WHEREAS, Declarant is the owner of certain real property in the
City of Cupertino, County of Santa Clara, more particularly described
as follows:

All of Parcel B as said parcel is shown on that certain map entitled
"Parcel Map being a portion of the Northeast 1/4 section 13, Township 7,
South, Range 2 West, M.D.B & M.", which map was recorded in Book 498 of
maps at page 34, records of Santa Clara County.
WHEREAS, Declarant and/or persons acting on behalf of Declarant
propose to alter the present ground sign of said real property in the
following manner:
New ground sign installed in the existing ground
sign location
WHEREAS, the City Council of the City of Cupertino, acting through
its duly authorized commissions and staff, as a condition to approval of
the above-described proposal has required compliance by Declarant with
certain covenants, conditions, and restrictions, further described as
follows:

CONDITION #10 GROUND SIGN LOCATION
The new ground sign may be temporarily installed in the
existing ground sign location. Prior to issuance of
building permits, the applicant shall record a covenant
running with the land agreeing to relocate the ground sign
to the location shown on the Staff Exhibit at such as the
City determines that the relocation is necessary because of
street or streetscape improvements or an application for
discretionary approval. The covenant shall be approved by
staff prior to recordation.
1. Agreement to Comply with Conditions: In satisfaction of the
above-referenced condition, Declarant hereby notices all future property
buyers of the ground sign condition and mitigation.
