AUTHORIZING EXECUTION OF AGREEMENT WITH MPA DESIGN
PROVIDING FOR LANDSCAPE ARCHITECTURAL SERVICES
FOR THE STEWS CANYON ROAD REPAIR PROTECT
WHEREAS, the City is desirous of engaging the services of a consultant
to provide landscape architectural services for. the Stevens Canyon Repair
Project; and
WHEREAS, the firm of MPA Design is qualified and willing to provide
the necessary services; and
WHEREAS, an agreement between the City of Cupertinb and MPA Design
outlining the terms and conditions of the required services, has been
presented to the City Council; and said agreement having been approved by
the Director of Public Works and the City Attorney;
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and the City Clerk are
hereby authorized to execute the agreement herein referred to in behalf of
the City of Cupertino this 2ndday of June , 1986, by the following

by and between the CITY OF CUPERTINO (Hereinafter referred to as CITY) and

COMPENSATION For the full performance of this Agreement,CITY shall pay CONTRACTOR:
ONE THOUSAND THREE HUNDRED SEVENTY and 00/100 DOLLARS ($1,370.00)
GENERAL TERMS AND CONDITIONS
Hold Harmless. Contractor agrees to save and hold harmless the City, its officers,agents and employees from any and
all damage and liability of every nature, including all costs of defending any claim,caused by or arising out of the per-
formance of this agreement.City shall not be liable for acts of Contractor in performing services described herein.
Insurance. Should the City require evidence of insurability Contractor shall file with City a Certificate of Insurance
before commencing any services under this agreement.Said Certificate shall be subject to the approval of City's
Director of Administrative Services.
Non-Discrimination. No discrimination shall be made in the employment of persons under this agreement because of
the race,color, national origin,ancestry, religion or sex of such person.
Interest of Contractor. It is understood and agreed that this agreement is not a contract of employment in the sense
that the relation of master and servant exists between City and undersigned.At all times Contractor shall be deemed to
be an independent contractor and Contractor is not authorized to bind the City to any contracts or other obligations in
executing this agreement. Contractor certifies that no one who has or will have any financial interest under this
agreement is an officer or employee of City.
Changes. This agreement shall not be assigned or transferred without the written consent of the City. No changes or
variations of any kind are authorized without the written consent of the City.

Subject: Stevens Canyon. Road Repairs Fee Proposal
Dear Travice:
MPA Design is pleased to submit this fee proposal for landscape
architectural services for the City of Cupertino, Stevens Canyon
Road repairs. As we discussed yesterday, the disturbed area will be
adjacent to the new wall, rip rap slope and paved edge of road and
not the entire slope each side of road as previously thought. This
greatly reduces the amount of slope to be exposed to possible
erosion.
Since irrigation will not be a part of this contract, we will
carefully specify native plantings and moisture retentive soil mix
and mulch to provide the best possible growth. Also, the commonly
specified 60 day plant maintenance period may be increased to 90
days to insure plant survival through fall and into the rainy
season.
Our scope of work includes the following:
1. Create base drawing based on civil engineer's plans.
2. Provide design development plan identifying plant types, sizes,
locations.
3. Provide estimate of probable construction costs.
4. Submit design development drawings by mail for City review and
approval.

budget, prepare construction drawings and specifications

A. Planting plan and details
B. Specifications
Compensation
Our proposed fee for landscape architectural services for design
development and contract documents will be $1,370.
Construction consultation if requested, will be figured on a time
and materials basis at time of construction.
Direct costs such as printing, reproduction, freight, delivery
charges, transportation, and long distance calls will be reimbursed
at cost plus 10% above the lump sum fee.
