Ordinance No. 1716 ORDINANCE NO. 1716 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO REZONING AND PREZONING APPROXIMA TEL Y 250 ACRES OF LAND FROM RI-IO, Rl-40, RI-60, RI-80, RI-IOO, AI-43, AI-IOO, RHS, PRE-RHS AND PRE-A TO RHS- RESIDENTIAL HILLSIDE ZONING DISTRICT; LOCATED NORTH AND EAST OF REGNART CANYON AND GENERALLY BOUNDED BY UPLAND WAY, LINDY LANE, LINDA VISTA PARK, STEVENS CREEK TO THE URBAN SERVICE AREA BOUNDARY (APPLICATION NO. 10-Z-95 - CITY OF CUPERTINO) WHEREAS, the City of Cupertino has initiated an application (Application No. 10-Z-95) for the rezoning and prezoning of property from RI - I 0, RI -40, RI -60, RI -80, RI-IOO (Single-Family Residential), AI-43, AI-IOO (Agricultural Residential), RHS, PRE-RHS (Residential Hillside), and PRE-A (Agriculture) to RHS- (Residential Hillside); and WHEREAS, upon due notice and after three public hearings the Planning Commission recommended to the City Council that the Rezoning and Prezoning be granted; WHEREAS, a list of the subject properties is attached hereto as Exhibit "A" and a map of the subject properties is attached hereto as Exhibit "B" as a proposed amendment to the Master Zoning Map of the City of Cupertino. NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS: Section I That the properties described in attached Exhibit "A" be and hereby rezoned or prezoned to a RHS- zone as shown, and that Exhibit "B" attached hereto is made part of the Master Zoning Map of the City of Cupertino. Section 2 This ordinance shall take effect and be in force thirty (30) days after its passage. Section 3 That building permit applications for properties affected by this rezoning/prezoning submitted prior to the effective date of this zoning ordinance be processed under the zoning regulations in effect at the time of building permit application.
