WHEREAS, Declarants are the owners of certain real property located in the City of Cupertino, County of Santa Clara, more particularly described as follows: Lot 11 and portion of Lot 12 (See Exhibit B attached) "Tract No. 124 subdivision of the• Van Dine Tract" more commonly known as the "Coach House Shopping Center". (See Exhibit. A attached) . WHEREAS, Declarants propose to implement a sign program as outlined in City of Cupertino Architectural and Site Approval Committee Resolution No. 1012. WHEREAS, the Architectural and Site Approval Committee,, as' a condition to approval of the above described proposal has required compliance by Declarants with certain covenants, conditions„ and restrictions, further described as follows: Architectural and Site Approval Committee Resolution No. 1012: Condition No. 10 ". . . , the applicant shall record a covenant., subject to the approval of the City Attorney, stating that the two remaining ground signs shall be removed within five years. The covenant shall also state that the City shall remove these signs, at the owner's expense, should they still remain after five years. . ." 1. Agreement to. Comply with Conditions: In satisfaction of the above- referenced condition, Declarants hereby ensure that said signs 'shall be removed on or prior to March 22, 1987. . 2. Rights Appurtenant: This declaration is intended to be a covenant running with the land and shall bind and inure to the benefit of the heirs, personal representatives, successors and assigns-of each present and future owner of real,prloperty described herein.
