface parking; and
WHEREAS, a map of the subject property is attached hereto as Exhibit "A" as a
proposed amendment to Application No. 2-Z-83 of the City of Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
I. That the property described in attached Exhibit "A" be and hereby is rezoned to
office development and that Exhibit "A" attached hereto is made part of the Master Zoning Map
of the City of Cupertino and Exhibit "B" describes adopted conditions of approval.

SECTION III' CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT

1.
SITE EXHIBITS
The master zoning plan labeled Exhibit A 3rd is approved to allow the construction of a
141,000 square foot, 4-story office building at the southeast corner of De Anza Boulevard
and the eastern extension of Scofield Drive. The parcel located to the north of Symantec
site may be used for retail and/or residential subject to an approved use permit which
allocates retail space and/or residential dwelling units permitted by the General Plan and
Stevens Creek Boulevard Specific Plan.
2.
PARKING
The "Symantec Site" shall accommodate approximately 657 parking spaces to meet the
need of the Symantec building and shared parking spaces to meet the need of surrounding
land use activities that have right of use for parking based upon parking agreements. The
number of parking spaces shall also be increased to accommodate parking spaces last on
the adjoining property to the south as a result of "off site" landscaping. The below grade
parking garage may be expanded to accommodate the additional parking spaces.
3.
CORNER PARK
The owners of the park located adjacent to the intersection of DeAnza Boulevard and
Stevens Creek Boulevard and the applicant for the Symantec Building and the City shall
participate in the planning and installation of improvements for said park (Lot 8, Tract
7953). The degree of participation for each party shall be based upon benefit formula to be
approved by the City Council. One element of the formula is the degree of commitment
improvement by private owners to install improvements as manifested by previously
approved drawings. The formula and necessary agreements shall be approved and signed
prior to issuance of a building permit for the designated site.
4.
STEVENS CREEK BO1JI,EV ARD STREETSCAPE
The applicant shall participate in the cost of installation of the Stevens Creek Boulevard
Specific Plan streetscape improvements for the portion of Stevens Creek Boulevard
fronting the "City Center Hotel Site" (APN 369-01-029). The improvements shall be
consistent with the streetscape plans contained in the Stevens Creek Boulevard Specific
Plan. The degree of financial participation shall be based upon a formula to be approved by
the City Council. The formula and necessary agreements for improvements shall be
approved and executed prior to issuance of a building permit for a Symantec Site.
