WHEREAS, on April 19, 2016, the Cupertino City Council held a public hearing
and at the conclusion of the hearing approved on a 4-0 vote (Paul abstaining)
applications R-2015-08 . and RM-2015-08 for a new 5,140-square-foot two=story
_residence and a netiv second story.balcony on the residence located at 21900 Oakview
Lane. ,
_ WHEREAS,; the Cupertino City Council's decision was within its discretion and
made at a properly noticed public meeting;
WHEREAS;,JanKucera Jr., and Matthew R. and Angela IVI.D. Miller requested that
the City Council reconsider its decision under the provisions of Section 2.08.096 of the
City's municipal code; and
WHEREAS, the City Council has considered all relevant evidence presented by the
parties at all hearings, including evidence presented at the june 21, 2016

reconsideration hearing.
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLQWS: .
1. The petitioners' Reconsideration Petition is defective on its face in that it does not
offer proof of facts as required by Municipal Code Section 2.08.096.
2. The petitioners did not provide new relevant evidence which, in the exercise of
reasonable diligence, could not have been produced at any earlier city hearing
(Municipal Code �2.08.096 (B) (1)).
3. The petitioners did not provide relevant evidence which was improperly
excluded at any prior city hearing {Municipal Code § 2.08.096 (B) (2)).

4. The petitioners have failed to provide proof of facts which demonstrate that the
City Council proceeded without, or in excess of its, jurisdiction (Municipal Code
�2.08.096 (B) (3)).
5. The petitioners have failed to present any evidence that the City Council failed to
provide a fair hearing (Municipal Code � 2.08.096 (B) (4)).
6. The petitioners have failed to demonstrate that the City Council abused its
discretion by not proceeding in a manner required by law; rendering a decision
which was not supported by findings of fact; and/or rendering a decision in
which the findings of fact were not supported by the evidence (Municipal Code �
2.08.096 (B) (5)).
7. Specifically, the City Council determines that:
a. The City Council's decision is supported by findings of fact attached as
Exhibit A.
b. The findings of fact related to the City Council's decision were supported
by substantial evidence in the record of proceedings.
8. The petitioners' Petition for Reconsideration of the City Council's decision of
April 19, 2016 on item #16 is DENIED, thereby affirming the original decision.

Cupertino 1Vlunicipal Code section 2.08.096 states:
"A petition for reconsideration shall specify,in detail, each and every ground for

M.ID. Miller (Attachments B & C) consists of three pages eac11 contesting the project
approval and lists claims for recorisideration of the Council's April 19� decision on the
grounds of criteria #1-#5. Each of the grounds for the reconsideration as submitted by the
petifioners and the City's findings of fact. and responses to each of the grounds are listed
below.
If fhe reconsideration is granted, the Council may conduct a hearing and reconsider its
decision in light of the new evidence presented. Reconsideration of this item constitutes the

The project is consistent with the regulations and intent of the Cupertino General Plan and
Single-Family Residential (R-1) Ordinance. The project complies with all established and required
setbacks, floor area ratio limitations, privacy protection planting requirements and other
Municipal Code requirements. In addition, the proposed development meets all prescriptive
development requirements of the Parking, Landscape, and Fence ordinances; and the two-story
non-discretionary permit procedural requirements in the R-1 Ordinance.
2. The granting of the permit will not result in a condition that is detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to the public
health, safety or welfare.

welfare as the projects is located within the R1-10 (Single Family Residential) zoning district, and
will be compatible with the surrounding residential uses of the neighborhood. The purpose of the
R-1 ordinance is to provide light, air and a reasonable level of privacy to individual residential
parcels, ensure a reasonable level of compatibility in scale of structures within the neighborhood
and reinforce the predominantly low-intensity setting in the community through setbacks,
daylight plane and privacy planting requirements, and other prescriptive requirements
incorporated within the R-1 Ordinance. The neighborhood is in transition and there is a healthy
mix of single-story and two-story homes in the general area making the proposed project
compatible with the neighborhood.
3. The proposed project is harmonious in scale and design with the general neighborhood.
The proposed project is located in a residential area consisting of single family homes with a mix
of single-story and two-story homes. There are three other two-story homes on the street and
several other newer and older two-story homes in the general neighborhood. This is a neighborhood
in transition and most new homes proposed within the neighborhood are two-story. Overall, the
proposed project maintains the single family home scale found compatible with the general
neighborhood.
4. Adverse visual impacts on adjoining properties have been reasonably mitigated.
Any potential adverse impacts on adjoining properties have been reasonably mitigated through the
privacy protection plantings and installation of a front-yard tree as required.

5. GEOTECHNICAL PLAN REVIEW
The applicant's geotechnical consultant shall inspect, test, and approve all geotechnical
aspects of the development plans to ensure that their recommendations have been
incorporated. The Geotechnical Plan Review should be submitted to the City for review by
the City staff prior to issuance of permits.
6. GEOTECHNICAL CONSTRUCTION INSPECTIONS
The applicant's geotechnical consultant shall inspect, test (as needed), and approve all
geotechnical aspects of the project construction. The inspections shall include, but not
necessarily be limited to: site preparation and grading, site surface and subsurface drainage
improvements and excavations for foundations and retaining walls prior to the placement of
steel and concrete. The following shall specifically be performed:
The applicant's geotechnical consultant shall inspect all foundation excavations to ensure
that the subsurface conditions are as anticipated, and that footings are embedded sufficiently
into competent earth materials.
The results of these inspections and the as-built conditions of the project shall be described
by the geotechnical consultant in a letter and submitted to the City Engineer for review prior
to final project approval.
7. PRIVACY PLANTING
The neighbors on the east side stated they will waive the privacy tree requirement in order
to gain sun exposure to their property, therefore those privacy plantings are not indicated on
the plans. Prior to building permit issuance, the applicant shall submit the waiver and the
final privacy-planting plan (of all required privacy planting) for review and approval from
the Planning Division. The variety, size, and planting distance shall be consistent with the
City's requirements. Should a waiver not be obtained, the applicant shall plant all required
privacy planting in compliance with the R-1 Ordinance.
8. PRIVACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future property
owners of the privacy protection measures and tree protection requirements consistent with
the R-1 Ordinance, for all windows with views into neighboring yards and a sill height that
is 5 feet or less from the second story finished floor. The precise language will be subject to
approval by the Director of Community Development. Proof of recordation must be
submitted to the Community Development Department prior to final occupancy of the

WHEREAS, the City of Cupertino received an application for a Two-Story Permit as
described in Section I of this 1Zesolution;
WHEREAS, the necessary notices were given and the comment period for the application
was provided as required by the Procedural Ordinance of the City of Cupertino;
iNHEIZEAS, the City was able to make the findings required under Section �928.140 (B)
and the application was approved with conditions on January 8, 2016; and
WHEREAS, the notice of decision was mailed to the appropriate parties, including the
applicant and any person who contacted Cify staff with comments during the comment
period, notifying them about the possibility of appealing a project; and
�T�IEREAS, the Planning Commission of the City of Cupertino received an appeal for the
Community Development Director's approval of the Two-Story Permit; and
VVHEIZEAS, the necessary public notices have been given as required by the I'roceclural
Ordinance of the City of Cupertino, and the Planning Commission has held at least one
public hearing in regard to the appeal; and

VVHEREAS, the appellant has not met the burden of proof required to support said appeal;
and
WHEIZEAS, the project is determined to be categorically exempt from the California
Environmental Quality Act (CEQA); and
WI�EIZEAS, the Planning Commission finds as follows with regard to this application:
a) The project is consistent with the Cupertino General Plan, any applicable specific plans,
zoning ordinance and the purposes of this title.
The project is consistent with the regulations and intent of the Cupertino General Plan and
Single-Family Residential (R-1) Ordinance. The project complies with all established and
required setbacks, floor area ratio limitations, privacy protection planting requirements and
other Municipal Code requirements. In addition, the proposed development meets all prescriptive
development requirements of the Parking, Landscape, and Fence ordinances; and the two-story
non-discretionary permit pYocedural Yequirements in the R-1 ordinance.
b) The granting of the permit will not result in a condition that is detrimental or injurious
to property or improvements in the vicinity, and will not be detrimental to the public
health, safety or welfare. :

welfaYe as the projects is located within the R1-10 (Single Family Residential) zoning district,
and will be compatible with the surYounding uses of the neighborhood. The purpose of the R-1
ordinance is to provide light, air and a reasonable level of privacy to individual residential
parcels, ensure a reasonable level of compatibility in scale of structures within the neighborhood
and reinforce the predominantly low-intensity setting in the community through setbacks,
daylight plane and privacy planting requirements, and other prescriptive requirements
incorporated within the R-1 Ordinance. The neighborhood is in transition and there is a healthy
mix of single-story and two-story homes in the general area making the proposed project
compatible with the neighborhood.
c) The proposed project is harmonious in scale and design with the general neighborhood.
The proposed project is located in a residential area consisting of single family homes with a mix
of single-story and two-story homes. There are three other two-story homes on the street and
several other newer and older two-story homes in the general neighborhood. Overall, the
proposed project maintains the single family home scale found compatible with the general
neighborhood.

c1) Adverse visual impacts on adjoining properties have been reasonably mitigated.
Any potential adverse impacts on adjoining properties have been reasonably mitigated through
the privacy protection plantings and installation of a front-yard tree as required.
l�TOVV, THEIZEFORE, BE IT RESOL�TED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, subject to the conditions which are enumerated in this Resolution
beginning on PAGE 2 thereof, the appeal of an application for a Two-Story Permit,
Application no. R-2015-08 is hereby denied and the Director of Community I�evelopment's
approval of the Two-Story Permit is uphelci; and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the Public Hearing record concerning Application
no. IZ-2015-08 as set forth in the Minutes of Planning Commission 1Vleeting of February 23,
2016, and are incorporated by reference as though fully set forth herein.
SECTIOlV III: COlVDITIOlVS ADMIlVISTEREl� �Y THE COIVINIUlVITY DEVELOI'MElVT

1. API'IZOVEI�PROTECT
This approval is based on a plan set entitled, "1Vew Residence 21900 Oakview Lane,
Cupertino CA" consisting of eleven sheets labeled "A.1 to A.10 and a topographic
survey", dated "Received January 6, 2016" except as may be amended by conditions in
this resolution.
2. AlV1VOTATIOlV OF THE COlVI�ITIOlVS OF APPRO�IAL
The conditions of approval set forth shall be incorporated into and annotated on the
building plans.
3. ACCURACY OF THE PIZOTECT PL1-�1VS
The applicant/property owner is responsible to verify all pertinent property data
including but not limited to property boundary locations, building setbacks, property
size, building square footage, any relevant easements and/or construction records. Any
misrepresentation of any property data may invalidate this approval and may require
additional review.

5. COMPLIAlVCE WITH PUBLIC WOI�KS COlVFII�MMAT�OIV FO1�M
The project shall comply with the requirements indicated on the I'ublic VVorks
Confirmation form, including, but not limited to, dedications, easements, off-site
improvements, undergrounding of utilities, all necessary agreements, and utility
installations/relocations as deemed necessary by the I�irector of Public i/Vorks and
required for public health and safety. The I'ublic Works Confirmation is a preliminary
review, and is not an exhaustive review of the subject development. Adclitional
requirements may be established and implemented during the construction permitting
process. The project construction plans shall address these requirements with the
construction permit submittal, and all required improvements sha11 be completed to the
satisfaction of the Director of I'ublic VVorks prior to final occupancy.
6. GEOTEC�ilVICAL PLAlV IZEVIEW
The applicant's geotechnical consultant shall inspect, test, and approve all geotechnical
aspects of the development plans to ensure that their recommendations have been
incorporated. The Geotechnical I'lan I�eview should be submitted to the City for review
by the City staff prior to issuance of permits.
7. GEO�'ECHIVICAL COlVSTIZUCTIOlV IlVSPECTIOlVS
The applicant's geotechnical consultant shall inspect, test (as needed), and approve all
geotechnical aspects of the project construction. The inspections shall include, but not
necessarily be limited to: site preparation and grading, site surface and- subsurface
drainage improvements and excavations for foundations and retaining walls prior to
the placement of steel and concrete. The following shall specifically be performed:
The applicant's geotechnical consultant shall inspect all foundation excavations to
ensure that the subsurface conditions are as anticipated, and that footings are
embedded sufficiently into competent earth materials.
The results of these inspections and the as-built conditions of the project shall be
described by the geotechnical consultant in a letter ancl submitted to the City Engineer
for review prior to final project approvaL
�. PRIVACY PLAlVTIlVG
The neighbors on the east side stated they will waive the privacy tree requirement in
order to gain sun exposure to their property, therefore those privacy plantings are not
indicated on the plans. Prior to building pe�mit issuance, the applicant shall submit the
waiver and the final privacy-planting plan (of all required privacy planting) for review
and approval from the Planning Division. The variety, size, and planting distance shall
be consistent with the City's requirements. Should a waiver not be obtained, the

applicant shall plant all required privacy planting in compliance with the IZ-1
Ordinance.
9. PIZIVACY PIZOTEC'TIOlV COVEIVAlVT
The property owner shall record a covenant on this property to inform future property
owners of the privacy protection measures and tree protection requirements consistent
with the I�-1 Ordinance, for all windows with views into neighboring yards ancl a sill
height that is 5 feet or less from the second story finished floor. 'The precise language
will be subject to approval by the I�irector of Community I�evelopment. I'roof of
recordation must be submittecl to the Community Development Department prior to
final occupancy of the residence.
10. LAIVDSCAPE PROJECT SUBMITTAL:
The applicant shall submit a full landscape projecf submittal, per secfions 490.1, 492.1,

T`his letter confirms the decision of the Director of Community Development, given on January
8, 2016, approving a Two-Story Permit (IZ-2015-08) to allow the construction of a new 5,140
square foot single family residence and a Minor Residential Permit (R1VI-2015-08) to allow a
second story balcony on the new residence, located at��L��� ��fl�vn��r IL�� with the following
conditions:
1. AI'PROVED PROJECT
This approval is based on a plan set entitled, "New Residence 21900 Oakview Lane,
Cupertino CA" consisting of eleven sheets Iabeled "A.1 to A.10 and a topographic survey",
dated "Received January 6, 2016" except as may be amended by conditions in this
resolution.
2. AIVNOTATION OF THE COlVDITIONS OF APPIZOVAL
'I`he conditions of approval set forth shall be incorporated into and annotated on the
building plans.
3. ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including
but not limited to property boundary locations, building setbacks, property size, building
square footage, any relevant easernents and/or construction records. Any misrepresentation
of any property data may invalidate this approval and may require additional review.
4. COMPLIANCE WITH PUBLIC WOIZKS COIVFIRMATION FORIVI
The project shall comply with the requirements indicated on the Public Works Confirmation
form, including, but not limited to, dedications, easements, off-site improvements,

undergrounding of utilities, all necessary agreements, and utility installations/relocations as
deemed necessary by the Director of Public Works and required for public health and
safety. The Public Works Confirmation is a preliminary review, and is not an exhaustive
review of the subject development. AdditionaT requirements may be established and
implemented during the construction permitting process. The project construction plans
shall address these requirements with the construction permit submittal, ancl all required
improvements shall be completed to the satisfaction of the Director of I'ublic Works prior to
final occupancy.
5. GEOTECHIVICAL PLAN REVIEW
The applicant's geotechnical consultant shall inspect, test, and approve all geotechnical
aspects of the development plans to ensure that their recommendations have been
incorporated. The Geotechnical Plan Review should be submitted to the City for review by
the City staff prior to issuance of permits.
6. GEOTECI�NICAL,CONSTRUCTION INSPECTIONS
The applicant's geotechnical consultant shall inspect, test (as needed), and approve all
geotechnical aspects of the project construction. The inspections shall include, but not
necessarily be limited to: site preparation and grading, site surface and subsurface drainage
improvements and excavations for foundations and retaining walls prior to the placement
of steel and concrete. The following shall specifically be performed:
The applicant's geotechnical consultant shall inspect all foundation excavations to ensure
that the subsurface conditions are as anticipated, and that footings are embedded
sufficiently into competent earth materials.
'I'he results of these inspections and the as-built conditions of the project shall be described
by the geotechnical consultant in a letter and submitted to the City Engineer for review
prior to final project approvaL
7. PItNACY PLANTING
The neighbors on the east side stated they will waive the privacy iree requirement in order
to gain sun exposure to their property, therefore those privacy plantings are not indicatecl
on the plans. Prior to building permit issuance, the applicant shall submit the waiver and
the final privacy-planting plan (of all required privacy planting) for review and approval
from the Planning I�ivision. The variety, size, and planting distance shall be consistent with
the City's requirements.
8. PIZIVACY PROTECTION COVENAlVT
The property owner shall record a covenant on this property to inform future property
owners of the privacy protection measures and tree protection requirements consistent with
the R-1 Ordinance, for all windows with views into neighboring yarcls and a sill height that
is 5 feet or less from the second story finished floor. 'The precise language will be subject to
approval by the Director of Community Development. Proof of recordation must be

submitted to the Community Development Department prior to final occupancy of the
residence.
9. LANDSCAPE PROLECT SUBMITTAL
The applicant_shall submit a full landscape project submittal, per sections 490.1, 492.1, and
492.3 of the Department of Water Resources model water efficient landscape ordinance, ���

full landscape project submittal or submit the prescriptive compliance checklist per
Appendix D of the Department of Water Resources model water efficient landscape

��ax��°e fr�e�. The landscape documentation package or prescriptive compliance checklist
shall be reviewed and approved to the satisfaction of the Director of Community
Development prior to issuance of building permits.
10. CONSULTATIOlV WITH OTHER DEPARTNIENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
11. EXTERIOR BUILDING MATERIALS/TREATMEl�TTS
Final building exterior treatment plan (including but not limited to details on exterior color,
material, architectural treatments and/or embellishments) shall be reviewed and approved
by the Director of Community Development prior to issuance of building permits. The final
building exterior plan shall closely resemble the details shown on the original approved
plans. Any exterior changes determined to be substantial by the Director of Community
Development shall require a minor modification approval with neighborhood input.
12. INI�E1ViNIFICATION
Except as otherwise prohibited by law, the applicant shall indemnify and hold harmless the
City, its City Council, and its officers, employees and agents (collectively, the "indeirulified
parties") from and against any claim, action, or proceeding brought by a third party against
one or more of the indexnnified parties or one or more of the indemnified parties and the
applicant to attack, set aside, or void this Resolution or any permit or approval authorized
hereby for the project, including (without limitation) reimbursing the City its actual
attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such
attorneys' fees and costs within 30 days following receipt of invoices from City. Such
attorneys' fees and costs shall include amounts paid to counsel not otherwise employed as
City staff and shall include City Attorney time and overhead costs and other City staff
overhead costs and any costs directly related to the litigation reasonably incurred by City.
13. 1VOTICE OF FEES I�EDICATIONS RESERVATIOlVS OR OT�IER EXACTIOlVS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the

amount of such fees, and a description of the dedications,reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a),has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020; you will be legally barred from later
challenging such exactions.

Prior to the start of the comment period for the project,three neighbors communicated their
objection to a fwo-story home and concerns about lost privacy, reduced daylight exposure,
possible existing ground contamination, and increased construction noise in the cul-de-sac to
staff.Staff inet with two of the three property owners who responded to meeting requests to
better understand their concerns and to answer their questions.
In addition to staff outreach,the property owner also met with these neighbors to try to address
their concerns.As a potential solution to the concerns discussed at the meetings,the property
owner made the following changes to the plans:
� Replaced two previously proposed openable second story windows along the western
property line with fixed,obscured windows, and
� Removed eight existing Italian Cypresses(Cupressus sempervirens) along the eastern
property line(neighbor agreed to sign a privacy waiver for the trees that were required as
privacy protection in order to benefit from the additional daylight).
During the comment period for the permits, staff received supplemental letters from two of the
three neighbors,who previously commented,reiterating their concerns and highlighting their
general objection to the construction of a two-story residence.
The proposed project is within the parameters of single-family residence approvals.Therefore
staff has determined that the proposed project is in compliance with the provisions of Chapter
19.28.140 (A) and 19.28.140(B) of the Cupertino Municipal Code, and no additional conditions
of approval were required in order to address the comments raised during the noticing period..
Staff has made all the findings that are required for approval of a 'Two-Story Permit and 1Vlinor
Residential Permit as required by Cupertino's Municipal Code, Chapter 19.28.140 (A) and(B).
1. 'The project is consistent with the Cupertino General Plan, any applicable specific plans,zoning
ordinances and the purposes of this title.
The proposed project is consistent with the General Plan as the project is within the Low
Density land use area. There are no applicable specific plans that affect the project. The
project has been found to be consistent with the requirements of Cupertino Municipal
Code Chapter 19.28 Single Family (R-1) Residential. The R1-10 Zoning district, in
which this property is located in, allows the development of two-story homes.

2. The granting of the permit will not result in a condition that is detrimental or injurious to
property improvements in the vicinity, and will not be detrimental to the public health, safety or
welfare.

in the general neighborhood.
4. Adverse visual impacts on adjoining properties have been reasonably mitigated.
Any potential adverse visual impacts on adjoining properties have been reasonably
mitigated through the installation of privacy protection plantings as required by the
Single Family R1 Ordinance.
