88-008 Santa Clara County Traffic Authority & City Construction of Drainage System Improvement at Stevens Creek Overcrossing at Route 85, Resolution No. 7432 , AGREEMENT BETWEEN THE SANTA CLARA COUNTY TRAFFIC AUTHORITY AND THE CITY OF CUPERTINO FOR THE CONSTRUCTION OF DRAINAGE SYSYEM IMPROVEMENTS AT STEVENS CREEK BOULEVARD OVERCROSSING OF ROUTE 85 THIS AGREEMENT, made and entered into this 16th day of • February , 1988 , by and between the SANTA CLARA COUNTY TRAFFIC AUTHORITY ("TRAFFIC AUTHORITY") , and the CITY OF CUPERTINO ("CITY") ; WITNESSETH: WHEREAS, the public interest requires the construction of the Stevens Creek Boulevard overcrossing and related street work at Route 85 ("PROJECT") , beginning at a point approximately one-hundred feet east of the Bubb Road intersection for a distance of approximately one-thousand and seventy feet easterly along Stevens Creek Boulevard. Such construction will consist of a new cast-in-place concrete bridge structure; reconstruction of Stevens Creek Boulevard, within the limits as described hereto; and all associated work required to complete the PROJECT in accordance with the approved construction drawings;and WHEREAS, it is in the best interests of orderly and economic construction practices to complete the PROJECT through joint action of the TRAFFIC AUTHORITY and the CITY under a single construction contract awarded and administered by the CALIFORNIA DEPARTMENT OF TRANSPORTATION ("CALTRANS") ; , NOW,. THEREFORE, for and in consideration of their mutual a' promises, covenants and agreements hereinafter set forth, and subject to the terms, provisions and conditions set forth below, the parties hereto do agree as follows: 1. Preparation of Plans and Specifications . The TRAFFIC AUTHORITY and CALTRANS will prepare all plans and specifications for the PROJECT. 2. CITY'S Estimated Share of Cost. The CITY shall pay to the TRAFFIC AUTHORITY. within thirty (30) days of the award of bid, Twenty-eight Thousand and six hundred dollars ($28 , 600 . 00) , which is the amount presently estimated to be the CITY'S share of the PROJECT, for the drainage system improvements described in Attachment "A" . The CITY shall pay the exact amount, calculated upon completion of said PROJECT, based on actual, installed quantities and costs incurred for drainage system bid items, as shown in Attachment "A" . In no event, without subsequent modification of this Agreement and mutual consent of the parties hereto, shall the CITY'S share of the cost of the drainage system improvements exceed the sum of Thirty-five Thousand Dollars ($35, 000. 00) . 3. Termination. This Agreement shall terminate on July 1, 1988_if CALTRANS has not awarded the contract for the construction of the PROJECT prior to that date, unless the date of termination of this Agreement has been changed by an amendment hereto. 4 J Y Y .
