AMENDMENTS: To chapter 19.40 Residential Hillside (RHS) zones of the Cupertino
Municipal Code related to exception findings, house size, grading quantity and other subjects to
be determined by the Planning Commission. Amendments to Chapter 19.08 (Definitions) of the
Cupertino Municipal Code related to definition of basement.
Bob Cowan stated the purpose of this item is to clari~ and clean up the existing RHS Ordinance.

AMENDMENTS: To chapter 19.48 regarding procedure for modification of definitive
development plan in a Planned Development Zone, and chapter 14.18 regarding tree removal
procedure.
Bob Cowan stated this item is another effort of streamlining our existing ordinances. Commission and
Council will be notified of these actions at which point they may appeal in the fourteen day appeal
p~riod.

Applicant: Citation Homes

Location: Southeast comer of DeAnza Boulevard and Homestead Road
ZONING: To rezone 18 acres from P (RES 20-35) to P (RES 10-20) as shown in Exhibit B.
Request to delete conditions regarding common area including the following City
Council Actions letters: condition No 1 of 6-TM-94 dated October 5, 1994, conditions
No. 15 of 10-U-89 dated August 17, 1989, conditions No. I of 8-U-94 (M) dated October
- 5, 1994, Condition No. 1 of City Council Action letter dated September 7, 1995,
condition No. 9 of g-U-94 (fYI) dated October 20, 1995 and condition No. 3 of 6-TM-95
dated October 16, 1995.
Bob Cowan explained the proposal to rezone the entire 18 acres to a 10-20 area. Aisc condition 15
(accessibility to project open space) will be considered. Since approval of this condition by the Planning
Commission, Portofino and Corsica homeowners have reached an agreement that condition 15 be
deleted. This deletion of this condition is a procedural matter that the Planning Commission will vote
on, therefore in terms of environmental issues this is of no consequence.

ZONING: A .7 acre parcel to P(RES - 4.4 - 7.7 dwelling units per gross acre)
Colin Jung presented this item regarding rezoning from commercial to residential. The general plan
designation was changed in 1993 for this parcel. The applicant is planning a small lot single thmily
development. Thc environmental issues of concern are traffic noise levels along Stevens Creek
boulevard that exceed general plan standards. Thc applicant is proposing to construct a soundwall along
a portion of lot ! to mitigation noise levels from auto traffic, in addition, trains traveling to Stevens
Creek quarries pass this site three times a week, one roundtrip per day. Because of federal regulations
that require train whistles at crossings, there are no mitigation measures for this noise. The consultants
report shows there is no contamination of the site other than light spills of tar and oil which am
superficial (1 to 2 inches in depth).
