Approval of the revised Memorandum of Agreement for the Santa Clara Valley Urban Runoff Pollution
Prevention Program, and resolution to reapply for reissuance of the City of Cupertino's Municipal Storm Water
NPDES Permit.
BACKGROUND
In April 1990, the City Council approved Resolution No. 8076 authorizing Cupertino to enter into an Agreement
providing for the Implementation of the Santa Clara Valley Nonpoint Source Pollution Control Program
(Agreement). This Agreement joined Cupertino, twelve other cities in Santa Clara County, Santa Clara County
and the Santa Clara Valley Water District(District)together as "Co-permittees." The Agreement allowed these
entities to jointly apply for, and implement, their National Pollution Discharge Elimination System (NPDES)
storm water permits and outlined area-wide programs including cohesive program planning, water quality
monitoring, and outreach and education programs. In August 1995, the San Francisco Bay Regional Water
Quality Control Board (Regional Board) re-issued the Co-permittees' NPDES permit for municipal storm water
discharges, in the second round of permits under the 1987 Clean Water Act Amendments. The Program is
currently preparing to apply for its third NPDES permit to be submitted in December. Under this permit, the
Co-permittees will continue to implement and annually evaluate and improve their Urban Runoff Plans, while
participating jointly in activities that are most efficiently implemented region-wide.
The revised MOA was developed to implement the following goals:
I. Ensure the continued systematic and orderly compliance with permit requirements.
2. Increase Program performance and promote efficiency by providing an opportunity to contract out
administrative tasks where costs could be reduced.
3. Allow cost-share savings to be redirected into local program implementation.
The Santa Clara Valley Water District's (District) resignation as program administrator in 1997 resulted in
additional revisions to the MOA to clarify the role and oversight of the current Program Managers, EOA, Inc.,
and the District's role as contracting agent and fiscal agent. There are no cost implications associated with
approval of the Memorandum of Agreement. Costs associated with the Program were presented to City Council
in July as part of the annual Engineer's Assessment of Fees Report.
City Council approval of the revised MOA would continue Cupertino's participation as a Co-permittee and
provide for orderly and systematic compliance with the area-wide provisions of the NPDES permit for storm
water discharges.

STAFF RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 99-337, authorizing the Mayor to sign the
revised Memorandum of Agreement (MOA) on behalf of the City and adopt Resolution No. 99-3W, to
reapply for reissuance of the city's storm water NPDES permit. Approval of this MOA would continue
Cupertino's participation in the Program for the purpose of complying with Cupertino's Municipal Separate
Storm Sewer System NPDES permit requirements, pursuant to the federal Clean Water Act.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO TO REAPPLY
FOR REISSUANCE OF ITS MUNICIPAL STORMWATER NATIONAL POLLUTANT
DISCHARGE ELIMINATION SYSTEM(NPDES) PERMIT
WHEREAS, the U.S. Environmental Protection Agency, under amendments to the 1987
Federal Clean Water Act, imposed regulations that mandate local governments reduce to the
maximum extent practicable that amount of pollutants in storm water discharged from municipal
storm drain conveyance systems, and;
WHEREAS, under authority of California Porter-Cologne Water Quality Control Act, the
State Water Resources Control Board and its Regional Boards have been delegated the authority
to adopt NPDES permits and waste discharge requirements for municipal stormwater discharges,
and;
WHEREAS, the San Francisco Bay Regional Water Quality Control Board's Water
Quality Control Plan specifically requires that all municipalities in Santa Clara County that
discharge storm water to San Francisco Bay and the Santa Clara Valley Water District (District)
have municipal storm water NPDES permit coverage and;
WHEREAS, the San Francisco Bay Regional Water Quality Control Board adopted an
NPDES permit (CAS029718), Order No. 95-180, on August 23,1995 for the municipalities in
Santa Clara County and the District, as described above, and;
WHEREAS, the adopted NPDES permit requires that the municipalities in Santa Clara
County and the District reapply for reissuance of their municipal stormwater NPDES permit by
December 21, 1999, and;
WHEREAS, the Santa Clara Valley Urban Runoff Pollution Prevention Program's
(SCVURPPP) Management Committee has compiled the necessary information and prepared the
application package for NPDES reissuance, and;
WHEREAS, the permit application represents mainly a continuation of the storm water
pollution prevention and control activities that are currently being implemented and associated
costs.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Cupertino
that:
1. The City of Cupertino hereby agrees to reapply to the San Francisco Bay Regional Water
Quality Control Board for reissuance of its municipal storm water NPDES permit; and

2. The City of Cupertino commits to implement it's Urban Runoff Management Plan and the
area-wide components of the Santa Clara Valley Urban Runoff Pollution Prevention Program
(SCVURPPP) Urban Runoff Management Plan and requests that the SCVURPPP's Manager
sign and submit the NPDES Permit Application Package to the San Francisco Bay Regional
Water Quality Control Board as part of the reapplication for NPDES permit reissuance, and
3. The City of Cupertino Clerk is hereby directed to forward a copy of this Resolution to the
SCVURPPP's Manager.

THIS AGREEMENT is made and entered into this dayof , 1990 by and

State of California; COUNTY OF SANTA CLARA, a subdivision of the State of California; CITY
OF CAMPBELL, a municipal corporation of the State of California; CITY OF CUPERTINO, a
municipal corporation of the State of California; CITY OF LOS ALTOS, a municipal corporation
of the State of California; TOWN OF LOS ALTOS HILLS, a municipal corporation of the State
of California; TOWN OF LOS GATOS, a municipal corporation of the State of California; CITY
OF MILPITAS, a municipal corporation of the State of California; CITY OF MONTE SERENO,
a municipal corporation of the State of California; CITY OF MOUNTAIN VIEW, a municipal
corporation of the State of California; CITY OF PALO ALTO, a municipal corporation of the
State of California; CITY OF SAN JOSE, a municipal corporation of the State of California; CITY

All of the previous above mentioned entities are hereinafter collectively referred to as
"PARTIES".

RECITALS
It is agreed that:
A. The 1986 Water Quality Control Plan for the San Francisco Bay (Basin Plan),
adopted by the Regional Water Quality Control Board in implementation of the Federal Clean
Water Act, requires that the PARTIES develop a Program to control pollution from urban runoff,
or nonpoint sources of water pollution in the Santa Clara Valley.
B. In furtherance of their responsibilities pursuant to the Basin Plan, the PARTIES
have previously entered into a series of agreements to jointly fund the cost of preparing an action
plan to evaluate nonpoint source pollutants, monitor identified pollutants and develop control
measures to mitigate or reduce nonpoint source pollution. Collectively, the measures undertaken
pursuant to the previous agreements and anticipated to continue pursuant to this Agreement, are
known as the Santa Clara Valley Nonpoint Source Control Program(hereinafter"Program"),which
consists of an Areawide Component and a Community Specific component as described in Santa
Clara Valley Nonpoint Source Control - VOLUME III, Program Implementation Program dated
March 1990.
C. The PARTIES desire to continue the Program and to enter into this Agreement for
the purpose of ensuring continued participation,in terms of cost and administrative responsibilities.
D. This Agreement does not amend or supersede any prior agreement among the
PARTIES regarding the Program, but is to be read as in accord with and implementation thereof.
E. The District is a local public agency of the State of California duly organized and
existing and empowered to provide maintenance and flood control management of the streams and
to prohibit the discharge of polluting stormwaters into surface streams,reservoirs or conduits of any

kind within the area of the County of Santa Clara. The County of Santa Clara and all of the cities
therein are subdivisions of the State with authority to control the discharge of surface waters from
their respective jurisdictions.
NOW, THEREFORE, THE PARTIES HERETO FURTHER AGREE, AS FOLLOWS:
AGREEMENT:
1. A Management Committee is hereby created to provide overall program direction,
review and recommend an annual budget for approval by the PARTIES, budget oversight, all in
accordance with Santa Clara Valley Nonpoint Source Control Program - VOLUME III, Program
Implementation, dated March 1990. The Management Committee membership is shown on
Exhibit A hereto. The Management Committee shall adopt bylaws for its governance. No action
shall be taken by the District which requires expenditures by any party other than the District
without prior Management Committee.approval.
2. Pursuant to direction of the Management Committee the District shall administer
and coordinate the Program, which duties include but are not limited to:
(a) Preparing draft annual budget and, periodic status reports on Program
activities and expenditure and distributing same to PARTIES at least quarterly;
(b) Consolidating and submitting reports prepared by the several PARTIES
required by the NPDES permit;
(c) Letting and administering approved consultant contracts;

(d) Maintaining knowledge of and advising the PARTIES regarding current and
proposed state and federal policies, regulations and programs that impact nonpoint
source pollution programs;assisting the PARTIES in development and presentation
of positions on these issues before State and Federal agencies;
(e) Preparing an annual report on the implementation of the Program.
(f) Representing the PARTIES in participation in.the Bay Area Stormwater
Management Agencies Association; and
(g) Formally advising the cognizant State and Federal agencies of termination
or amendment of this Agreement.
3. The PARTIES accept and agree to perform the following duties:
(a) Each will fully comply with the NPDES permit conditions applicable to its
Community Specific Program and its identified portion of the Areawide Program;
(b) Each will participate in Management Committee meetings and other required
meetings of the PARTIES;
(c) Each will fund and implement its Community Specific Program,and will fund
and implement its share of the Areawide Program;
(d) Each will provide agreed upon reports to the District on compliance with
applicable provisions of the NPDES permit and program implementation.

4. By agreement of the PARTIES, budget allocations shall be made in the proportions
shown in the schedule marked Exhibit B hereto.
5. This Agreement shall have a term of five (5) years from the first day of January
1990, subject to automatic renewal for a like period in the absence of objection thereto made in
writing by any party 90 days in advance of the renewal date. Any Party may terminate its
participation in this Agreement in any year in which funds for continued participation in the
Program are not appropriated by its legislative body.
6. The PARTIES shall retain the ability to individually(or collectively) request permit
modifications and initiate permit appeals for permit provisions to the extent that a provision affects
an individual party or group of PARTIES.
7. This agreement may be amended from time to time by agreement of the parties.

AGREE this 1St day of August , 1989, as follows:
The parties have heretofore agreed to join in meeting the cost of continuing the
Santa Clara Valley Nonpoint Source Program.
,AGREEMENT:
1. Santa Clara Valley Water District (hereafter "District") shall assume a
significant coordination role in carrying out the program and shall extend the contract
with Woodward-Clyde Consultant for work approved by the agencies.
2. A Task Force consisting of representatives of agencies specified on "Exhibit
A" hereto, so marked and made a part hereof, shall oversee and direct the consultant sc
engaged.

Subject: Nonpoint Source Discharge Evaluation Action Plan - Agreement No. A0866a,

On Tuesday, August 1, 1989, the District Board of Directors authorized extension of the above-
described Cost-Sharing Agreement.
The Agreement provides for cost-sharing of the Nonpoint Source Program between the District,
the 13 cities of Northern Santa Clara County and the County of Santa Clara at a currently
estimated not-to-exceed cost of$900,000. The $900,000 budget would provide for an extension of
the present contract for engineering services with Woodward-Clyde Consultants and new funds for
the Aquatic Habitat Institute to design and implement research and monitoring to evaluate the
present and potential future effects of pollution on the beneficial uses of the waters of the Bay.
Following execution of the enclosed Agreement by all parties and execution of contracts with
Woodward-Clyde Consultants and Aquatic Habitat Institute, we will submit a statement of your
anticipated costs payable to the District within 30 days thereafter.
We would encourage your early execution of the Agreement. If we can be of assistance in that
regard,please let me know. Please send a copy of the executed Agreement to Susan A. Pino, Clerk
of the Board, at this address.

A. The parties have heretofore agreed to join in meeting the cost of preparing a •
proposal for evaluation of nonpoint source pollution.
B. Said proposal, denominated "Santa Clara Valley Nonpoint Source Discharge
Evaluation Action Plan" (hereafter "the action plan" has been approved by the San
Francisco Bay Regional Water Quality Control Board on August 19, 1987.
C.— This-agreement will-similarly-allocate-responsibility_fotimplementation_of_the
action plan.

AGREEMENT:
1. Santa Clara Valley Water District shall assume a significant coordination role
in carrying out the program proposed in the action plan and shall select a professisonal
consultant for the work in accordance with its established selection procedures.

2. A Task Force consisting of representatives of agencies specified on "Exhibit
A" hereto, so marked and made a part hereof, shall oversee and direct the consultant so
engaged.
3. The parties shall share in meeting the cost, including the consultant's fee and
the necessary and reasonable cost incurred by District, in the proportions stated in the
schedule thereof marked "Exhibit B" attached hereto and made a part hereof. The
indicated shares are based on proportional stormwater runoff from the respective
jurisdictions as computed for purposes of District's Benefit Assessment Revenue
Program. - - -
4. The total cost to be so apportioned shall not exceed $1,200,000.
5. This agreement will be effective as to signing parties upon the execution of
parties sharing 90% or more of the apportioned cost. District will thereupon proceed to
secure the services of a consultant as stated in paragraph 1 above. If execution is
refused by one or more of the balance of the named proposed parties hereto the share of
such party or parties will be met by the executing parties other than District in the
general proportion shown on "Exhibit B" or by such division as the executing parties other
than District may determine and agree upon.

WHEREAS, there has been presented to the City Council an agreement by
and between the Santa Clara Valley Water District, the County of Santa
Clara, and participating cities of which
Cupertino is a participant, for
the preparation and review by the Regional Water Quality Control Board a
detailed proposal for the evaluation of nonpoint source pollution; and
WHEREAS, said agreement outlines the cost sharing proportions of the
participants, which is to supersede the cost sharing participation as
approved in the original agreement entered into by all agencies and
approved by the City of Cupertino through Resolution No. 7136 on April 6,
1987;
NOW, . THEREFORE, BE IT RESOLVED, that the Mayor and the City Clerk are
hereby authorized to sign the aforementioned agreement in behalf of the

AUTHORIZING EXECUTION OF ',AGREEMENT REGARDING EVALUATION
OF NONFOINT SOURCE OF WATER POLLUTION" WITH THE SANTA
CLARA VALLEY WATER DISTRICT AND CITIES IN SANTA CLARA COUNTY
PEEFEAS, the San Francisco Bay Basin Water Quality Control Plan of the
San Francisco Bay Regional Water Quality Control Board requires that local
agencies in the County of Santa Clara shall prepare for review by said
Regional Board a detailed proposal for evaluation of nonpoint source
pollution; and
WHEREAS, the Santa Clara Valley Water District will assume the
responsibility of lead agency in coordinating the effort in accomplishing
said requirement in a joint effort with participating agencies within the
County of Santa Clara; and
W WHEREAS, there has been presented to the City Council an agreement
with the Santa Clara Valley Water District and all participating agencies
of which Cupertino is a participant;
NOW, 'THEREFORE, BE IT RESOLVED that the City Council of the City of
Cuperhereby approved the agreement and authorizes the Mayor and the
City Clerk to execute the aforementioned agreement in behalf of the City
of Cupertino.

RECITALS:
•
A. The San Francisco Bay Basin Water Quality Control Plan of
the San Francisco Bay Regional Water Quality Control Board requires •
that local agencies in the County of Santa Clara (viz, the parties
to this agreement) shall prepare for review by said Regional Board
a detailed proposal for evaluation of nonpoint source pollution by
June 15, 1987.
B. This agreement will provide for the allocation of
responsibility for the work and for distribution of the cost thereof. .

AGREEMENT:
1. In accordance with the Basin Control Plan, the Santa Clara
Valley Water District (hereinafter District) is assuming a significant
coordination role in development of this program and shall undertake
to secure the services of a consultant in accordance with District
procedures on selection of professional consultants.
2. A Task Force consisting of representatives of agencies
specified on "Exhibit A" hereto, so marked and made a part hereof,
shall oversee and direct the preparation by the consultant so engaged
of the proposal mentioned in Recital A above.
_3. The parties shall share in meeting the cost of the proposal,
including the consultant 's fee and the necessary and reasonable cost
incurred by the District therein, in the proportions stated in the
schedule thereof marked "Exhibit B" attached hereto and made a part
hereof. The indicated shares are based on proportional stormwater
runoff from the respective jurisdictions as computed for purposes of
District's Benefit Assessment Revenue Program.
• 4. The total cost to be so apportioned shall not exceed
$150,000.
5. This agreement will be effective as to signing parties upon
the execution of parties sharing 75% or more of the apportioned cost.
District will thereupon proceed to secure the services of a consultant
as stated in paragraph 1 above. If execution is refused by one or
more of the balance of the named proposed parties hereto the share
of such party or parties will be met by the executing parties other
than District • in the general proportion shown on Exhibit B or by such
division as the executing parties other than District may determine
and agree upon.
