j3 Non-turf Restrictions
a. Plants shall be arranged appropriately based upon the site's climate, slopes, sun
exposure, soil characteristics, wildfire susceptibility and other site conditions . appropriate for the selected plants .
b. . The horticultural attributes of plant species (e.g., mature plant size, invas_ive roots, and
structural attributes) shall be considered, in order to minimize the potential for damage
to property or infrastructure (e.g., buildings, septic systems, sidewalks, power lines).
.c. Fire-prone plant materials and highly flammable mulches are strongly discouraged. In
areas designated.wildland urban interface by Chapter 16.74 of this Code, plants shall be
selected, arranged and maintained to provide defensible space for wildfire protection, in
conformance with Public Resources Code Section 4291. . d ... Invasive plant species/noxious weeds: . i. Installation shall be prohibited.
ii. Existing within or adjacent to the proposed landscape area shall be removed prior to . installation of new landscaping .

Gilbert,
We funded a total of $I I5k in FYI5/I6. Right now there is a waitlist valued at $I I2k matching
dollars for Cupertino applications waiting at the Water District that could be funded IF the District
renews their base funding in FYI6/I 7 AND Cupertino authorizes the $I match program again in
FYI 6/I 7. Our proposed budget will include a recommendation of$ I I 5k again for this program in
FYI6/I 7. If the Water District does not continue their program, we will recommend that the City's
program discontinue as well.
In FYI 5/I 6 the expended funding of$ I I 5k provided rebates to I I 8 residential and commercial
accounts. We need to query the District for a breakdown between the two but from past reports,
residential is the majority group.

State-Mandated Changes
THRESHOLDS
Intent:
To increase applicability of requirements to development
projects
2009 MWELO –Requirements of ordinance apply
to projects with ≥ 2,500 s.f.of landscape area
2015 MWELO –Requirements of ordinance apply
to projects with ≥ 500 s.f.of landscape area
State-Mandated Changes
PRESCRIPTIVE COMPLIANCE OPTION
Intent:
Reduce cost for property owners to meet state-regulations
Already an option in City’s current local ordinance
Now an option in State MWELO
Minor revisions to include State requirements
Projects with landscape areas between 500 s.f.and
2,500 s.f.may meet requirements by:
Limit turf and encourage native or low water use plants;
Add compost and mulch amendments; and
Install regulators, valves, automatic controllers, etc.
State-Mandated Changes
WATER BUDGET FORMULAS &HIGH-WATER USE PLANTS
Intent:
Restrict the amount of landscape dedicated to turf and
high-water use plants
Allow for site-wide flexibility
Modify water budget calculations and formulas
Provide detailed evapotranspiration rates (ETo)as
required by 2015 MWELO for residential and non-
residential projects
State-Mandated Changes
IRRIGATION EFFICIENCY
Intent:
Improve efficiency standards for irrigation systems
Require:
Dedicated landscape water meters and submeters for >
5,000 s.f.residential projects/ > 1,000 s.f.non-residential
projects;
Flow sensors for landscape areas > 5,000 square feet;
Pressure regulators and master shut-off valves; and
Reduce minimum width of areas that can be irrigated
with overhead sprinklers
State-Mandated Changes
ON-SITE STORM-WATER CAPTURE / GRAYWATER USAGE
Intent:
Promote alternative irrigation methods
Require:
Identification of any graywater or storm water retention design elements
Return of compacted soil to friable and non-compacted condition
Incentivize:
Allow prescriptive compliance option (irrigation systems only) for projects with landscape areas > 2,500 square feet that are irrigated entirely with captured rainwater or graywater
State-Mandated Changes
ANNUAL REPORTING
Intent:
Provide State with data on local implementation
Require:
Annual reporting on the implementation and
enforcement of local/regional water efficient landscape
ordinances
