To Cupertino Building Department From Connie Lin of DBLIN Construction Date 8/30/2016 Subject removing DBLIN Construction from permit 15110051 and 15110052 DBLIN Construction is writing this letter for the purpose of removing the name and license on the project at 10104 Byrne Avenue, Cupertino, CA 95014 This project contains two parts, the construction of main house (permit 15110051), and construction of guest house (permit 15110052) Construction started on the guest house first, from early May, until 6/30, when Cupertino city inspector granted the tag for electricity and gas connection After that, owners claimed that without PG&E connection of electricity and gas, they cannot move into the guest house, and would not allow the main house construction to start. Since then, the project has been on hold until today, and two months have passed Since owners refused to provide a confirmed date for construction to continue, DBLIN Construction Company has made the difficult decision to finally remove the name and license from this construction project As of 6/30/2016, the newly constructed guest house passed all rough inspections and gas/electrical tag inspections have passed also No further city inspections were performed at this job site from 6/30 to today Once electricity and gas are provided, this guest house should be ready for final inspection at any time Since DBLIN Construction Company cannot decide how owner and PG&E would work out on the supply of electricity and gas, to avoid further liability risks, we would want to be removed from this project and return the building permit to the city I would appreciate your understanding Sincerely, Connie Lin General Contractor at DBLIN Construction Patricia Garcia From: Albert Salvador Sent: Tuesday, August 30, 2016 10:33 AM To: info DBLin Cc: Patricia Garcia Subject: RE: removing my license from a building permit - Connie, I received your letter and will place it in our files. As we discussed at the counter and in my prior email, the City cannot just remove your name as the contractor of record without some other person or firm take responsibility for the work completed to date. That said, I also put a hold on the project to require the new contractor or owner to come to the City to sign for the building permit prior to accepting any new inspection requests. I hope this takes care of some of your concerns. You should consult with your own lawyer to ensure you have covered all your issues as it relates to this project. I will bring the building permit card, which I assume will be needed during our meeting. Thank you. What I can offer is for you to write a letter explaining the situation and that you will no longer be involved with the project. I suggest you have pictures of the project in your files to document the work you did so you can identify any future work not done by you. I could file the letter in our records. If the City receives a subpoena for records in the future, your letter will be on file. Furthermore, you should consult with your own lawyer to ensure you have covered all other bases. > Regards, > Albert Salvador, P.E., C.B.O. > Building Official > City of Cupertino > On Aug 29, 2016, at 3:29 PM, DBlin <info. dblin. constructioni? mail.com<mailto:info. dblin.construction( a gmail.com>> wrote: > > Hi Albert, > Thank you for your quick response. In case the owner does not have another GC at this moment, and they don't want to be the owner builder, what can I do? Despite my multiple inquires, The owner is not confirming on the continuation of the project. The project has been on hold for two months, and I cannot be liable for the job site that I am not working on. It is a risk for me. I hope you understand my perspective from the GC point of view. > I checked with building department two months ago and was told that I CAN withdrawal from the permit, even the owner does not pick up the permit.
