The Hamptons Development Agreement
Relocation Obligation Summary
Under Section 3.13.2 of the Development Agreement, the Developer is required to provide three
main categories of relocations benefits.
1. The Developer has agreed to reimburse the City for all relocation benefits as required by
the State Relocation Laws owed to tenants displaced from the affordable units in the
Hamptons. (See Development Agreement Section 3.13.2 and Exhibit C, Affordable
Housing Relocation Agreement Section 1.1.) "State Relocation Laws" are summarized in
the table below.
2. The Developer has agreed to offer eligible tenants comparable replacement dwellings in
Developer's North Park Apartment Homes, located at 3500 Palmilla Drive, San Jose.
(See Development Agreement Section 3 .13 .2 and Exhibit C, Affordable Housing
Relocation Agreement Section2.2.)
3. All relocated tenants shall be offered a right of first refusal to return to the Hamptons
once comparable units are available. (See Development Agreement Section 3.13.2 and
Exhibit C, Affordable Housing Relocation Agreement Section 2.3.)

• Relocation Plan must be available for public comment and
review at least 30 days prior to approval. Plan must contain -
o Analysis of relocation needs
o Projected dates of displacement
o Analysis of comparable housing resources
o Description of relocation advisory services
o Description of relocation payments
o Cost of carrying out relocation plan
o Last resort housing plan if necessary
o Temporary relocation plan if applicable
o Plans for citizens participation ·
o Comments from relocation committee if applicable.
• Actual and reasonable moving costs including costs for
o Transportation not to exceed a distance of 50 miles
except where justified
o Packing and unpacking
o Storage of personal property if necessary
o Replacement value of property lost, stolen or damaged
• Provide at least three offers of comparable replacement
housing

permanently affordable housing.
