No response. 3/9 -followed up again with B of A Branch Manager, no eesponse. 3/18-sent first mailing notice, using Cupertino City's address labels,to neighbors and property owners within 500 ft about Marina Project's open house on 4/7 and 4/9. 3/28-sent second mailing notice about the open house. 3/31- went to B of A again, and connected with the Branch Manager. Showed him the plans and asl<ed for his assistance in reaching out to Mr. Saich. 4/4-Connected with B of A Facilities Manager of JLL, and sent him the link to Marina's project. 4/4-JLL Manager didn't have concerns about the project. 1 4/13-JLL Manager asked Marina's assistance to provide to him B of A landlord's name (Mr.Saich) as well as the owner's Property Manager's contact info so he can forward to them the W-9 and leasing info. 4/15- second letter to atl adjacent property owners about the Project. 4/26- Mr.Saich's attorney contacted Marina's attorney requesting all communication be in writing. Did not want meeting. 5/3 -sent color coded map of the parcels to Mr. Saich's attorney and again requested a meeting. 5/5 to 5/17-left several phone messages with Mr. Saich's attorney. No response. 5/27-Called Mr. Saich attorney and connected. A meeting was agreed to, on 6/8. 6/8- met with Mr. Saich, his attorney and his real estate manager. Questions about utility easements were responded. At conclusion of the meeting, they wanted more time to review project. 6/10-sent a suggested alternative to open up the Ingres/egress. Not accepted. 6/17-sent another suggested alternative with parking on Marina easement. Not accepted. 6/24-informed Mr. Saich's attorney about the research on the easement issues. It appears there's no legal basis for Mr. Saich's concerns. 7/4-followed up with Mr.Saich attorney about the easement issue 7/25- Mr. Saich's attorney responded they did more research on the easement and found the intent but is still checking on the recorded documents to support their claim.
