Contractor agrees to save and hold harmless the City, its officers,agents and employees from any and all damage and liability of every nature, including all costs of defending any claim,caused by or arising out of the per- formance of this agreement.City shall not be liable for acts of Contractor in performing services described herein. Insurance. Should the City require evidence of insurability Contractor shall file with City a Certificate of Insurance before commencing any services under this agreement.Said Certificate shall be subject to the approval of City's Director of Administrative Services. Non-Discrimination. No discrimination shall be made in the employment of persons under this agreement because of the race,color, national origin,ancestry, religion or sex of such person. Interest of Contractor. SCOPE OF WORK: • The work to be accomplished is to provide and install supply and return ducts additions to an existing air conditioning system. II. LOCATION: The work is located in the basement of the City of Cupertino City Hall at 10300 Torre Avenue in a partially completed employee's lounge. III. PERMITS: No permits are required. IV. TIME OF COMPLETION: The Contractor shall diligently prosecute the work and said work shall be completed within fifteen (15) working days from the date of the contract. V. SPECIFICATIONS: A. General All work shall be accomplished in, accordance with current industry standards and with the following: 1. AMACNA - Low Pressure Duct Construction 2. N.E.S.C.A, - Manual 9 3. Uniform Building Code and Uniform Mechanical Code 4. The Plans and Specifications for the Basement Modification VI. DAMAGE TO EXISTING EQUIPMENT AND CONSTRUCTION: The Contractor shall insure that all existing construction is not damaged or modified without the approval or consent of the Engineer. The Contractor shall exercise great care in performing all demolition and/ or modifications to existing equipment so that all permanent work shall be durable and perform its intended function. - 1 - • • • VII. DUST AND NOISE CONTROL: The Contractor shall insure that all construction related dust shall not spread 'beyond the limited area of work.
